Greuel, Chief of Police DATE: March 4, 2015 RE: Approve Child Abduction Response Team(CART) Memorandum of Understanding BACKGROUND Child Abduction, although infrequently occurring in Oshkosh or Wisconsin, is an event that can tear a community apart and often ends in tragedy. Protecting the children of our community is a primary function of any public safety agency. An appropriate response by law enforcement in the first few minutes and hours of an investigation can help to achieve a successful outcome and save lives. A child abduction investigation is very manpower and resource intensive and requires coordinated response acting within the Incident Command System. In the past year or so, law enforcement agencies in Winnebago County and personnel from other entities such as fire, schools, IT, medical,probation/parole, sex offender registry, etc., got together to form a multi-agency Winnebago County Unified Child Abduction Response Team (CART)to mare effectively investigate child abduction or missing children incidents. City of Oshkosh Departments including Police, Fire and Information Technology have all committed personnel and resources to the CART Team. The Winnebago County Unified CART Team was modeled after other successful teams formed and operating in other parts of this country. The development of the team and training of personnel assigned to the Winnebago CART has been occurring over the past year with an evaluated tabletop exercise occurring in late March 2015. This Memorandum of Understanding not only solidifies a long-term commitment to CART that is consistent with mutual aid and intergovernmental cooperation as outlined in state statutes, but also publicly recognizes the collaboration and coordination of various public safety, intergovernmental and community agencies working together on an important issue. The Oshkosh Police Department, Oshkosh Fire Department and Oshkosh Information Technology Division commit to providing specially trained personnel, equipment or other appropriate resources to respond to and assist in the investigation of any child abduction or certain missing children investigation that occurs in Winnebago County, and as requested by the agency of jurisdiction as outlined in the CART agreement. The Oshkosh Police Department agrees to activate the CART Team for such incidents occurring in the city of Oshkosh. The Mission of the Oshkosh Police Department is to promote public safery and to enhance the quality of life in our community through innovative policing and community partnerships ANALYSIS As stated, abduction incidents are not common in our area, but when it happens the safety of the child is the primary concern with these investigations being very time sensitive. The Oshkosh Police Department has activated one Amber Alert since the inception of the statewide Amber Alert system for a possible child abduction incident a few years ago that met the criteria for such an alert. More recently, local police have investigated suspicious person incidents reported by children in our communities that raises our concern. Personnel assigned to the Winnebago County Unified CART Team have been involved in the development of the attached procedures. Oshkosh Police Department Captain Kurt Schoeni and Winnebago County Sheriff Captain Dave Mack are Co-Coordinators for the CART Team. Oshkosh Police Chief Scott Greuel, Oshkosh Fire Chief Tim Franz and IT Director Tony Neumann have all reviewed and approved the CART procedures and Memorandum of Understanding as presented. Staff recommends approval of this CART Memorandum of Understanding by the Oshkosh Common Council. FISCAL IMPACT The only cost to the Oshkosh Police Department to date since the development of CART is $1198, which includes sending two Police Detectives to Baltimore, MD to enhance their skills for investigating child abductions. No additional equipment has been purchased and no new equipment needs are anticipated in the future. The costs to date for Fire and IT personnel have been minimal as training has been done on regular work time. Future on- going training costs to Oshkosh Police, Fire, and IT personnel assigned to specific roles or assignments in the CART incident command structure would be absorbed into our regular training budgets. We would also explore the availability of state or federal grants for any future costs as needed. When activated, city personnel overtime costs would also be likely as is the case with any other prolonged critical incident or investigation. Assisting agencies would cover their own personnel and other resource costs. RECOMMENDATION We recommend approval by the Oshkosh Common Council of this Agreement to create a multi-agency Child Abduction Response Team (CART) for effective and successful investigation of child abduction or missing children incidents. Stats., this agreement is entered into between the Winnebago County Sheriff's