HomeMy WebLinkAboutAgricultural lease/Mark Schultz October 29,2014 Mr. Mark Schultz N9458 Ridge Road Van Dyne, WI 54979 Dear Mr. Schultz: This letter is to confirm the lease agreement between the City of Oshkosh (lessor) and Mark Schultz (lessee) for eight parcels of land in the Southwest Industrial Park and one parcel of land in the Universal Business Park equating to approximately 76 acres of land at no charge from October 31, 2014 to October 31, 201.,�'> The lease property shall solely be used for agricultural purposes. Lessee shall not allow recreation activities on the leased property. Recreation activities includes, without limitation, hunting, snowmobiling, motorcycling, or ATV's. Lessee has inspected properties and leases them as is. Lessee cannot sublease or assign its interests in the leased property. As agreed you will lease the land for the term from the date this agreement is fully signed until October 31, 2015. Location descriptions of the parcels of land are described in the attached spreadsheet and map. Permitted crops include low-level, i.e.soybeans, alfalfa, grass, etc. No corn is permitted. Should the City of Oshkosh need to disturb any of the planted land on these parcels for any sort of work (e.g. survey work, wetland delineation, etc.), OR if the land is sold during the term of this lease, the lessee will NOT be compensated for any costs (e.g. crops and/or labor). The City of Oshkosh will not be held liable for any damage incurred to crops on these parcels that are not removed from the leased property by October 31, 201����_ 1 Lessee shall not alter the leased property and agrees to remove all personal property, fixtures, andlor crops by the end of the lease. Lessee further agrees to fully indemnify and refund to the City within 30 days of written demand all such sums the City may be obligated to pay on such actions, claims or demands. The dates identified in this agreement are firm and time is of the essence.
