PURPOSE: APPROVE AGREEMENT WITH REGIONAL DOMESTIC
ABUSE SERVICES, INC.
INITIATED BY: DEPARTMENT OF COMMUNITY DEVELOPMENT.
BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper
City officials are hereby authorized and directed to enter into an appropriate
Agreement with Regional Domestic Abuse Services, Inc. for funding under the City's
1991 Community Development Block Grant Program, in an amount not to exceed
$15,960.00 for the period from March 1, 1991 to February 29, 1992.
BE IT FURTHER RESOLVED that said funding is contingent upon the City's receipt
of 1991 Community Development Block Grant funds from the U.S. Depurtment of
Housing and Urban Development.
BE IT FURTHER RESOLVED that monies for this purpose are hereby appropriated
from the 1991 Community Development Block Grant Program.

A G R E E M E N T
THIS AGREEMENT is between the City of Oshkosh, a Wisconsin municipal corpo�ation, herein referred to as "CITY", and
Regional Danestic Abuse Services, Inc., a Wisconsin non-profit corporation, herein referred to as "RDAS".
I. GENERAL DESCRIPTION
A. The City has received funding from the U.S. Department of Housing and Urban Development (HUD) under the
Title I Camiunity Developrr�ent Block Grant Program, to undertake projects and activities as indicated in
the City�s Final Statement of Community Developnent Objectives and Projected Use of Punds. The activity
set forth in this Agreement�s Scope of Services is one of the said activities and it is the
responsibility of RDAS to carry out the activities in compliance with this Agreement and other applicabte
regulations referred to herein.
B. Funding under this Agreement shall be paid with 1991-92 Cam�unity Development elock Grant (CDBG) funds.
Should said funds not be received by the City, this Agreertient shall be nutl and void.
II. SCOPE OF SERVICES
A. RDAS shall:
(1) Provide emergency housing and counseling for low- and moderate-income persons experiencing domestic
abuse.
(2) Provide the following activities for victims of domestic abuse:
(a) Temporary shelter for abuse victims.
(b) Group support service and counseling.
(c) Camiunity education and advocacy.
(3) Provide said services in accordance with the objectives outlined in RDAS's proposat to the City (see
"Appendix A'�, uhich is attached and fully incorporated into this Agreement>.
B. Said services shall cam�ence on or about March 1, 1991 and shall be canpleted by february 29, 1992.
II1. REPOR7ING RE�UIREMENTS/RECORDS
A. RDAS shall provide quarterly reports to the City beginning June 1, 1997, which at a minimum shall include
the following intormation:
(1) Amount of CDBG funds expended per budget.
(2) Type and amount of services provided.
(3) Nunber of clients and percent of clients from the City.
(4) Nunber of persons in ctients family and family income (if obtainable).
(5) Progress towards program goals.
Records necessary to substantiate these reports shall be kept on file at the RDAS office.
B. Maintain a separate financial account for COBG funds which shows all receipts, including program income,
and disbursements. All disbursements shall have docunentation which substantiates that costs incurred
and paid from the CDBG account are reasonabte, allowable, and allocable per applicabte Federal cost
principals.
C. Provide the City with a copy of an annual audited financial statement for any fiscal year for which RDAS
received CDBG funds under this Agreement.
D. All records required under this Agreement shall be retained for three (3) years after completion of the
project, or after all pending matters relative to this Agreement are closed.
E. RDAS agrees to provide access to the City, the U.S. Department of Housing and Urban Developnent, the
Comptroller General of the United States, or any of their duly authorized representatives to any books,
docunents, papers and records uhich are directly pertinent to this Agreement for the purposes of making
audit, examination, excerpts and transcriptions.
IV. STANDARD PROVISIONS �
A. RDAS agrees in all hiring or employment made possible by or resulting from this Agreement, there (1) will
not be any discrimination against any employee or appiicant for employment because of race, color, sex
orientation, religion, sex or nationat origin; and (2) affirmative action witl be taken to ensure that
applicants are employed and that employees are treated during emptoyment uithout regard to their race,
color, religion, sex orientation, sex or national origin.