Office, Winnebago County Emergency Management, Winnebago County District Attorneys' Office, Oshkosh Police Department, Oshkosh Fire Department, Neenah Police Department, Menasha Police Department, Town of Menasha Police Department, Town of Menasha Fire Department, Omro Police Department, Winneconne Police Department and the Wisconsin Department of Corrections.. The purpose of this Memorandum of Understanding (MOU) between the aforementioned parties is to establish a formal framework forjoint actions involving the parties as it relates to the participation of agency members with the Winnebago County Child Abduction Response Team (CART). The terms and conditions for this reciprocal mutual aid agreement are as follows: 1. The aforementioned parties recognize the goal of providing citizens with proficient, well- equipped, and professional emergency services. Protecting the children of our community is one of the core responsibilities of these agencies. 2. The aforementioned parties have identified a group of emergency responders that serve as members of a specially trained group referred to as a Child Abduction Response Team (CART). 3. CART members, while working as a Winnebago County CART, shall remain an employee of their respective agency at all times. All wages, salaries, fringe benefits, retirement contributions, social security contributions, disability retirement contributions or benefits, unemployment compensation contribution or benefits and workers compensation benefits will be those approved by the employee's individual employer and applicable labor agreements. 4. Winnebago County CART members should complete a minimum eight-(8) hour basic CART course and participate in organized CART training designated by the CART Coordinator. All wages and disability payments, pensions and Worker's Compensation claims, clothing and medical expenses relating to the training will be paid by the agency regularly employing the employee. 5. Participating agency Non-CART members, while working on an incident with Winnebago County CART, shall remain an employee of their respective agency at all times. All wages, salaries, fringe benefits, retirement contributions, social security contributions, disability retirement contributions or benefits, unemployment compensation contribution or benefits and workers compensation benefits will be those approved by the employee's individual employer and applicable labor agreements. 6. The Winnebago County CART can be activated by the Command Staff of any law enforcement agency within Winnebago County once the activation criteria have been met. The activation criteria, along with the activation procedure, can be located within the Winnebago County CART protocols or simply by contacting the CART Coordinator(s). 7. During CART activations, the requesfing agency is required to have an Incident Commander not assigned to the CART Team present in the Command Post at all times. 8. This agreement will expire on December 31. 2015, but shall automatically renew according to these terms for successive one-year periods unless any party gives all others not less than 60 days advance notice. Any party may cancel this agreement at any time, provided that a 30 day written notice is provided to the other party. 9. Should any provision of this agreement be determined to be illegal by any Court, it is intended that all other provisions of the agreement will remain in force. Winnebaao CART—AuthoritvlResponse Criteria The Winnebago CART will activate at the request of any Winnebago County law enforcement agency. Winnebago CART Team Members are au#horized to assist in investigations of abduction or endangerment of children within Winnebago County upon the request af a participating law enforcement agency Chief Administrator (Sheriff, Chief of Police or his/her designee) and the approval of the Winnebago CART Coordinator(s), B. Winnebaqo CART criteria for activation: 1. The occurrence of any of the following incidents may initiate investigative involvement, assistance, or coordination by the Winnebago CART Members: a. Any incident that meets the Wisconsin Amber Alert Criteria: 1. Child must be 17 years of age or younger 2. Child must be in danger of serious bodily harm or death. 3. Initiating agency must have enough descriptive information about the child, the suspect(s} and/or the suspect vehicle{s)to believe an immediate broadcast alert will he}p {ocate the child b. The non-family adduction of a child under the age of 18 or; c. A child under the age of 18 and whase whereabouts are unknawn to his ar her parents, guardian or responsible party, and with at least one of the following unusual circumstances: 1. Out of the zone of safety for his/her age, developmental stage and/or physical condition. NOTE.� The zone of safety will vary for each child depending on the above conditions. For example, in the case of an infant, the zone of safefy is limited fo the immediate presence of an adult custodian or fhe safe area the infant is placed. For a schoo!