HomeMy WebLinkAboutMinutes__________________________________ Plan Commission Minutes 1 January 20, 2015 PLAN COMMISSION MINUTES January 20, 2015 PRESENT: David Borsuk, Ed Bowen, Jeffrey Thoms, Thomas Fojtik, John Hinz, Steve Cummings, Kathleen Propp, Gary Gray, Robert Vajgrt EXCUSED: Donna Lohry, Karl Nollenberger STAFF: Darryn Burich, Director of Planning Services; David Buck, Principal Planner; Brian Slusarak, Planning Technician; Steve Gohde, Assistant Director of Public Works; Raymond Maurer, Director of Parks; Deborah Foland, Recording Secretary Chairperson Fojtik called the meeting to order at 4:00 pm. Roll call was taken and a quorum declared present. The minutes of January 6, 2015 were approved as presented. (Vajgrt/Hinz) Mr. Bowen arrived at 4:02 pm. I. EXTRATERRITORIAL TWO-LOT LAND DIVISION/CERTIFIED SURVEY MAP AT SOUTHEAST CORNER OF STH 91 AND KNOTT ROAD IN THE TOWN OF UTICA The owner/petitioner are requesting a two-lot land division/certified survey map from one existing parcel containing a total of 72.53 acres. Sizes of the proposed lots are as follows: Lot 1 = 40.0011 Acres Lot 2 = 32.5298 Acres Mr. Slusarek presented the item and reviewed the site and surrounding area as well as the land use in this area. He stated that the purpose of the proposed land division was to sell a portion of the parcel to a neighboring property owner. The land division is consistent with the City’s Comprehensive Plan and the Department of Public Works has reviewed the request and noted that there may be wetlands present on the property. This information will be forwarded to Winnebago County and he reviewed the proposed certified survey map. Mr. Thoms questioned if the wetlands delineation would have to be done in advance of the land division receiving approval. Mr. Buck responded that with certified survey maps within the City the wetlands delineation could be required to be shown on the certified survey map however in this case it would be the responsibility of Winnebago County as the area is in their jurisdiction. He noted that the delineation would be required to be completed prior to any development occurring on the subject site. Mr. Gray inquired if the property owner was present at the meeting as the application was not signed by the property owner but by the land surveyor. Mr. Buck responded that the certified survey map will require the property owner’s signature after the approval of the Plan Commission prior to it being recorded at the Winnebago County Register of Deeds. __________________________________ Plan Commission Minutes 2 January 20, 2015 Motion by Vajgrt to approve the extraterritorial two-lot land division/certified survey map located at the southeast corner of STH 91 and Knott Road in the Town of Utica. Seconded by Bowen. Motion carried 9-0. II. ARCHITECTURAL BUILDING PLAN REVIEW FOR A PUBLIC RESTROOM AND PARK SHELTER FACILITY LOCATED WITHIN STEVENS PARK (44 FRANKFORT STREET) The applicant is requesting an architectural building plan review for construction of a public restroom facility and park shelter in Stevens Park. Mr. Buck presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in said area. He discussed the history of Stevens Park and reviewed the park layout and associated amenities on the site. He stated that the City of Oshkosh Comprehensive Outdoor Recreation Plan provides recommendations for improvements to Stevens Park including accessible bathrooms and shelter at this location. He also discussed the area in the park where the shelter will be located and reviewed the site plan, floor plan, and elevations for the structure. The shelter and restroom facility was designed to be very similar to the rest of the shelters including the one recently constructed in Menominee Park and the one scheduled to be constructed on the Boatworks property. The elevations have been revised since the staff reports were sent out to address staff concerns regarding the addition of some type of architectural features to break up the open space on both the south and north elevations and he reviewed the original and revised plans. The restroom/shelter facility was approved by the Parks Advisory Board and is included in the 2015 Capital Improvement Program. He also reviewed the condition that was recommended for approval of this request. Mr. Hinz questioned why there was a difference in the costs as the Comprehensive Outdoor Recreational Plan contained an expense of $250,000 for the restroom/shelter and the Capital Improvement Program contained an expense of $200,000. Raymond Maurer, Director of Parks, responded that the amount included in the Comprehensive Outdoor Recreational Plan included architectural fees for the structure’s design which was covered under the 2014 budget so the amount reflected