PURPOSE: APPROVE & EXECUTE REVISED RELOCATION ORDER;
DETERMINATION OF NECESSITY TO ACQUIRE PROPERTY
FOR 9TH AVENUE/WASHBURN STREET AREA STORM WATER
DETENTION BASIN
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
PLAN COMMISSION RECOMMENDATION: Approved
WHEREAS, in November 2006 the Common Council approved the official
mapping of lands in the 9th Avenue/Washburn Street area for the purpose of storm
water detention; and
WHEREAS; in November 2010 the Common Council approved the relocation
th
order for the 9 Avenue/ Washburn Street area storm water detention basin; and
WHEREAS, the Department of Public Works has completed further study of the
area and is recommending the acquisition of portions of properties at 1382/1388
Maricopa Drive from Waukau Creek LLC and 1390/1394 Maricopa Drive from 1390
Maricopa Drive LLC and, more particularly described in the attached.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the Common Council determines that it is necessary and a public purpose
for the City to acquire portions of the properties described in the attached for said
purpose of construction of a storm water detention basin.
BE IT FURTHER RESOLVED by the Common Council that this resolution
constitutes a revised Relocation Order for acquisition of property described in the
attached in accordance with the title acquisition procedure set forth in Wisconsin
Statutes, Section 32.05, said properties being portions of 1382/1388 Maricopa Drive
and 1390/1394 Maricopa Drive.
BE IT FURTHER RESOLVED that the proper City officials are hereby authorized
and directed to execute any and all documents necessary for implementation of this
revised order and that a certified copy of this Resolution shall be filed with the
Winnebago County Clerk within twenty (20) days of its adoption.
BE IT FURTHER RESOLVED that this Resolution shall be effective immediately
upon its passage and publication.

To properly construct the stormwater detention basin designated above it is necessary to acquire certain lands or
interests in lands as shown on the revised right-of-way plat for the above project.
To effect this change, pursuant to authority granted under Wisconsin Statutes the City of Oshkosh orders that:
1. The said stormwater detention basin is laid out and established to the lines and widths as shown on the plat.
2. The required lands or interests in lands as shown on the plat shall be acquired by the City of Oshkosh.
3. This order supersedes and amends any previous order issued by the City of Oshkosh.

BACKGROUND
1382 Maricopa Drive consists of two four-unit dwellings with associated off-street parking area while
1390 Maricopa Drive contains a single 16-unit apartment building with associated off-street parking
area. The properties abut undeveloped lands to the north which the City acquired in 2010-2011 for
future development of a storm water detention basin. The surrounding area consists of a mix of
multiple-family uses along the north side of Maricopa Drive, two-family uses along the south side of
Maricopa Drive, and light industrial/commercial uses along S. Washburn Street further east.
ANALYSIS
In 2010, the Common Council approved a relocation order to allow the City to acquire property for a
proposed storm water detention basin near the intersection of W. 9th Avenue and S. Washburn Street.
With design work currently underway, it has been determi,ned that an existing storm sewer easement
at the south end of the acquired property is not wide enough to allow construction of the new facilities.
A new location for a 40-foot wide by 200-foot deep storm sewer easement has been selected near the
common lot line of 1382 and 1390 Maricopa Drive which will have a minimal impact on the existing
developments. During construction, portions of the driveways and parking areas on both properties
will be excavated and returned to its original state once complete. City staff have been in contact with
the property owners and will have appropriate documents signed and recorded at the Winnebago
County Register of Deeds. The easement request will not have a negative impact on the subject
properties and is necessary to alleviate storm water flooding issues in the area.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its December 2, 2014 meeting.

GENERAL INFORMATION
Petitioner: City of Oshkosh

Action Requested:
The City of Oshkosh Department of Public Works is requesting a 40-foot wide by approximately
200-foot deep storm sewer easement to the City of Oshkosh to install a new five-foot by eight-foot
storm sewer through the subject properties to connect from a proposed storm water detention basin
to the north to storm water facilities located in Maricopa Drive.
Applicable Ordinance Provisions: N/A
Property Location and Type:

The Department of Public Works has been in contact with the property owners for the easement
acquisition and will work with the City Attorney to have appropriate easement documents signed
and recorded at the Winnebago County Register of Deeds.
Staff supports the easement request as it will not have a negative impact on the subject properties,
and is needed to help alleviate storm water flooding issues in the area.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the acquisition of the proposed storm sewer easement as requested.
The Plan Commission approved of the easement acquisition as requested. The following is the Plan
Commission's discussion on this item.
Mr. Buck presented the item and reviewed the site and surrounding area as well as the zoning
classifications and land use in said area. He discussed the land acquisition for a future storm water
detention basin that took place in 2010 and reviewed the detention basin area. He explained that the
existing easement was not adequate to allow the construction of the new larger storm sewer pipe
required and that the new easement acquisition area was the most viable location. The subject site
is not centered on the common property line as noted in the staff report and is actually 15 feet on
1382 Maricopa Drive and 25 feet on 1390 Maricopa Drive. He stated that once construction is
complete, the property would be restored to its previous state and would not have a negative impact
on the subject properties and is necessary to alleviate storm water flooding issues in the area.
Mr. Thoms questioned if this storm sewer easement was to allow water to flow into or out of the
detention basin.
Steve Gohde, Assistant Director of Public Works, responded that it was to allow water to flow into
the basin.
Mr. Thoms then questioned if it was planned to be a dry or wet detention basin.
Mr. Gohde indicated that the basin would have wet components.
Motion by Vajgrt to approve the easement acquisition located at 1382 and 1390 Maricopa
Drive.
Seconded by Bowen. Motion carried 9-0.
Item-Easement Acq 1382/1390 Maricopa Dr
In late 2010 the Plan Commission and Common Council approved a relocation order to allow the
Department of Public Works to acquire land for a stormwater detention basin near the intersection of
W 9tn Avenue and Washburn Street. The land for the detention basin was acquired and design work has
begun. During the design, it was determined the existing stormwater easement located at the south
end of the acquired property is not adequate to allow for construction on the new larger storm sewer
pipe.
A new location for the pipe is available,with limited impacts to the existing development. The proposed
new location is along the property line between 1382 and 1390 Maricopa Drive. The proposed
easement is 40 feet wide,see the attached map. This width is needed to allow for installation of the
new 5' tall by 8'wide storm sewer pipe within the easement area. The easement will impact the parliing
lot area of 1382 Maricopa Drive and the driveway area if 1390 Maricopa Drive. The asphalt pavement
will be replaced afterthe storm sewer is constructed.
