Ripple Avenue, east of Wittman Regional Airport for the purpose of future aviation business development. The City's portion includes approximately 22 acres of the eastern property and the County owning 47 acres of the western portion adjacent to the airport. The City and County lands will be bisected by future Aeroinnovate Way, an 80-foot public right-of way snaking from the north to southern limits of the property. A proposed outlot is located at the northeast corner of the 80-acre site which is planned to be used for storm water detention purposes. The areas surrounding the proposed business park include single-family and industrial uses to the north, agricultural to the east and south, and the airport to the west. ANALYSIS ; Easements- Development of the business park will require the acceptance and granting of nine easements of varying purposes including storm sewer purposes, installation of City-related infrastructure, construction of a temporary cul-de-sac and city water main. The various easements locations are documented on the certified survey map and the necessary easement documents will be prepared by City staff and recorded at the Winnebago County Register of Deeds. Land Disposition- In 2014, the City and County recorded a two-lot certified survey map consolidating five existing parcels that were part of the land purchase. The common lot line curved southward from W. Ripple Avenue to the southern property line and also was to serve as the future west right-of-way line of Aeroinnovate Way. Due to the presence of wetlands on the southern portion of the site, the proposed street was realigned to the east resulting in the creation of a sliver of undevelopable City-owned land west of the relocated street. Since this land serves no meaningful purpose to the City and is mainly located in a wetland area, the City is proposing to dispose the surplus land to the County. Street Dedication- The City is proposing the dedication of Aeroinnovate Way which would wind southerly from W. Ripple Avenue to the southern end of Aviation Business Park. The right-of-way is 80 feet in width and 2,816 feet in length allowing for a 48-foot wide street with wide terraces enabling the placement of a pedestrian trail, public sidewalk and streetscaping. The layout was designed to maximize the developable land area while avoiding the delineated wetland areas. The City is also proposing a second right-of-way dedication on the south side of W. Ripple Avenue 107 feet from the western end of the current street to allow for the construction of a 50-foot radius cul-de-sac bulb located on the County's property to allow for adequate turnaround area for larger vehicles. The proposed dedications layouts have been reviewed and approved by both the Department of Public Works and the Transportation Department. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of these requests at its February 17, 2015 meeting. RIPPLE AVENUE,WEST OF OREGON STREET Plan Commission meeting of February 17, 2015 . GENERAL INFORMATION Applicant: City of Oshkosh Owners: City of Oshkosh, Winnebago County Actions Requested: The City requests a land disposition of vacant property west of the future Aeroinnovate Way, dedication of street right-of-way for Aeroinnovate Way and W. Ripple Avenue, and the granting/acceptance of various public and private utility easements. All requests are located within the proposed Aviation Business Park located on the south side of W. Ripple Avenue, one quarter mile west of Oregon Street and immediately east of Wittman Regional Airport. The common lot line dividing the City's and County's portions curve southward from W. Ripple Avenue to the south lot line of the property. This lot line was to also serve as the future west right-of-way line of Aeroinnovate Way. It was discovered during site and engineering design work that the southern portion of the proposed street was located within wetlands determined by a 2012 study. The City's consultant, Strand Associates, realigned the proposed street to the east to remove the affected portions out of the wetland area. This results in the creation of a sliver of undevelopable City-owned land containing 1.12 acres west of the relocated street. This sliver of land takes away direct access to Aeroinnovate Way from the County, although access easements could be granted. Since this land serves no meaningful purpose to the City, the City is proposing to dispose the surplus land to the County. The land has little practical value due to much of it being located in a wetland. Staff is in support of this land disposition as the other option would require the creation of a new substandard, irregular-shaped parcel serving no purpose and prohibiting the County direct access to Aeroinnovate Way. Street Dedications: The City is proposing the dedication of Aeroinnovate Way which is proposed to wind southerly from W. Ripple Avenue to the southern end of the Business Park. The right-of-way is 80 feet in width that allows for a 48-foot wide concrete street. The proposed right-of-way will be approximately 2,816 feet in length along the centerline and encompass 5.181 acres of land. The width of the right-of-way will provide wide terraces which will enable placement of a pedestrian trail, public sidewalk and streetscaping. The street layout was designed to m�imize the developable land area while avoiding environmentally sensitive areas such as the delineated wetlands. The City is proposing a second right-of-way dedication on the south side of W. Ripple Avenue, 107 feet from the western end of the current street. The dedication consists of a partia150-foot radius, 3,032 square foot cul-de-sac bulb located on the County's property. This dedication is needed to allow far adequate turn-around area for larger vehicles, including fire and sanitation trucks and snow plows. Item—Aviation Business Park RoWDedications,Land Disposition and Easements 2 The Department of Public Works and Transit Department have reviewed both of these dedication proposals and have expressed no concerns with the designed layouts. Staff is in support of the dedications as proposed as they are a necessary step in the development of the business park. Easements: Development of the business park will require the acceptance and granting of several easements of varying purposes. Easement#1 — 12-foot wide private utility easement. The City is proposing to accept a 12- foot private utility easement from Winnebago County along the south side of W. Ripple Avenue and west side of proposed Aeroinnovate Way. The easement is needed for installation of City- related infrastructure. Easement#2— 12-foot wide