-aged childe, the zone of safefy may be the immediafe neighborhood or roufe between home and school and ofher activifies. 2. Mentally Diminished. NOTE: /f fhe child is developmenfa!!y disabled or emotionally disfurbed, he/she may have difficulfy communicating wifh others about needs, identity, or�address and may be more prone ta exploitation. 3. Medicai and/or Drug Dependent. c. Any other abduction or missing child investigation that requires an immediate response in order to profect a child whose life or wellbeing is perceived to be at risk (due to violence or health conditions) or if an abductor has expressed a potential for violence ar could endanger the child. , z C. Winnebaqo CART-Activation Notification 1. Once approved, the CART Coordinator(s} will instruct 8-1-1 to send a voice and text message (via Aiert Sense) to the Winnebago CART members. The message will give instructions to the CART members on where to report. If possible, the CART members will acknowledge receiving the voice message by pressing 1. 2. As the incident progresses, the individual CART Section Leader(s} will de#ermine how many members they naed to remain to accomplish the needs of the investigation, Once this has been determined, the CART Coordinator(s) will release selected CART members so they can be available at a later time to relieve those that remain on the initial activation. D. Winnebaqo CART— Incident Command 1. The Winnebago CART is a resource to all Winnebago County law en#orcement agencies. The requesting law enforcemen# agency will maintain incident command of the missing child investigation and will work in conjunction the Winnebago CART Coordinator(s). All Winnebago CART Operations will be conducted from The Winnebago County EOC unless an alfernative EOC is designated by the Winnebago CART Coordinatar(s). 2. Responsibilities of the Winnebago CART Coordinator(s}: a. The Winnebago CART Coordinator(s}will be responsible for directing the investigation and working to assist the lncident Commander of the requesting law enforcement agancy. CART Coordinator(s)will work in conjunction with the CART divisional leaders and aversee all CART operations. The CART Coordinator{s) will be tasked with oversight of the following divisions: 1. Logistics Division 2. Search Operations Division 3. Investigations Division 4. Intelligence Division 5. Legal Division E. Winnebaao CART- Lo�istics 1. The Winnebago CART Logistics l,eader(s} is responsible to maintain a complete list of resources that may be needed on CART activation. This includes, but is not limited to: K-9 tracking dogs, search and rescue services, dive teams, air support, FLIR units, ceN phanes, GPS tracking, polygraphers, and miscellaneous equipment. 2, The Winnebago CART Logistics E.eader(s) are responsible for: ' 3 a. Transporting the Winnebago CART equipment to the appropriate venues. b. Ensure requesting agency has arranged (ocations for the CART venues. c. Securing Op channels through Winnebago County Communications Center.(Appendix Aj d. Ali computer equipment is properly set up in the Emergency Operations Center Ensuring Winnebago CART forms are available to the search and investigation venues. (Appendix B} e. Interface with requesting agency's dispatch in order to route cafis from dispatch to the EOC. (Appendix B} f. Arrange resources as needed. g. Organize CART related trainings, exercises, meetings and maintain of all associated records. F. Winnebaqo CART- Search Operations 1. The Winnebago CART Search Leader(s) will ensure: a. Timefy briefings are held to update searchers on the progress of the investigation. b. The search venue has sufficient personnel and resources. c. The civilian volunteer venue has sufficient personnel and resources. d. The Winnebago CART search members are supplied with all search and canvass forms. e. Searches are conducted and documented properly. f. The Logistics Leader(s) are contacted if additionai resources are needed (e.g. K-9, dive team, search and rescue). 2. The Winnebago CART Volunteer Search Leader{s)will ensure: a. The Logistics Leader(s) are contacted to confirm a loca#ion for the voiunteer venue has been selected. b. The civilian volunteer venue has sufficient personnel, resources and CART equipment. c. All civilian volunteers have fiiled out the Registration Agreement form. d. All civilian volunteers have cleared a background check. e. All civilian vo�unteers have watched the Winnebago CART volunteer instructional video and a##ended a briefing/debriefing, f. All civilian volunteers have proper a#tire and identifiers. g. Searches are conducted and documented properly. h. Civilians are not conducting door-to-door searches in neighborhoods. 