�� The "prevailing hours of labor" for all classes of laborers and mechanics are eight hours per day and forty
hours per calendar week. All work performed in excess of these prevailing hours must be paid at a rate of at least
1-1/2 times the hourly basic rate of pay, plus fringe benefits, if appticable.
2� A wage rate is available for a learner� helper, preapprentice, trainee or other similar classification for
this trade or occupation. Any employer who Wishes to use such a classification must request the applicable wage
rate� in writing� from this department prior to starting work on this project.
3� A wage rate is available for a learner, helper� preapprentice, trainee or other similar classification only if
a bona fide indentured apprentice in the same classification is also employed by the requestor. Any employer who
wishes to use such a classification must request the applicable wage rate, in writing, fran this department prior to
starting work on this project.
ss. 66.293(3)(a)(e), Wis. Stats.
Any contractor, subcontractor or agent thereof, who fails to pay the prevailing rate of wages determined by the
departrt�ent under this subsection or pays less than 1-1/2 times the hourly basic rate of pay for hours worked on the
project in excess of the prevailing hours determined under this subsection� shalt be liable to the employes affected
in the amount of their unpaid minimum wages or their unpaid overtime canpensation and an additional amount as
liquidated damages. Action to recover the liability may be maintained in any court of competent jurisdiction by any
one or more employes for and in behalf of himself and other employes similarty situated. No employe shall be a
party plaintiff to any such action untess he gives his consent in writing to become such a party and the consent is
filed in the court in which the action is brought. The court shall, in addition to any judgment awarded to the
plaintiff, allo►+► a reasonable attorney's fee and costs to be paid by the defendant.
Each contractor� subcontractor or agent thereof participating in a project covQred by this subsection shall keep
full and accurate records clearty indicating the name and trade or occupation of every laborer, workman or mechanic
emptoyed by him in connection with the project and an accurate record of the number of hours worked by each employe
and actual wages paid therefor.
