HomeMy WebLinkAbout91-075 FEBRUARY 21, 1991 91-75 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AGREEMENT WITH CENTER FOR CAREER DEVELOPMENT INITIATED BY: DEPARTMENT OF COMMUNITY DEVELOPMENT BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to enter into an appropriate Agreement with the Center for Career Development for funding under the City's 1991 Community Development Block Grant Program, in an amount not to exceed $13,046.00 for the period from March 1, 1991 to February 29, 1992. BE IT FURTHER RESOLVED that said funding is contingent upon the City's receipt of 1991 Community Development Block Grant funds from the U.S. Department of Housing and Urban Development. BE IT FURTHER ftESOLVED that monies for this purpose are hereby appropriated from the 1991 Community Development Block Grant Program. i__.___._.._.�_____ SIiT'.i:`.1'.i'�`r;L .'c�Y _�____�.�...._.�._.�._.._��_�_ ♦ , 't .�P'`a3`''J-�'�J` . � � - 3 6 - � Rse 91-75 A G R E E M E N T THIS AGREEMENT is between the City of Oshkosh, a Wisconsin municipal corporation, herein referred to as "CITY��, and Center for Career Development, a camiunity agency sponsored by the University of Wisconsin-Oshkosh, herein referred to as "CCDET'�. I. GENERAL DESCRIPTION A. The City has received funding fran the U.S. Department of Housing and Urban Development (HUD) under the Title I Comn�ity Development Block Grant Program, to undertake projects and activities as indicated in the City�s Final Statertient of CamKU�ity Developrnent Objectives and Projected Use of Funds. The activity set forth in this Agreement�s Scope of Services is one of the said activities and it is the responsibility of CCDET to carry out the activities in cortipliance with this Agreement and other applicable regulations referred to herein. B. Funding under this Agreement shall be paid with 1991-92 Camiunity Development Block Grant (CDBG) funds. Should said funds not be received by the City, this Agreement shall be null and void. II. SCOPE OF SERVICES A. CCDET shall: (1) Provide an intensive self-esteem building and skill developnent training program for lou- and moderate-incaae teens falling into one or more of the following categories: teens at greatest risk of becoming pregnant, pregnant teens, and parenting teens. (2) Provide at least three (3) uorkshops of twenty-one (21) teens each and ueekly fottou-up. (3) Secure interagency cooperation. (4) Provide said services in accordance with the objectives outlined in CCDET's proposal to the City (see "Appendix A", which is attached and fully incorporated into this Agreement>. B. Said services shall conmence on or about March 1, 1991 and shall be completed by February 29, 1992. III. REPORTING REQUIREMENTS/RECOROS A. CCDET shall provide quarterly reports to the City beginning June 1, 7991, Which at a minimum shall include the following information: (1) Amount of CDBG funds expended per budget. (2) Type and amount of services provided. (3) Number of clients and percent of clients from the City. (4) Nunber of persons in clients family and family incane. (5) Progress touards program goals. Records necessary to substantiate these reports shall be kept on fite at the CCDET office. B. Maintain a separate financial account for CDBG funds which shows all receipts, including program income, and disbursements. All disbursements shall have docunentation which substantiates that costs incurred and paid from the CDBG account are reasonable, allowable, and allocable per applicable Federal cost principals. C. Provide the City with a copy of an armual audited financial statement for any fiscal year for which CCDET received COBG funds under tnis Agreement. D. All records required under this Agreement shall be retained for three (3) years after completion of the project, or after all pending matters relative to this Agreement are closed. E. CCDET agrees to provide access to the City, the U.S. Department of Housing and Urban Devetopnent, the Comptroller General of the United States, or any of their duly authorized representatives to any books, documents, papers and records which are directly pertinent to this Agreement for the purposes of making audit, examination, excerpts and transcriptions. IV. STANDARD PROVISIONS A. CCDET agrees in all hiring or employment made possible by or resulting from this Agreement, there (1) will not be any discrimination against any employee or applicant for employment because of race, color, sex orientation, religion, sex or national origin; and (2) affirmative action will be taken to ensure that applicants are employed and that employees are treated during employment without regard to their race, color, religion, sex orientation, sex or national origin. - 36a - � Res 91-75 - 2 - This requirement shall apply to but not be limited to the following: employment, upgrading, dertation or transfer, recruitment