Code enforcement staff has noted that the majority of these cases achieve compliance after the 1 St notice. Staff has also noted a decline in repeat violations for the same property. However, there are some unusual cases each year that require ongoing notices without compliance being easily achieved. Due to the additional workload and time required to pursue compliance, there should be an escalating fee assessed for each subsequent notice to cover the City administrative costs. ANALYSIS The current service fees charged are $20 for 1St notice and $50 for each subsequent notice. We believe that if there were 2 more tiers of service fees for the subsequent violations, the increased fees would help cover the City's additional costs and potentially increase compliance due to fewer continuing violations. The proposed service fee for the 3�d notice sent for violations should be $100 due to the extraordinary time these types of cases require of staff. For these cases, staff will make multiple trips to the property, create multiple violation letters, create multiple documents for possible legal action regarding the violations, on multiple occasions, and frequently meet with the property owners and tenants multiple times. This additional staff time for the non-compliance adds up and is not covered by the current$50 administrative charge. The proposed 3�d notice of$100 and any subsequent notices sent for the 4th violation notice would be set at $200 to help cover staff time required to bring the property into compliance. We also think that the increase in the service fee for 3�d and each subsequent should help achieve greater compliance for code enforcement violations that are found. The proposed ordinance should take effect January 1, 2015. FISCAL IMPACT The additional revenue generated by the proposed ordinance update would be about$6,000 based on our experience of the last 2 years.
