PURPOSE: APPROVE AGREEMENT FOR HIGHWAY IMPROVEMENT - USH 45
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City of Oshkosh
that the attached Agreement for Highway Improvement Project, said
project being USH 45, 4. 106 miles, is hereby approved and the proper
City officials are hereby authorized and directed to enter into said
agreement.
BE IT FURTHER RESOLVED that money for this purpose is hereby
appropriated from: Acct. No. 338-999, Street Improvement Expendi-
tures. (This will be reimbursed from the 1992 Capital Improvements
Program. )

Attached are three copies of the State/Municipal Agreement for the above
1992 highway improvement project. This agreement sets the terms and the
estimated costs for the following items:
1. The adjustment of 34 sanitary manholea
2. 1-inch and 3-inch non-metallic conduit
3. Pull boxes
The traffic signal items will be required at Murdock Street, Smith Street,
Fernau Avenue and Packer Avenue.
The city of Oshkosh will provide 100$ funding of these non-participating
items.
If this project agreement meets your approval, please return two signed
copies.
We also need a copy of the resolution authorizing the expenditure.

The signatory city, village, town or county, hereinafter called the
Municipality, through its undersigned duly authorized officers or officials,
hereby requests the State of Wisconsin Department of Transportation,
hereinafter called the State, to initiate and effect the highway or street
improvement hereinafter described.
The authority for the Municipality to enter into agreements with the
State is extended by Section 86 . 25(1) , (2) , and (3) of the Statutes.
NEEDS AND ESTIMATE SUMMARY:
Existing Facility - Describe and give reason for request: Zhe existing cancrete
surface canstructed in 1950 is deteriorated and is in need of frequent repairs. Zhe existing
facility does not need capacity needs. There are nwr►erous accidents at intersections.
P r op o s e d I mp r o v e m e n t - N a t u r e o f w o r k: 'It►e roadway will be widened to a f ive-lane
roadway - 4 - 12 foot traveled lanes and a center 14-ft. left turn lane traffic signals will
be installed.
Describe non-participating work included in the project and other work
necessary to finish the project completely which will be undertaken
independently by the municipality: Non-part.icipating itens are: the adjustrnent
of 34-sanitary manholes, 1-inch and 3-inch non-►r�etallic canduit and pull boxes.

This request is made by the undersigned under proper authority to make such
request for the designated Municipality and upon acceptance by the State sha11
constitute agreement between the Municipality and the State.

TERMS AND CONDITIONS:
1. The initiation and accomplishment of the improvement will be subject
to the applicable Federal and State regulations.
2. The Municipality will pay to the State all costs incurred by the
State in connection with the improvement which exceed Federal/State financing
commitmenta or are ineligible for Federal/State financing.
3. Funding of each project phase (preliminary engineering, real estate,
conetruction, and other) ia eubject to inclusion in an approved program. Federal
aid and/or State highway fund financing will be limited to participation in the
costs of the following items:
(a) The grading, base, pavement, and curb and gutter.
(b) Catch basina and inlets for surface water drainage of the
improvement, with connectiona to the storm sewer main.
(c) Conatruction engineering incident to inspection and
supervision of actual conatruction work.
(d) Signing and pavement marking, including detour routes.
(e) Other:
Note: The following itema may be included in paragraph 3 as eligible for
state/federal participation or included in paragraph 4 as entirely financed by
the municipality of other utility or facility owner.
Storm aewer maine necessary for the surface water drainage.
Construction or replacement of sidewalks and reaurfacing of private
driveways.
New installations or alternation of etreet lighting and traffic
signals or devices. ,
Real Estate for the improvement.
Preliminary engineering and state review services.
4. Work necessary to complete the. improvement to be financed entirely
by the Municipality or other utility or facility owner includes the following
items.
(a) New installation of or alteration of sanitary sewers and
connections, water, gas electric, telephone, telegraph, fire
or police alarm facilities, parking meters, and aimilar
utilitiea.
(b) Other: Adjuating 34-sanitary manholes and installation of
1-inch and 3-inch non-metallic conduit, pull boxes at Murdock
Street, Smith Street, and Fernau Avenue and Packer Avenue
intersections.

5. As the work progresses , the Municipality will be billed for work
completed which is not chargeable to Federal/State funds . Upon completion of
the project, a final audit will be made to determine the final division of
coscs.
6. If the Municipality should withdraw the project, it will reimburse
the State for any costs incurred by the State in behalf of the project.
7. The work will be administered by the State and may include items not
eligible for Federal/State participation.
8. The Municipality will:
(a) Maintain all portions of the project that lie within its
jurisdiction for such maintenance through statutory
requirements, in a manner satisfactory to the State and will
make ample provision for such maintenance each year.
(b) Prohibit angle parking.
(c) Regulate or prohibit all parking at locations where and when the
pavement area usually occupied by parking vehicles will be
needed to carry active traffic in the street. .
(d) Regulate and prohibit, by ordinance, parking at all times on

(e) Assume general responsibility for all public information and
public relations for the project and to make fitting
announcement •to• the press and such outlets as would generally
alert the affected property owners and the community of the
nature, extend, and timing of the project and arrangements for
handling traffic within and around the projects. '
(f) Provfde complete plans, specifications, relocation order, real
estate plat, and estimates.