or recruitment advertising, lay-off or termination, rates of pay or other forms of compensation, and selection for training, inctuding apprenticeship. There shatt be posted in conspicuous places avaitable to employees and applicants for employment, notices required or to be provided by Federat or State agencies involved setting forth the provisions of the clause. All solicitations or advertisements for employees shall state that all qualified applicants uill receive consideration for employment without regard to race, color, religion, sex orientation, sex or national origin. B. CCOET will make a good faith effort to use minority and wanen-owned businesses in procurement of supplies, and upon request of the City, must provide satisfactory evidence of such effort. Additionally, CCDET agrees to provide the City with the name(s) and contract amount(s) of all minority and uomen-oWned businesses awarded contracts on the project. C. If the proceeds used urxler this Agreement result in book or other copyrightable materials, the author is free to copyright the uork, but the appropriate Federal agency involved reserves a royalty-free nonexclusive and irrevocable license to reproduce, publish or otherwise use, and to authorize others to use all copyrighted material and all materials uhich can be copyrighted. D. Any discovery or invention arising out of or developed in the course of work aided by this Agreement shall be pramptly and futly reported to the appropriate Federal agency involved for determination by it as to whether patent protection on such invention or discovery shall be sought arxi hou the rights in the invention or discovery, including rights under any patent issued thereupon, shall be disposed of and a�ninistered, in order to protect the public interest. E. CCDET agrees to comply with all applicable standards, orders, or requirements issued under Section 306 of the Clean Air Act (42 U.S.C. 1857(h)), Section 508 of the Clean Water Act (33 U.S.C. 1368>, Executive Order 11738, and Envirormental Protection Agency regulations (40 CRF Part 15). F. CCOET agrees to comply with mandatory standards and policies relating to energy efficiency uhich are contained in the State Energy Conservation Plan. G. No officer, employee or agent of the City who exercises any functions or responsibilities in the review or approval, or the carrying out of responsibilities to which this Agreement pertains, shall have any personal interest, direct or indirect, in this Agreement. H. Incorporated by reference herein are OMB Circular A-87, A-110, Attachments A, B, C, G, I, J, M, 0, and A-122, as applicable. V. PAYMENT FOR SERVICES A. Contract Amount CCDET shall perform all work under this Agreement for an amount not to exceed THIRTEEN THOUSAND FORTY-SIX DOLLARS AND NO/100 (513,046.00). B. Method of Pamient Upon receipt of proper invoice, payment shall be made in four (4) installments of THREE THWSAND TUO HUNDRED SIXTY-ONE DOLLARS AND 50/100 (53,261.50) each; one in May, August, November and February. VI. SUSPENSION AND TERMINATION A. When CCDET has failed to comply with the terms, ccnd9iions er starsdards of chis Agreement or applicable U.S. Department of HUD regulations, the City may, on reasonable notice to CCDET, suspend the Agreement and withhold further payments or prohibit CCDET from incurring additional obligations of funds, pending corrective action by CCDET, or a decision to terminate in accordance with paragraph B below. e. This Agreement may be terminated for cause or convenience. (1) TERMINATION FOR CAUSE: The City may terminate this Agreement in whole or in part at any time before the date ot completion, whenever it is determined that CCDET has failed to comply with the conditions of this Agreement. The City shall promptly notify CCDET in writing of the determination and the reasons for the termination, together with the effective date. Payments made to CCDET or recoveries by the City in the event this Agreement is terminated for cause, shall be in accordance with the legal rights and liabilities of the parties. - 36b - � Res 91-75 - 3 - (2) TERMINATION FOR CONVENIENCE: This Agreement may be terminated in whole or in part when both parties agree that the continuation of the project would not produce beneficial results conmensurate with the further expenditures of funds. The two parties shall agree upon the effective date and in the case of partial terminations, the portion to be terminated. CCDET shall not incur new obligations for the terminated portion after the effective date, and shall cancel as many outstanding obligations as possible. The City shall allow full credit to CCDET for any noncanceltable obligations properly incurred by CCDET prior to termination. (3) The parties shall pramptly settle the terminated grant and execute a written amendment upon settlement, uhich sets