Home My WebLink About91-003 � R E V I S E D DECEMBER 20, 1990 JANUARY 3, 1991 90-471 91-03 ORDINANCE FIRST READING SECOND READING (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: WEST RIDGE ANNEXATION INITIATED BY: THOMAS ftUSCH, ETAL PLAN COMMISSION RECOMMENDATION: Approved 9-0 A GENERAL ORDINANCE OF THE CITY OF OSHKOSH ANNEXING CERTAIN TERRITORY IN THE CITY OF OSHKOSH AND SPECIFICALLY TO THE 13TH WARD OF SAID CITY. The Common Council of the City of Oshkosh do ordain as follows: WHEREAS, an annexation petition duly circulated has heretofore been signed by the owners of all the real property within such territory and all of the electors residing in said territory; and WHEREAS, Section 66.021(12) of the Wisconsin Statutes allows for petition to be filed without a notice of intention to circulate in an annexation by unanimous approval; and . WHEREAS, said annexation petition together with a description of the territory to be annexed and a scale map showing the boundaries of such territory and its relation to the municipalities involved, having been filed with the City Clerk of the City of Oshkosh and the Town of Nekimi; and WHEREAS, a copy of said annexation petition together with a description of the territory to be annexed and a scale map having been mailed to the Director of Planning Function, Department of Resource Development, State of Wisconsin and the appropriate School District Clerk within five (5) days of the filing of said petition; and WHEREAS, not more than one hundred twenty (120) days have lapsed since the filing of the annexation petition; and WHEREAS, the Director of the Planning Function of the Department of Resource Development of the State of Wisconsin has issued his opinion that the annexation is not contrary to the public interest; and WHEREAS, the petitioners have requested that the annexation ordinance temporarily designate the classification of the annexed area for zoning purposes; and WHEREAS, the Plan Commission of the City of Oshkosh is recommending that said property be temporarily zoned as follows: R-3 Multiple Dwelling Planned District ��r 1UE�:I`I`lF:�D �sY �__-�� a � — 4 — ��,��,, a r ^r1�,�D �,� DECEMBER 20, 1990 JANUARY 3, 1991 90-471 9�-03 ORDINANCE (cont'd) NOW, THEftEFORE, the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. The following described territory, pursuant to a duly circulated and filed annexation petition for direct annexation is hereby annexed to and made part of the City of Oshkosh, a municipal corporation located in Winnebago County, more specifically to the. 13th Ward of said City and is annexed for school purposes also and is hereby made a part of the City School District, and subject to Wisconsin Statutes and the amendments thereto; Part of Lot 2 of Winnebago County Certified Survey Map No. 1785 as recorded in Volume 1 of Certified Survey Maps on page 1785, Document No. 692290, being part of the NE 1/4 of the NW 1/4 of Section 4, T17N, R16E, Town of Nekimi, Winnebago County, Wisconsin, which is moce particularly described as follows: Commencing at the N. 1/4 corner of said Section 9; thence S. 00°50'24" E., along the east line of the Nt9 1/4 of said Section 4, 33.00 feet to a point on the southerly R/W line of Waukau Avenue; thence south 89°23'04" W., alonq said southerly R/W line, 34.55 feet; thence S. 89°19'32" W., along said southerly R/W line, 452.98 feet to the northeast corner of Lot 1 of said Certified Survey Map; thence S. 00°40'28" E., along the easterly line of said Lot 1, 328.5 feet to the southeast corner of said Lot 1 and the true point of beginning; thence continuing S. 00°40'28" E. 360.00 feet; thence south 89°19'32" W. 250.00 feet; thence south 70°35'00" W. 60.00 feet; thence S. 63°55'00" W, 165.00 feet; thence N. 28°30'00" W. 100.00 feet; thence north 41°00'00" W. 77.00 feet; thence N. 86°56'19" W. 130.78 feet; thence south 89°19'32" W. 172.00 feet to a point on the westerly line of Lot 2 of Certified Survey Map No. 1785; thence N. 00°59'18" W, along the westerly line of said Lot 2, to the north line of said Section 4, thence east along the- north line of said Section 9 to the extended west line of Lot 1 of said Certified Survey Map, thence S. 00°90'28" E. along the extended west line and the west line of Lot 1 of said Certified Survey Map to the southwest corner of said Lot 1, thence N. 89°19'32" E. 232.00 feet along the soatherly line of said Lot 1 to the true point of beqinning. Said parcel contains 12.04 acres. SECTION 2. Sections 1-28, 1-29, 10-1 and 10-3 of the Oshkosh Municipal Code pertaining to Boundaries,. The proper City officials are hereby suthorized and directed to comply with the following requirements of Section 66.021(8) of the Wisconsin Statutes and the City Clerk shall give written notice to the appropriate Town Clerk of the acceptance of the annexation petition and the adoption of this Ordinance. SECTION 4. That said property hereinabove described is hereby temporarily zoned as follows: R-3 Multiple Dwelling Planned District SECTION 5.
