HomeMy WebLinkAbout30. 15-27 JANUARY 13, 2015 15-27 ORDINANCE FIRST READING (CARRIED________ LOST________ LAID OVER________ WITHDRAWN_______) PURPOSE: AMEND SECTION 6-14 RABIES VACCINATION TO ALLOW VETERINARY TECHNICIANS TO ADMINISTER RABIES VACCINE INITIATED BY: CITY ADMINISTRATION A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 6-14 RABIES VACCINATION TO ALLOW VETERINARY TECHNICIANS TO ADMINISTER RABIES VACCINE The Common Council of the City of Oshkosh does ordain as follows: SECTION 1. That Section 6-14(A) of the Oshkosh Municipal Code pertaining to Rabies Vaccination is hereby repealed and recreated to read as follows: SECTION 6-14 RABIES VACCINATION (A) Required. Dogs and cats shall be vaccinated by a licensed veterinarian or, if a veterinarian is physically present at the location the vaccine is administered, by a veterinary technician, pursuant to section 453.05 (2) (d) of the Wisconsin Statutes at no later than five (5) months of age. Unvaccinated dogs or cats acquired or moved into the City must be vaccinated within thirty (30) days after purchase or arrival, unless under five (5) months of age, wherein the above shall apply. Each dog or cat vaccinated at under one (1) year shall be re-vaccinated twelve (12) months after the initial vaccination. Thereafter, every dog or cat shall be re-vaccinated at not more than thirty-six month intervals with a three year vaccine or at not more than 12 month intervals with a one year vaccine. SECTION 2. This ordinance shall be in full force and effect from and after its passage and publication. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #15-XXX AMEND SECTION 6-14 RABIES VACCINATION TO ALLOW VETERINARY TECHNICIANS TO ADMINISTER RABIES VACCINE, on January 27, 2015. The ordinance change would JANUARY 13, 2015 15-27 ORDINANCE CONT'D permit rabies vaccine to be administered by either a licensed veterinarian or a veterinary technician under the direct supervision of a licensed veterinarian as permitted by Wisconsin State Statutes. Lorenson, City Attorney DATE: January 9, 2015 RE: Amend City Ordinance Section 6-14 to allow Veterinary Technicians to Administer Rabies Vaccine BACKGROUND City ordinances currently require rabies vaccine to be administered by a licensed veterinarian. A local veterinarian recently contacted our office to request that the City consider amending its ordinances to allow veterinary technicians to administer rabies vaccine. ANALYSIS State statutes permit rabies vaccine to be administered by either a licensed veterinarian or a veterinary technician under the direct supervision of a licensed veterinarian. We contacted both the Winnebago County Health Department who work closely with the City on rabies related issues and Dr. Yvonne Bellay, the Animal Welfare Programs Manager/Epidemiologist for the Wisconsin Department of Agriculture, Trade and Consumer Protection Division of Animal Health. Neither the Winnebago County Health Department nor Dr. Bellay raised any concerns with expanding the City's ordinances to include administration of the vaccine by veterinary technicians. FISCAL IMPACT There is no anticipated fiscal impact associated with this proposed change in the municipal ordinances. RECOMMENDATION Because the proposed change is consistent with state law and no concerns have been raised by either the Winnebago County Health Department or the State Animal Welfare Programs Manager/Epidemiologist, staff recommends adoption of the proposed ordinance change to allow veterinary technicians to administer rabies vaccine under the direct supervision of a licensed veterinarian.