forth the terms and conditions of the settlement Agreement. VII. REVERSION OF ASSETS CCDET agrees to transfer back to the City any CDBG funds and accounts receivable attributable to the use of COBG funds on hand at time of expiration of this Agreement. CCDET further agrees that any real property under CCDET�s control that uas acquired or improved in whole or in part with CDBG funds in excess of 525,000 is either: A. Used to meet one of the national objectives in CFR 570.208 until five years after expiration of this Agreement, or such longer period of time as determined appropriate by the City; or B. Is disposed of in a manner which results in the City being reimbursed in the amount of the current fair market value of the property less any portion thereof attributable to expenditures of non-CDBG funds for acquisition of, or improvement to, the property. Such reimbursement is not required after the period of time specified in accordance with A. above. VIII. AMENDMENTS This Agreement may be amended at any time by a written modification mutually agreeable to both parties hereto. IX. iNDEMNIFICATION CCDET agrees to and does hereby hold the City harmless and does hereby indermify the City against any ctaims or demands of any person or legal entity arising by reason of this Agreertient. This Agreement is made this _ day of , 1991, and is specifically binding upon the parties hereto. Agency Descrlptfon � The Cerrter for Career Development (CCDE�, University of Wisconsin--�shkosh, was founded in 1979 as a youth advocacy and adult career counseling outreach service of the College of Education. Since its creation, CCDET has consistently demonstrated effectiverress in providing services for economicaily disadvar�taged youth and adulis. In receM years, CCDET has been cited by the Department of Public Instruction for the quality of programming and its comprehensive approach. CCDET is frequently sought out by seroica providers around the state for assistanca in curriculum development and other youth program consultation. In addition to working with youth, CCDET staff has years of e�erience in counseling and training adufts. Staff members, with bacicgrounds in social work, education and counseling, have an average of 15 years experience working with low income, under- and unemployed people. The mission of CCDET is to provide training and additional services which will assist individual, groups, or communities in meeting their goals. Z. Description of Project, lnc/uding Objectivas and Activities. We are se�king funding for an intensive self-esteem building and skill development training program far low/moderate income taens who fall into one or more of the following categories: teens at greatest risk of becoming pregnant, pregnaM teens, and parenting teens. This muRi-faceted program addressas many of the problems facing aforeme�tioned groups. The training is designed to do the following: a) build self-esteem � b} develop responsible decision making skills c) provide teens with the means to identify healthy risk-taking d) develop effective communication skills ej �establish appropriate support networks f) identify appropriate role modelslmentors Presentations and activities also relate to issues such as peer pressure, respect and responsbility toward seff and others, and techniques for dealing with dysfunctional family problems. This five day program involves four days of Dynamic Youth Leadership and one day of Outdoor Adventure. Following the initial five days, weskiy follow-up sessions will be held at the high schools to reinforce learning and maintain positive attitudes. The training atmosphere is warm, empowering and supportive. Variativns of this program have been effectively provided to over 540 at risk teens from around the state, including one group of teen parerrts. - 36d - • Res 91-75 Linkages with pregnancy related school programs and community agencies will be established to ensure an adequate blend of services without overlap. At monthiy one hour meetings involved personnel wiil provide input to ensure that a focus on keeping at-risk, pregnant, and parenting teens it� school is maiMained. We will provida eight sessions, 20.students per session, for a total of 160 studems. School staff will compile a list of appropriate referrals. 3. Second, future quality of life for participants wiil be enhanced by their determination to remain in or return to school, a key program goal. Any student who leaves school prior to graduation is three times more likely to be unemployed. If that students is also a teen parent the chance of becoming unemployed, turning to welfare, and bringing up a child with a welfare frame of references increase: 80%of parents receiving AFDC are high school drop-outs. A young person without seif-esteem or education has much less to offer seff., child, or community.
