Home My WebLink About91-093 . � FEBRUARY 21, 1991 MARCH 7, 1991 91-65 91-93 ORDINANCE ' FIRST READING SECOND READING (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: BAY VIEW PAftK ANNEXATION INITIATED BY: CAROL WISSINK, ETAL PLAN COMMISSION ACTION: Approved 7-0 A GENERAL ORDINANCE OF THE CITY OF OSHKOSFI ANNEXING CERTAIN TERRITORY IN THE CITY OF OSHKOSH AND SPECIFICALLY TO THE 15TH WARD OF SAID CITY. WHEftEAS, an annexation petition duly circulated has heretofore been signed by the owners of more than 50X of the land in the area within such territory, and a majority of the electors residing in said territory, notice of intention to circulate an annexation petition for direct annexation having been duly published, and a copy of said notice with a scale map reasonably showing the boundaries of the area sought to be annexed and its relation to the municipalities involved, having been duly served upon the affected municipal and school district clerks and the Director of the Planning Function, Department of Resource Development, State of Wisconsin, within five (5) days of the date of publication of said notice, adoption of this Ordinance shall constitute acceptance of the petition of annexation; and WHEREAS, more than twenty (20) days have lapsed since the publication of the notice of intention to circulate such annexation petition and not more than one hundred twenty (120) days have lapsed since the filing of the annexation petition; and WHEREAS, the Director of Planning Function of the Department of Resource Development of the State of Wisconsin has issued his opinion that the annexation is not contrary tc the public interast; an3 WHEREAS, the Plan Commission of the City of Oshkosh has recommended that said property be temporarily zoned as follows: R-1 Single Family Residence and C-1 Neighborhood Business (per the attached "Exhibit B") ' NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as follows: SECTION 1. The following described territory, pursuant to a duly circulated and filed annexation petition for direct annexation is hereby annexed to and made part of the City of Oshkosh, a municipal corporation located in Winnebr�go County, more specifically in the 15th Ward of said City and is annexed for school purposes also and is hereby made a part of the City school district, and subject to all the laws governing the same, all in accordance with Section 66.021 of the Wisconsin Statutes and the amendments thereto: - 9 - , " FEBRUARY 21, 1991 MARCH 7, 1991 91-65 91-93 ORDINANCE (cont'd) A part of the NE 1/4 and the NE 1/4 of the SE 1/4 of Section 1, Township 18 North, Range 16 East, Town of Oshkosh, Winnebago County, Wisconsin, described as followa: Commencing at the intersection of the East line of County Rond A with t.he Sout:h line of Ridge Lane; thence East along the South line of Ridge Lane to the Northeast Corner of Lot 15, Bay VieH Park Plat; thence South along the East line of said Lot 15 to the Southeast corner of said Lot 15; thence East along the South lines of Lots 14, 13 and 12 to the Southenst corner of said Lot 12; thence continue East across Shady Lane to the Southwest corner of Lot 67 of the said Buy VieN Park Plat; thence East along the South line of said Lot 67 of the Bay View Park Plat to the Western shoreline of Lake Winnebago; thence Northerly along ttie Western ahoreline of Lake Winnebago to the Southerly line of Lot 36, Assessor's Plat No. 1 of the Town of Oahkosh; thence Westerly along Southerly line of said Lot 36 to the SouthNest corner of said Lot 36; thence Northerly alorig the Westerly line of Lots 36, 35, 34, 33, 32 and 31 to the NorthNest corner of Lot 31 of said Assessor's Piat No. 1 of the Town of Oshkosh; thence Easterly along the Northerl,y line of said Lot 31 to the Westerly shoreline of Lake Winnebago; thence Northerly along the Westerly shoreline of Lake Winnebago to a point 100 feet North of the South line of the NE 1/4 of the NE 1/4 of said Section 1; thence West parnllel und 100 feet North thereof the South line of the N 1/2 of the NE 1/4 of said Section 1 to the Easterly right-of-way line of t}�e Fox River Valley R.R.; thence South along the Easterly right-of-way of the Fox River Valley R.R. to a point 11 feet South of the North line of the SW 1/4 of the NE 1/4 of said Section 1; thence East parallel to and 11 feet South thereof the North line of the S 1/2 of the NE 1/4 of said Section 1 to the East line of County Road A; thence South along the East line of County Road A to the point of commencement. Said parcel contains approximately 27.1 acres. SECTION 2. Section 1-28, 1-29, 10-1 and 10-3 of the Oshkosh Municipal Code pertaining to Boundaries, Wards, Polls, Benchmarks are hereby amended so as to reflect the provisions of this Ordinance and the proper City officials are hereby authorized and directed to make such changes. SECTION 3. This Ordinance shall be in full force and effect from arid after its passage. SECTION 4. The proper City officials are hereby authorized and directed to comply with the following re�uir�mpnts of Sea�icn 65.021(8) of the Wisconsin Statutes and the City Clerk shall give written notice to the appropriate Town Clerk of the acceptance of the annexation petition and the adoption of this Ordinance. SECTION 5.