This requirement shall apply to but not be limited to the fotlowing: employment, upgrading, demotion or
transfer, recruitment or recruitment advertising, lay-off or termination, rates of pay or other forms of
ca�ensation, and selection for training, including apprenticeship. There shall be posted in conspicuous
places available to employees and applicants for employment, notices required or to be provided by
Federal or State agencies involved setting forth the provisions of the clause. All solicitations or
advertisements for employees shall state that all qualified applicants will receive consideration for
employment without regard to race, color, religion, sex orientation, sex or national origin.
B. RDAS will meke a good faith effort to use minority and women-owned businesses in procurement of supplies,
and upon rec�uest of the City, must provide satisfactory evidence of such effort. Additionally, RDAS
agrees to provide the City with the n�ne(s� and contract amount(s) of all minority and women-owned
businesses awarded contracts on the project.
C. lf the proceeds used under this Agreement result in book or other copyrightable materials, the author is
free to copyright the work, but the approp�iate Federal agency involved reserves a royalty-free
nonexctusive and irrevocable license to reproduce, publish or otherwise use, and to authorize others to
use all copyrighted material and all materials which can be copyrighted.
D. Any discovery or invention arising out of or developed in the course of work aided by this Agreement
shall be promptly and fully reported to the appropriate Federal agency involved for determination by it
as to whether patent protection on such invention or discovery shall be sought and how the rights in the
invention or discovery, including rights under any patent issued thereupon, shall be disposed of and
administered, in order to protect the public interest.
E. ROAS agrees to comply with all applicable standards, orders, or requirements issued under Section 306 of
the Clean Air Act (42 U.S.C. 1857(h)), Secti� 508 of the Clean uater Act (33 U.S.C. 1368), Executive
Order 11738, and Environmental Protection Agency regulations (40 CRF Part 15).
F. RDAS agrees to comply with mandatory standards and policies relating to energy efficiency which are
contained in the State Energy Conservation Plan.
G. No officer, employee or agent of the City who exercises any functions or responsibilities in the review
or approval, or the carrying out of responsibitities to which this Agreertient pertains, shall have any
personal interest, direct or indirect, in this Agreement.
H. Incorporated by reference herein are OMB Circular A-8T, A-110, Attachments A, B, C, G, I, J, M, 0, and
A-122, as applicable.
V. PAYMENT FOR SERVICES
A. Contract Amount
RDAS shall perform all work under this Agreement for an amount not to exceed FIFTEEN THOUSAND NINE
HUNDRED SIXTT DOLLARS AND NO/100 (515,960.00).
e. Method of Pamient
Upon receipt of proper invoice, payment shall be made in two (2) installments of SEVEN THOUSAND NINE
HUNORED EIGHTY DOLLARS ANO 00/100 (57,980.00) each; one in April and o�e in August.
VI. SUSPENSION ANO TERMINATION
A. Yhen RDAS has faited to canply with the terms, conditions or standards of this Agreement or applicable
U.S. Depertment of NUD regulations, the City may, on reasonable notice to RDAS, suspend the Agreement and
withhold further payments or prohibit RDAS from incurring additional obligations of funds, pending
eorrective action by RDAS, or a decision to terminate in accordance with paragraph B belou.
e. This Agreement may be terminated for cause or convenience.
(1) TERMINATION FOR CAUSE: The City may terminate this Agreement in whole or in part at any time before
the date of canpletion, whenever it is determined that RDAS has failed to comply uith the conditions
of this Agreement. The City shall promptly notify RDAS in writing of the determination and the
reasons for the termination, together uith the effective date. Payments made to RDAS or recoveries
by the City in the event this Agreement is terminated for cause, shall be in accordance with the
legal rights and liabilities of the parties.