in the 2015 Capital Improvement Program was for the construction costs only. Mr. Borsuk questioned if the adjacent land owners and Stevens Park Neighborhood Association members were notified. Mr. Buck responded affirmatively. Mr. Thoms stated that the construction of the restroom/shelter facility would result in approximately 1300 square feet of additional impervious surface and inquired if this would create any concerns regarding storm water runoff issues. Steve Gohde, Assistant Director of Public Works, indicated that the City would allow this expansion of impervious surface without the requirement for additional storm water management facilities as it did not exceed the area requirements for such facilities however it could result in an increase in fees of the water billing for the Parks Department to account for the additional impervious surface. __________________________________ Plan Commission Minutes 3 January 20, 2015 Ron Hansche, HGM Architecture, Inc., 805 N. Main Street, added that the park has storm sewer facilities located in the southeast corner of the site that addresses storm water runoff from the park property. Mr. Gray questioned if there had been any thoughts in regard to placing a mural on the shelter wall area. Mr. Maurer responded that this feature was not a consideration as they have held discussions on the matter however most materials used to create murals do not weather well in this climate. Holly Fawley, 1247 Harney Avenue, stated that she received a meeting notice last week regarding this request and that it was the first notification she received that anything was being proposed for the park area. She voiced her displeasure with not being informed about this sooner and felt that the location for the shelter should be closer to the parking area on Frankfort Street. She further stated that her biggest concern was who was going to be monitoring this facility and if it was going to be locked during evening hours. She did not want the facility to become an issue with drugs or other undesirable activities occurring on the site and also did not like that the structure would be blocking her view of the park area. She reiterated that it should be located closer to the parking area. Ms. Propp questioned if Ms. Fawley was not in favor of having the shelter facility in the park. Ms. Fawley responded that the park was not really utilized now and that a lot of the citizens do not know that this park even exists and voiced her concerns again about illegal activities on the site and who was going to be maintaining the facility. Mr. Hansche indicated that the Stevens Park Neighborhood Association delivered flyers to all the residents of the neighborhood regarding this matter in August, September, October, and November. He further stated that ball games are held in this park three nights a week and that there is not adequate parking to handle all the attendees to these events. He felt the park was used extensively and that the facility will be locked by the Parks Department according to their schedule and will also have lighting that would be turned on and off as well. There was also street lighting in that area that would provide some source of lighting when the facility’s lighting is turned off. Mr. Gray questioned who would have received the flyers delivered by the Neighborhood Association. Mr. Hansche responded that every member of the association received these flyers and described the boundaries included in the association. Mr. Maurer stated that there are mechanical locking mechanisms that control the entrance doors so they would be locked during appropriate evening hours. Mr. Gray inquired if someone could be locked in the facility by these self-locking mechanisms. Mr. Maurer replied that this was not possible as there are safety measures in place that would prevent this issue. He also presented samples of the exterior materials for the structure for the Plan Commission members to review. Motion by Thoms to approve the architectural building review for a public restroom and park shelter facility located within Stevens Park at 44 Frankfort Street with the following condition: __________________________________ Plan Commission Minutes 4 January 20, 2015 1. The north and south elevations incorporate elements intended to break up the overall mass of the façade, as approved by the Department of Community Development. Seconded by Vajgrt. Ms. Propp stated that she felt the restroom/shelter facility would be a nice addition to this park. Motion carried 9-0. OTHER BUSINESS Mr. Buck stated that the next meeting of the Plan Commission will not be held in room 404 as the room was scheduled to be used for training purposes on that day and the location would be so noted on the agenda.
