PURPOSE: STATE ROAD 110 ANNEXATION
INITIATED BY: WILLIAM RASMUSSEN, ETAL
PLAN COMMISSION ACTION: Approved 6-0
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH ANNEXING CERTAIN TERRITORY IN THE CITY
OF OSHKOSH AND SPECIFICALLY TO THE 12TH WAftD OF SAID CITY.
WHEREAS, an annexation petition duly circulated has heretofore been signed by
the owners of more than 50% of the land in the area within such territory, and a
majority of the electors residing in said territory, notice of intention to
circulate an annexation petition for direct annexation having been duly published,
and a copy of said notice with a scale map reasonably showing the boundaries of
the area sought to be annexed and its relation to the municipalities involved,
'�aving been duly served upon the affected municipal and school district clerks and
the Director of the Planning Function, Department of Resource Development, State
of Wisconsin, within five (5) days of the date of publication of said notice,
adoption of this Ordinance shall constitute acceptance of the petition of
annexation; and
WHEREAS, more than twenty (20) days have lapsed since the publication of the
�otice of intention to circulate such annexation petition and not more than one
hundred twenty (120) days have lapsed since the filing of the annexation petition;
and
WHEREAS, the Director of Planning Function of the Department of Resource
Development of the State of Wisconsin has issued his opinion that the annexation
is not contrary to the public interest; and
, WHEREAS, the Plan Commission of the City of Oshkosh has recommended that said
property be temporarily zoned as follows:
R-1 Single Family Residence Planned District, C-2 Light Commercial Planned
District, M-1 Light Industrial Planned District, M-3 Heavy Industrial
Planned District and M-3 Heavy Industrial (per the attached "Exhibit B")
NOW, THEREFORE, the Common Council of the City of Oshkosh do ordain as
follows:
SECTION 1. The following described territory, pursuant to a duly circulated
and filed annexation petition for direct annexation is hereby annexed to and made
part of the City of Oshkosh, a municipal corporation located in Winnebago County,
more specifically in the 12th Ward of said City and is annexed for school purposes
also and is hereby made a part of the City school district, and subject to all the
laws governing the same, all in accordance with Section 66.021 of the Wisconsin
Statutes and the amendments thereto:

A part of Section 33-19-16. S. 1/2 of Section 39-19-16, and
Section 3-18-16, all in the Town of Oshkosh, Winnebago
County, Wisconsin, described as follows: �
Beginning at the northeast corner of Algoma Boulevard
(S.T.H. 110) and Stillman Drive, thence northeasterly
along the northerly line of Stillman Drive 253.87 feet,
thence N. 00°14'15" W. 349.08 feet, thence west
parallel to the north line of the SW 1/4 of the SE 1/4
of said Section 3 to the easterly line of Algoma Boule-
vard (S.T.H. 110), thence northerly along the easterly
line of Algoma Boulevard (S.T.H. 110) to the easterly
line of U.S.H. 41, thence northeasterly along the
easterly line of U.S.H. 41 to the east line of NE 1/4
of the SW 1/4 of said Section 3. thence north along the
east line of the NE 1/4 of the SW 1/4 of said Section 3
to the northeast corner of said NE 1/4 of the SW 1/4 of
said Section 3, thence north along the east line of the
SE 1/4 of the NW 1/4 of said Section 3 to the center-
line of U.S.H. 41, thence northeasterly along the ,
centerline of U.S.H. 41 to a point 925 feet south of
the north line of the NE 1/4 of said Section 3, thence
west parallel to the north line of the NE 1/4 of said
Section 3 to a point 2440.06 feet west of the east line
of said Section 3, thence north 925 feet to the north
line of said Section 3, thence west along the north
line of said Section 3 to a point 304.61 feet west of
the S. 1/4 cornec of said Section 34, thence north .
253.00 feet, thence east 166.02 feet, thence south
220.00 feet to the north line of Fountain Avenue,
thence east along north line of Fountain Avenue to the
• west line of properties described in Doc. 603144,
Winnebago County Recocds, thence N. 04° E, to a point
1300 feet from the southwest corner of groperties
described in said Doc. 603149, thence N. 65 W. to the
centerline of a Slough, thence southwesterly along
centerline of a Slough to the northeasterly line of
State Road 110, thence northwesterly along the north-
easterly line of State Road 110 to the west line of
the NW 1/4 of the SW 1/4 of said Section 34, thence
south along the west line of the NW 1/4 of the SW 1/4
of said Section 34 to the centerline of Old State Road
110, thence nocthwestecly along the centerline of Old
State Road 110 to the north line of Ryf Road, t}�ence

tion with the north line of West Wind Road extended

line 360.59 feet south of and parallel to the north
line of the SE 1/4 of the SW 1/4 of said Section 3 to
the centerline of Algoma Boulevard , thence
southeasterly along the centerline of Algoma Boulevard
to the extended south line of lands described in
Certified Survey Map No. 1384, Winnebago County
Records, thence east along the extended south line and
the south line of lands described in said C.S.M. 1384
to the east line of Lot 1 of said C.S.M. 1384, thence
N. 00°14'27" E. 178.31 feet along the east line of said
Lot 1 to the south line of Stillman Drive, thence
westecly along the south line of Stillman Drive to the
southeast corner of Stillman Drive and Algoma Boule-
vard, thence northwesterly to the northeast corner of
Stillman Drive and Algoma Boulevard, also being the
place of beginning.
Said parcel contains approximately 347 acres.
SECTION 2. Section 1-28, 1-29, 10-1 and 10-3 of the Oshkosh Municipal Code
pertaining to Boundaries, Wards, Polls, Benchmarks are hereby amended so as to
reflect the provisions of this Ordinance and the proper City officials are hereby
authorized and directed to make such changes.
SECTION 3. This Ordinance shall be in full force and effect from and after
its passage.
SECTION 4. The proper City officials are hereby authorized and directed to
comply with the following requirements of Section 66.021(8) of the Wisconsin
Statutes and the City Clerk shall give written notice to the appropriate Town
Clerk of the acceptance of the annexation petition and the adoption of this
Ordinance.
SECTION 5. That said property hereinabove described is hereby temporarily
zoned as follows:
R-1 Sin�le Family Residence Planned District
C-2 Light Commercial Planned District
M-1 Light Industrial Planned District
M-3 Heavy Industrial Planned District
M-3 Heavy Industrial .