(2) TERMINATION FOR CONVENIENCE: This Agreement may be terminated in whole or in part when both parties
agree that the continuation of the project would not produce beneficial results cormiensurate uith
the further expenditures of funds. The tuo parties shall agree upon the effective date and in the
case of partial terminations, the portion to be terminated. RDAS shalt not incur new obligations
for the terminated portion after the effective date, and shall cancel as many outstanding
obligations as possible. The City shall allow full credit to RDAS for any noncancellable
obligations properly incurred by RDAS prior to termination.
(3) The pa�ties shall promptly settle the terminated grant and execute a uritten amendnent upon
settlement, which sets forth the terms and conditions of the settlement Agreement.
VII. REVERSION OF ASSETS
RDAS agrees to transfer back to the City any CDBG funds and accounts receivable attributable to the use of
CDBG funds on hand at time of expiration of this Agreement. RDAS further agrees that any real property under
RDAS's controt that was acquired or imp�oved in whole or in part with CDBG funds in excess ot $25,000 is
either:
A. Used to meet one of the national objectives in CfR 570.208 until five years after expiration of this
Agreement, or such longer period of time as determined appropriate by the City; or
B. Is disposed of in a manner which results in the City being reimlwrsed in the amount of the current fair
market value of the property less any portion thereof attributable to expenditures of non-CDBG funds for
acquisition of, or improvement to, the property. Such reimbursement is not required after the period of
time specified in accordance with A. above.
VIII. AMENDMENTS
This Agreement may be amended at any time by a written modification mutually agreeable to both parties
hereto.
IX. INDEMNiFICATION
RDAS agrees to and does hereby hold the City harmless and does hereby inde�mify the City against any ctaims
or demands of any person or legal entity arising by reason of this Agreement.
This Agreement is made this _ day of , 1991, and is specifically binding upon the parties
hereto.

1. PLEASE GIVE A BBIEF DESCBIPTZON OF YOITg AGENCY OR ORGANIZATION AND ITS GOALS.
In this country, a woman is more likely to be assaulted, injured, raped, or killed
by a male partner than by any other type of assailant. Domestic violence is believed to
be the most common yet least reported crime in our nation. An estimated 3 to 4 million
American womea are beaten each year by their husbands or partners. The U.S. Surgeon
General has identified domestic violence as a major health problem to women.
Wife-beating results in more injuries that require medical treatment than rape, auto
accidents, and muggings combined. Each year, more than 1,000 women - or about four
women per daq - are killed by their husbands or partners. Domestic violence is indeed a
serious natioaal problem that affects not only individual victims, but the entire
community as well. .
Regional Domestic Abuse Services is a private non-profit agency serving families
experiencing violence in Winnebago County. Regional Domestic Abuse Services' goal is to
provide services to any family member who is involved in violence and give them the
opportunity to live violent free lives.
Regional Domestic Abuse Services provides ' emergency shelter to women and children,
24 hr. crisis lines, support groups, 1:1 crisis counseling, a Children.'s Program,
Perpetrators Program, and community education.
2. PI,EASE GIVE A BBIEF DESCRIPTION OF THE PROJEGT, INCLDDING OBJEGTIVES AND ACTIVITIES.
A. Regional Domestic Abuse Services is requesting funds for our Children's Program.
Statistics have proved that children who grow up in violence are iavolved in
violence as adults. For boys who grow up in violence 70� will become perpetrators
and 40X of women who witness violence will be abused.
Emotional effects of domestic violence on children include:
* Taking responsibility for the abuse.
* Constant anxiety (that another beating will occur)
* Guilt for not being able to stop the abuse or loving the abuser.
* Fear of abandonment.
Regional Domestic Abuse Services stroagly believes we aeed to provide services to
children. Our Children's Advoccate provides 1:1 crisis counseling, support groups
for children, pareating groups, school arrangements, and prevention presentations in
the school system.
B. Regional Domestic Abuse Services is requesting funds for our Advocate Position.
The Advocate provides all the support groups and 1:1 crisis counseling for women not
needing shelter, as well as counseling and groups for women residing in Shelter. We
provtde daily groups at the Shelter, a Wednesday night open support group at Mercy
Medical and 3 closed 10 week groups each year which average 15-20 women. The
purpose of counseling and support groups is to provide victims with alternatives,
support, education, advocacy, and referrals, so they have options to change their
lives.

BUDGET
Children's Advocate including benefits: $25,200 x 1/3 = $8,400.
Advocate Position including benefits: $22,680.x 1/3 = $7,560

ESTABLISHED BY TSE HIIMAN SERVICES SUBCOMMITTEE.
R.D.A.S. believes the project objective for housing coincides with Human Service
subcommittee guidelines because we are providing emergency housing to low-income
families in order for them to live violenct free lives and develop a suitable living
environment for themselves and their children. Support groups and 1:1 crisis counseling
are very important for any family members who are working towards living violent free
lives. These services are designed to raise individuals self-esteem, offer
alternatives, provide prevention, and educaton to living violeat free lives aad
continued work towards becoming economically independent.