3. VIlinnebago CART searchers are required to document, in a written report, all pertinent information they have discovered as a result of their search effarts. Officers/Searchers may be provided digital recorders to dictate reports. G. Winnebaqo CART— Investiqations 1. In compliance with the Winnebago CART organizational structure, the Winnebago CART Investigation Leader(s) will work side-by-side with the requesting law enforcement agency's iead investigator. , 4 2. The Winnebago CART Investigation Leader(s) will oversee personnei in the following areas: a. Canvass Operations b. Lead Management a Crime Scene Processing d. Victim/Family Advocate & Liaison 3. The Winnebago CART Investigation Leader(s)will ensure: a. All leads and tips are properly and thoroughly investigated b. Family members are removed from the residence and relocated to a safe residence. c. A camplete interview and investigation of family members is conducted. d. Provide the family with a Victim Advocate e, Updated investigation information is distributed to Winnebago CART investigators. f. All Winnebago CART investigators complete reporEs in a timely manner. g. Registered sex offenders are contacted and interviewed. h. Collect DNA from the child's personal belongings. i. Obtain current photographs of the child. j. Give child's photographs to Intel for creation of poster. k. Digital evidence is fawfully collected and preserved (Computers, cell phones, surveillance cameras). I. Appfy for cell phone"tower dumps" and/or"real time" ceil phone tracking. m. Arrange for garbage collection to be dumped in designated area. 4. Winnebago CART investigators are required to dacument, in a written report, all information they have discovered as a result of their investigation. H. Winnebaqo CART- Intelliqence 1. The Winnebago CART lntelligence Leader(s)wi11 ensure: a. Afl investigative leads are entered in to the MACE database. b. Data entry completes the Winnebago CART Lead four-part #orm and provides the document to the Priority Leads staff. c. The Priority Leads Staff prioritizes the investigative lead and provides the document fo the Investigative L.eads staff. d. All investigative reports are enfered into the MACE database. e. A timeline af events is documented throughout the activation. f. Maps are prepared for the LEO and civilian searchers. I, Winnebaqa CART— LeqaE Issues 1. When a child goes missing in Winnebago County, Winnebago County Unified CART, per the Multi-Jurisdictional Mutual Aid Agreement for Sheriff and Police Services, law enforcement agencies have agreed that should they have the need for resources from other Winnebago County law enforcement agencies (police, support personnel, etc.)the other agencies will provide the resources if possible. In the event a child goes missing in other Winnebago jurisdictions, each law enforcement agency that participates in 1 ' S Winnebago CART has the sole discretion to determine whether or not its resources can be spared to the requesfing agency. 2. The Winnebago CART has an attorney from the Winnebago County District Attorney's Office. The attorneys pravide legai counsel on search and seizure, search warrants, and other legal processes. The city/counfy in which the child goes missing wiEl have primary legal authority and the decision on whether to use local, county, state, or federal prosecutors wifl be determined by the requesting law enforcement agency wi#h input from the local, county, state, and federal prosecutors. J. Winnebago CART- Media Relations 1. Media relations regarding the missing child are the responsibility of the venue law enforcement agency. Winnebago CART will maintain a trained Public Informafion Officer (P10) that can be utilized by the venue agency upon request. In the event additional Public Information Of�cers {PIOs) are needed, the requesting agency Pubiic lnformation Officer (Pl0} can utilize a predetermined Joint Information Center (JIC) and/or Winnebago CART Public Information Officer{PIO). K. Winnebaqo CART- Reportinq 1. All Winnebago CART reports will be documented under one Winnebago County Sheriff s Office report number. Each law enforcement agency will designate one word processor that will be granted access to the Winnebago County Sheriff's Office LRMS to assist with work flow. L. Winnebago CART- Reuni�cation 1. Once khe child has been located, Winnebago CART will offer assistance to the requesting agency investigatars to facilitate the reunification, forensic interview, forensic medical examination, psychological resources, Crime Victim's Reparation services and Child Protective Services (if the child should not be returned to his/her legal guardians.) The requesting agency will be encouraged to use #he Children's Advocacy Center for forensic interview and the forensic medical examination. 2. If during the forensic interview the child provides information to investigators that requires follow-up, Winnebago CART wilf ofier assistance to the requesting agency investigators with their on-going investigation.
