HomeMy WebLinkAboutMinutes__________________________________ Plan Commission Minutes 1 November 18, 2014 PLAN COMMISSION MINUTES November 18, 2014 PRESENT: Ed Bowen, Thomas Fojtik, Steve Cummings, Kathleen Propp, Gary Gray, Robert Vajgrt, Karl Nollenberger EXCUSED: David Borsuk, Jeffrey Thoms, John Hinz, Donna Lohry STAFF: David Buck, Principal Planner; Jeffrey Nau, Associate Planner; Steve Gohde, Assistant Director of Public Works; Deborah Foland, Recording Secretary Chairperson Fojtik called the meeting to order at 4:00 pm. Roll call was taken and a quorum declared present. The minutes of November 4, 2014 were approved as presented. (Hinz/Bowen) I. EXTRATERRITORIAL THREE-LOT LAND DIVISION/CERTIFIED SURVEY MAP AT 6061 STATE ROAD 91 IN THE TOWN OF UTICA The owner/petitioner are requesting a three-lot land division/certified survey map from one existing parcel containing a total of 22.147 acres. Sizes of the proposed lots are as follows: Lot 1 = 5.080 Acres Lot 2 = 6.816 Acres Lot 3 = 8.343 Acres Right-of-Way = 1.908 Acres Mr. Nau presented the item and reviewed the site and surrounding area as well as the county zoning classifications and land use in said area. He reviewed the layout of the proposed land division and stated that this area is outside of the City’s Comprehensive Land Use Plan area. He further stated that the Department of Public Works reviewed this request and noted that it may have some drainage easement requirements regulated by Winnebago County code and that there was possible wetlands on the site which may require a wetland delineation prior to any development. These comments would be forwarded to the appropriate County staff. Ms. Propp questioned if we were aware of the potential land use of this site as the property is being marketed and she was wondering if it would be for subdivision use. Mr. Nau responded that the property currently possesses an A-2 County zoning classification of agricultural use and he was not aware if the property owner had requested a zone change; however the City has no regulatory authority in this area. Mr. Buck added that the proposed lot sizes would meet both City and County standards. Mr. Gray inquired if the Town board had approved this request. Mr. Nau replied that the property owner has a closing scheduled at the end of the month on one of the proposed lots but he is unaware of its standing with the Town board. __________________________________ Plan Commission Minutes 2 November 18, 2014 Motion by Vajgrt to approve the extraterritorial three-lot land division/certified survey map at 6061 State Road 91 in the Town of Utica. Seconded by Bowen. Motion carried 7-0. II. GRANT STORM SEWER EASEMENT FOR PROPERTY SOUTH OF 2490 JACKSON STREET Jackson Square Apartments, LP is requesting a 20 foot by 165 foot storm sewer easement from the City of Oshkosh to install a storm sewer across city-owned land to connect their on-site storm water management facility with the municipal storm sewer system. Mr. Buck presented the item and reviewed the site and surrounding area as well as the zoning classifications and land use in said area. He stated that a planned development was approved for an apartment complex earlier this year at 2490 Jackson Street and he reviewed the site plan from that meeting. He explained the issues with connecting the private storm water management system to the municipal storm sewer located within the Jackson Street right-of-way which led to the determination that granting the easement would allow the development to connect to the municipal storm sewer to the south of the property. The easement would extend through City owned property and would eventually connect to the detention basin planned for construction on the subject site. He further stated that this easement would not have any negative impact on surrounding properties and is necessary for the development to continue. This easement would allow a more efficient way to connect to the City’s storm sewer system at this time and it will be connected directly to the detention basin to the south when it is constructed. Mr. Bowen questioned if the developer is still constructing everything in the approved planned development including the detention basin on the site and that the only change was the redirection of the storm water runoff to the south. Mr. Buck indicated that the planned development was unchanged and the storm water would still be directed to the City’s municipal storm sewer system that is present through the City owned property and will connect to the detention basin in the future. Mr. Bowen inquired when the detention basin was planned to be constructed. Steve Gohde, Assistant Director of Public Works, responded that the detention basin was planned to be constructed in 2016 or 2017. Mr. Gray questioned why there was one foot difference between where the easement area begins on the north side compared to where it terminates on the south side. Mr. Gohde replied that it was just how it was laid out. Mr. Gray then questioned if this planned development was still going to proceed as he has not seen any signs of construction on the site. Mr. Buck responded affirmatively and stated that the planned development was approved in January and was still in the process of obtaining approval for their plans and getting the appropriate permits in order. __________________________________ Plan Commission Minutes 3 November 18, 2014 Motion by Vajgrt to approve granting a storm sewer easement for property located south of 2490 Jackson Street. Seconded by Nollenberger. Motion carried 7-0. There being no further business, the meeting adjourned at approximately 4:12 pm.
