MEMORANDUM OF UNDERSTANDING

Under the authority of Sec. 66.0301 of Wis. Stats., this agreement is entered into between the
Winnebago County Sheriff's Office, Winnebago County Emergency Management, Winnebago
County District Attorneys' Office, Oshkosh Police Department, Oshkosh Fire Department,
Neenah Police Department, Menasha Police Department, Town of Menasha Police Department,
Town of Menasha Fire Department, Omro Police Department, Winneconne Police Department
and the Wisconsin Department of Corrections.. The purpose of this Memorandum of
Understanding (MOU) between the aforementioned parties is to establish a formal framework
for joint actions involving the parties as it retates to the participation of agency members with the
Winnebago County Child Abduction Response Team (CART). The terms and conditions for this
reciprocal mutual aid agreement are as follows:
1. The aforementioned parties recognize the goal of providing citizens with proficient, well-
equipped, and professional emergency services. Protecting the children of our community
is one of the core responsibilities of these agencies.
2. The aforementioned parties have identified a group of emergency responders that serve as
members of a specially trained group referred to as a Child Abduction Response Team
(CART).
3. CART members, while working as a Winnebago County CART, shall remain an employee of
their respective agency at all times. All wages, salaries, fringe benefits, retirement
contributions, social security contributions, disability retirement contributions or benefits,
unemployment compensation contribution or benefits and workers compensation benefits
will be those approved by the employee's individual employer and applicable labor
agreements.
4. Winnebago County CART members should complete a minimum eight-(8) hour basic CART
course and participate in organized CART training designated by the CART Coordinator. All
wages and disability payments, pensions and Worker's Compensation claims, clothing and
medical expenses relating to the training will be paid by the agency regularly employing the
employee.
5. Participating agency Non-CART members, while working on an incident with Winnebago
County CART, shall remain an employee of their respective agency at all times. All wages,
salaries, fringe benefits, retirement contributions, social security contributions, disability
retirement contributions or benefits, unemployment compensation contribution or benefits
and workers compensation benefits will be those approved by the employee's individual
employer and applicable labor agreements.
6. The Winnebago County CART can be activated by the Command Staff of any law
enforcement agency within Winnebago County once the activation criteria have been met.

The activation criteria, along with the activation procedure, can be Iocated within the
Winnebago County CART protocols or simply by contacting the CART Coordinator(s).
7. During CART activations, the requesting agency is required to have an Incident Commander
not assigned to the CART Team present in the Command Post at all times.
8. This agreement will expire on December 31, 2015, but shall automatically renew according
to these terms for successive one-year periods unless any party gives all others not less
than 60 days advance notice. Any party may cancel this agreement at any time, provided
that a 30 day written notice is provided to the other party.
9. Should any provision of this agreement be determined to be illegal by any Court, it is
intended that all other provisions of the agreement will remain in force.
