HomeMy WebLinkAbout91-082 February 21, 1991 # 91-82 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AMENDMENT TO DEVELOPER'S AGREEMENT/ 6th ADDITION TO WESTHAVEN PLAT INITIATED BY: FINTAN FLANAGAN, et al WHEREAS, the Common Council previously approved an agreement to finance improvements in 6th Addition to Westhaven Plat, generally Village Lane , Donegal Court , Galway Court and Candlelight Court; and WHEREAS, during construction of the utilities, the developer requested the City of Oshkosh alter the proposed construction and executed an amended Waiver of Special Assessment Notices and Hearing, which reflects the new final quantities and adjusted costs for all improvements; and WHEREAS, it is necessary to amend the previous developers ' agreement to incorporate the revision; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the amended Waiver is approved and accepted in all respects and the proper City officials are authorized and directed to execute an appropriate amendment to the developers' agreement, originally approved June 21, 1990. --.__.__..__._._._____._.._..____ � J�'.iyi'�l i�'.I�1'�' iJ Y�1 � �,�+!` �i i LO��/ �p'����4�n ,I ( � - 43 - . /je�.'s�.� � , Res 91-82 W1IIVER OE' SPECIIIL I1SS�SSP9EN'I NO`1'ICGS 11NL) HEARING UNDER SEC`t'ION 66 .60 , WISCONSIN STA'i'U'PLS The undersigned , owner of property benefited by tt�e following improvements to be made by the city of Oshkosh , Winnebago County, state of Wisconsin , to wit : SANITARY SEP�ER, STORf•1 SEWER, WATER h1AIN, AND L11TER�1L5 GRI�DING & GRAVELING, CONCRETE PAVING, CONCRETE SID�WIILKS In consideration of the construction of said improvements by the city of Oshkosh, Wisconsin, I hereby admit that suct� public improve- ment will benefit said property and consent to the levying of special assessments against the premises under Section 66.60 of the Wisconsin Statutes for the cost of such improvements.
