(CARRIED LOST LAID OVER WITHDRAWN )
PURPOSE: ESTABLISH FAIR MARKET VALUE AND AUTHORIZE
PURCHASE OF SAME - 2162 STATE ROAD "44"
INITIATED BY: CITY ADMINISTRATION
PLAN COMMISSION RECOMMENDATION: Approved 6-0
WHEREAS, the Common Council of the City of Oshkosh has previously determined
the necessity of acquiring certain property for right-of-way purposes for the
proposed S.T.H. "44"/Washburn Street improvement project; and
WHEREAS, an appraisal has been made on the property to be acquired, which is
more particularly described in the attached "Exhibit A" ; and
WHEREAS, a review appraisal has been submitted to the Common Council in
accordance with applicable State and Federal laws; and
WHEREAS, the property and interest to be acquired includes land and build�ings,
if any, exclusive of equipment and fixtures both movable and immovable;
NOW, THEREFORE, BE IT RESOLVED by the Commn Council of the City of Oshkosh
that the Common Council certifies the work of the appraiser has been performed in
a competent manner according to applicable State and Federal laws, policies and
requirements.
BE IT FURTHER RESOLVED that the fair market value for the property to be
acquired, as described in the attached "Exhibit A", is hereby established at
ONE HUNDRED ELEVEN THOUSAND FOUR HUNDRED EIGHT AND NO/100 DOLLARS ($111 ,408.00) .
BE IT FURTHER RESOLVED that the proper Gity officials are authorized and
directed to purchase said property and execute all documents necessary to
consumate this transaction. Money for this purpose is appropriated from Account
No. 780991 -- TIF #7 - Streets.

David W. & Barbara A. McClain, property owners
All that part of the NE 1/4 of the SE 1/4 of Section 33, T18N,
R16E, Town of Algoma, Winnebago County, Wisconsin, lying N and W
of the highway known as State Highway "44" , except the following:
Commencing at the NW corner of said NE 1/4 of the SE 1/4, Section
33, T18N, R16E; thence E 24 rods, 4 ft. ; thence S parallel to the
W line of said NE 1/4 of the SE 1/4 to the centerline of said
Highway "44" ; thence SWIy along the centerline of said Highway to
the W line of said NE 1/4 of the SE 1/4, Section 33, T18N, R16E;
thence N to the point of beginning. Also excepting therefrom that
portion thereof conveyed for highway purposes as contained in
those instruments recorded in the Winnebago County, Wisconsin
Registry in Vol . 881 on Page 437 and Vol . 1298 on Page 270.

The methods employed to arrive at the estimates of value
satisfies generally accepted appraisal practices.
