PURPOSE: APPROVAL OF AMENDMENT TO ENGINEERING SERVICES
AGREEMENT WITH BROWN & CALDWELL FOR DEVELOPMENT
OF A STORM WATER MANAGEMENT PLAN FOR THE FERNAU
AVENUE AREA WATERSHED IN THE NORTH INDUSTRIAL PARK
($24,260.00)
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the City and Brown & Caldwell previously entered into a professional
services agreement in which they would develop for the City a storm water management
plan for the Fernau Avenue Area Watershed; and
WHEREAS, additional engineering services were necessary in order to complete
the development of this plan.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed pursuant to Section 12-
16 of the Municipal Code to enter into an amended agreement with Brown & Caldwell.
BE IT FURTHER RESOLVED that an amendment to the agreement with Brown &
Caldwell is approved and said City officials are authorized and directed to take those steps
necessary to implement the terms and conditions of the final agreement.
BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated
from:

RE: Amendment to Engineering Services Agreement for Development of a Storm Water
Management Plan for the Fernau Avenue Area Watershed
Brown and Caldwell/$24,260
BACKGROUND
A professional services agreement for development of a storm water management plan with Brown and
Caldwell was approved by the Common Councii on June 10, 2014. During the course of performing the
services within this contract, it was determined that additional services were necessary in order to
complete the development of this plan.
ANALYSIS
As the study progressed, it became apparent that the future reconstruction of Snell Road would result in
additional area draining into the Fernau Avenue Watershed. These areas needed to be added into the
model to ensure accurate, reliable results. In addition to this added drainage area, it also became
apparent that some private storm sewer systems needed to be incorporated into the model. Private
systems are not typically incorporated into the models because the information is not readily available for
inclusion in the model. In this case, the property owner provided the information to staff to include into
the model. Other additional services provided by Brown and Caldwell included analyzing portions of the
watershed under multiple rainfall distributions to ensure the needs of Tax Incremental Finance District 27
were being met.
FISCAL IMPACT
Staff has reviewed the amendment and costs. The amount of this contract amendment is $24,260. This
will raise the total contract amount to $149,960 (not to exceed). These services will be funded through
the Storm Water Utility. There were $200,000 budgeted in the Storm Water Utility Capital Improvements
Project budget for this study, therefore funds are available within the Storm Water Capital Improvements
Program for these additional services.
RECOMMENDATIONS
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a
specialized nature, including engineering services, may be procured without the use of formal, sealed
quotes. I have reviewed this amendment and in accordance with Section 12-16 of the Code, I am hereby
recommending that the Common Council approve this amendment.