private utility easement. The City is proposing to grant a 12- foot private utility easement to itself along the south side of W. Ripple Avenue and east side of proposed Aeroinnovate Way. The easement is needed for installation of City-related infrastructure. Easement#3 —30-foot wide public storm sewer and drainage easement. The City is proposing to accept a 30-foot wide public storm sewer and drainage easement from Winnebago County along the west side of the County's property, beginning from the south side of W. Ripple Avenue heading south 1,062 feet. This easement also includes a 30-foot wide by 235-foot long segment heading east, 723 feet south of W. Ripple Avenue. This easement is required for storm sewer purposes and related infrastructure. Easement#4—66-foot wide public drainage and public utility easement. The City is proposing to grant a 66-foot wide by 604-foot long public drainage and public utility easement to itself located east of proposed Aeroinnovate Way. This easement is required for storm sewer purposes and related infrastructure as well as giving the City the ability to construct an additional street at a later date. Easement#5 - 30-foot wide public storm sewer and drainage easement. The City is proposing to grant a 30-foot wide storm sewer and drainage easement to itself on the east side of proposed Aeroinnovate Way, 310 feet north of the south business park boundary. The easement runs more or less parallel with the southerly lot line of the property, approximately 447 feet(along the centerline) long to the east property line. This easement is required for storm sewer purposes and related infrastructure. Easement#6—Partial 50' radius temporary cul-de-sac easement. The City is proposing to grant to itself a temporary 50' radius partial cul-de-sac easement for construction of a temporary cul-de-sac at the southern end of proposed Aeroinnovate Way. Easement#7—30-foot wide by 15-foot wide storm sewer and drainage easement. The City is proposing to accept a 30-foot wide by 15-foot wide storm sewer and drainage easement from Winnebago County along the west side of proposed Aeroinnovate Way. The easement is located approximately 320 feet north of south line of the business park and is needed far storm sewer purposes and related infrastructure. Item—Aviation Business Park RoWDedications,Land Disposition and Easements 3 Easement#8 —30-foot wide public water main easement. The City is proposing to accept a 30-foot wide by 858-foot long public water main easement from Winnebago County along the south business park boundary, west of proposed Aeroinnovate Way. The easement is needed for construction of city water main extending from the airport property. Easement#9 - 30-foot wide public storm sewer and drainage easement. The City is proposing to grant a 30-foot wide storm sewer and drainage easement to itself on the east side of business park boundary. The easement runs north from the proposed 66'wide multi-purpose easement to the south line of proposed Outlot 1. This easement is required for storm sewer purposes and related infrastructure. The Department of Public Warks and City's consultant is currently preparing pertinent easement documents and will be recorded at the Winnebago County Register of Deeds. RECOMMENDATION/CONDITIONS A - Staff recommends approval of the land disposition of the 1.118 acre remnant parcel west of proposed Aeroinnovate Way as requested. B— Staff recommends approval of the street dedications of Aeroinnovate Way and W. Ripple Avenue as proposed. C— Staff recommends approval of the granting and accepting of the proposed various utility easements as requested. The Plan Commission approved of the land disposition, street dedications, and the granting and accepting of various utility easements as requested. The following is the Plan Commission's discussion on this item. Mr. Nau presented the item and reviewed the site and surrounding area and discussed the land purchased for the creation of the Aviation Business Park. He further stated that the City was moving forward with site preparation for development of the park and reviewed the overall layout of it. He described how the roadway was laid out originally and that it was realigned due to the presence of wetlands which created a sliver of land on the west side of Aeroinnovate Way which removed direct access to the road from the County and served no purpose for the City. He also reviewed the site plan depicting the land disposition area. He explained the street dedication and displayed the areas proposed to be dedicated which included the area for Aeroinnovate Way as well as area to accommodate a cul-de-sac bulb on the County's property on the south side of W. Ripple Avenue. He described the street layout which was designed to utilize the most developable area possible. The Department of Public Works has reviewed this aspect of the site and has no concerns with the proposed street and cul-de-sac locations. Mr. Nau also reviewed the nine easements be to accepted or granted within the business park and reviewed each easement and the purpose of it which were for public and private utilities, storm sewer, a temporary cul-de-sac, a potential new street connection and other city-related infrastructure. Mr. Gray voiced his concerns with how the street was named and why it is called a way rather than a street. He also questioned why the proposed street dedication curves back and forth instead of running straight through the lot. Item—Aviation Business Park RoW Dedications,Land Disposition and Easements 4 Mr. Nau responded that the street was laid out as it was due to environmental challenges as the city was trying to avoid placing it in areas that contained wetlands and the topography of the site also was considered. Mr. Gohde added that the original layout was developed by the City's consultant for the project and the curved features help to create various sizes of lots for future development and also disturbed the least amount of wetlands possible. Mr. Gray then questioned if easement#4 was to allow the installation of a potential future street if it would be wide enough to accommodate this feature. Mr. Gohde replied that street right-of-way required 60 feet and the easement was 66 feet which was 6 feet wider than necessary for street construction. Motion by Borsuk to approve the land disposition ofproperty, street dedications, and the granting/accepting of various easements located within the Aviation Business Park, south side of W. Ripple Avenue west of Oregon Street. Seconded by Cummings. Mr. Gray commented that he did not like the chosen name for the street. Motion carried 8-0.
