PURPOSE: APPROVE GRANTING EASEMENT TO JACKSON SQUARE
APARTMENTS, LP; PROPERTY SOUTH OF 2490 JACKSON

BE IT RESOLVED by the Common Council of the City of Oshkosh that the
proper City officials are hereby authorized and directed to grant Jackson Square
Apartments, LP, a storm sewer easement to connect their on-site storm water
management facility with the Municipal Storm Sewer System along the east side of
Jackson Street approximately 130 feet north of Bacon Avenue, per the attached, and
the proper City officials are hereby authorized and directed to execute any and all
documents necessary for purposes of same.

BACKGROUND
The subject property is a 4.68 acre city-owned parcel located within the Town of Oshkosh along the
east side of Jackson Street approximately 130 feet north of Bacon Avenue. The undeveloped
property is a 165 foot wide by 1,235 foot long strip of land that fronts both Jackson Street on the west
and North Main Street on the east and contains a storm sewer along the south property line
(connecting facilities in Jackson Street to those on North Main Street). The Storm Water Utility has
long term plans to utilize the property for the construction of a detention basin to provide flood
reduction within the Libbey Avenue and Nicolet Court watersheds.
ANALYSIS
Jackson Square Apartments, LP is in the process of constructing a 54 unit multiple-family
development at 2490 Jackson Street which is adjacent property to the north of the subject site. This
development would typically require connection of their private storm water management system to
the municipal storm sewer located within Jackson Street right-of-way. Due to a significant amount of
private utilities located within Jackson Street complicating this connection, it was determined that the
best option would be private storm sewer through the subject property connecting to the existing
municipal storm sewer. This easement would allow for this installation and potential maintenance
until the construction of the detention basin at which time a portion of this easement can be released
and the storm sewer can be connected directly into the new basin. The Department of Public Works
has reviewed this request and does not have any concerns with it and city staff will work with the
property owner to have appropriate easement documents signed and recorded at the Winnebago
County Register of Deeds.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its November 18, 2014 meeting.

GENERAL INFORMATION
Petitioner: Jackson Square Apartments, LP

Action Requested:
Jackson Square Apartments, LP is requesting a 20 foot by 165 foot storm sewer easement from the
City of Oshkosh to install a storm sewer across city-owned land to connect their on-site storm water
management facility with the Municipal Storm Sewer System.
Applicable Ordinance Provisions: N/A
Property Location and Type:

Analysis:
Jackson Square Apartments, LP is in the process of constructing a 54 unit multiple-family
development at 2490 Jackson Street (adjacent property to the north), which was approved as a
Planned Development in January 2014. This development would typically require connection of
their private storm water management system to the municipal storm sewer located within Jackson
Street, however there is a significant amount of private utilities located within the Jackson Street
right-of-way complicating the connection to the storm sewer, which is located on the far west side
of the street. To eliminate the need to cross Jackson Street and the associated private utilities and
connect the private storm management facility to the municipal system, it was determined that the
best option would be installing a 12 inch private storm sewer through the subject property
connecting to the existing 60 inch municipal storm sewer. This requires the granting of an easement
of suitable size (20 feet wide)to allow its installation and potential maintenance. When the Storm
Water Utility constructs the detention basin on the property, a portion of this storm water easement
can be released, and the storm sewer from the developer's site will connect directly into the new
detention basin.
The Department of Public Works reviewed the request and does not have any concerns with the
proposal. The Department of Public Warks and City Attorney are working with the property owner
to have appropriate easement documents signed and recorded at the Winnebago County Register of
Deeds.
Staff supports the easement request as it will not have a negative impact on the City's or
surrounding properties, will minimize potential conflict with existing utilities in Jackson Street, is
needed to allow Jackson Square Apartments, LP to proceed with their site improvements, and will
allow a more efficient and direct connection to the future detention basin planned for the subject
property.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the granting of the proposed storm sewer easement as requested.
The Plan Commission approved of granting the easement as requested. The following is the Plan
Commission's discussion on this item.
Mr. Buck presented the item and reviewed the site and surrounding area as well as the zoning
classifications and land use in said area. He stated that a planned development was approved for an
apartment complex earlier this year at 2490 Jackson Street and he reviewed the site plan from that
meeting. He explained the issues with connecting the private storm water management system to
the municipal storm sewer located within the Jackson Street right-of-way which led to the
determination that granting the easement would allow the development to connect to the municipal
storm sewer to the south of the property. The easement would extend through City owned property
and would eventually connect to the detention basin planned for construction on the subject site. He
further stated that this easement would not have any negative impact on surrounding properties and
is necessary for the development to continue. This easement would allow a more efficient way to
connect to the City's storm sewer system at this time and it will be connected directly to the
detention basin to the south when it is constructed.
Mr. Bowen questioned if the developer is still constructing everything in the approved planned
development including the detention basin on the site and that the only change was the redirection
of the storm water runoff to the south.
Mr. Buck indicated that the planned development was unchanged and the storm water would still be
directed to the City's municipal storm sewer system that is present through the City owned property
and will connect to the detention basin in the future.
Mr. Bowen inquired when the detention basin was planned to be constructed.
Steve Gohde, Assistant Director of Public Works, responded that the detention basin was planned to
be constructed in 2016 or 2017.

Mr. Gray questioned why there was one foot difference between where the easement area begins on
the north side compared to where it terminates on the south side.
Mr. Gohde replied that it was just how it was laid out.
Mr. Gray then questioned if this planned development was still going to proceed as he has not seen
any signs of construction on the site.
Mr. Buck responded affirmatively and stated that the planned development was approved in January
and was still in the process of obtaining approval for their plans and getting the appropriate permits
in order.
Motion by Vajgrt to approve granting a storm sewer easement for property located south of
2490 Jackson Street.
Seconded by Nollenberger. Motion carried 7-0.

Project Narrative
The developer (Jackson Square Apartments, LP) of parcel 15195913001ocated at 2490 Jackson Street
has requested a storm water easement from the City of Oshkosh across parce10180203. The purpose of
the easement is to connect their onsite storm water management facilities to the City of Oshkosh's -
Municipal Storm Sewer System.
Typically, and developer would connect to the storm sewer within the adjacent street to dischazge their
storm water from their private system into the City's municipal storms sewer system. In this case,there
is a significant number of other private utilities (telephone and communications companies)located
within the Jackson Street right-of-way,that make connecting to the storm sewer on the west side of
Jackson Street extremely challenging.
The City of Oshkosh Storm Water Utility recently purchased the parcel of land directly south of the
developer's property. There is a large storm sewer located on the south property line of the City owned
parcel. Granting this easement to the developer will allow them to construct a much more effective
outlet for their storm water management facility onsite.
The Storm Water Utility intends to construct a detention basin on the City owned property long term to
provide flood reduction within the Libbey Avenue and Nicolet Court Watersheds. When the Storm
Water Utility constructs the detention basin on this property, a portion of this storm water drainage
easement will be released, and the storm sewer from the developer's site will be connected directly into
the City's detention basin.
