A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 30-68
OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO THE OFFICIAL MAP.
WHEREAS, a public hearing, after due and proper notice, was duly held before
the Common Council of the City of Oshkosh concerning the adoption of this amendment
to the Official Map of the City of Oshkosh, and the Plan Commission having duly
recommended the adoption of this Ordinance.
NOW, THEREFORE, the Common Councit of the City of Oshkosh do ordain as
follows:
SECTION 1. That Section 30-68 of the Oshkosh Municipal Code pertaining to
the Official Map of the City of Oshkosh and its extraterritorial jurisdiction shown, is
hereby amended by deleting therefrom the present map sheet, and the substituting
therefore an amended map sheet, thereby making revisions to the official map as
described in the attached.
SECTION 2. Immediately upon these amendments to the Official Map becoming
effective, the City Clerk shall file a certificate with the Register of Deeds for Winnebago
County showing that the City has amended its official map; and shall remove from the
Official Map the obsolete map sheet and shall replace it with a copy of the map sheet
attached hereto; the obsolete map sheet shall be retained by the City Clerk in a hard-
bound folder and each sheet thereof marked to the effect that it was rescinded by action
of the Common Council this date; the new sheet added to the Official Map shall be
marked to the effect that the amended sheet was adopted by action of the Common
Council of this date.

RE: Approve Official Mapping for the Extension of Farmington Avenue, Extending Easterly
and South/South Westerly from Existing Farmington Avenue to Christian Drive and the
Extension of Christian Drive Extending Easterly and North/North Westerly to
Farmington Avenue (Plan Commission Recommends Approval)
BACKGROUND
The two properties located in the area of the official mapping request are single family residential
areas at the easterly terminus of Farmington Avenue and Christian Drive. Both streets were
previously dedicated in 1992 and 1996 respectively without turnaround features constructed at their
termination point as it was anticipated that the streets would continue to the east as the area was
developed. This did not occur and both Farmington Avenue and Christian Drive were constructed as
dead end streets without appropriate turnarounds which are usually created in the form of cul-de-
sacs.
ANALYSIS
Officially mapping roadway extensions to these two streets was initially discussed in 2010 during
review of a certified survey map for the south side of Farmington Avenue which would have required
the dedication of right-of-way to provide for a cul-de-sac that would take a considerable portion of one
of the lots. The proposed officially mapped road area totals 940 feet of length and 56,400 square feet
in area and creates a connection between Farmington Avenue and Christian Drive alleviating the
need for the cul-de-sac. The proposed right-of-way is 60 feet wide and extends 80 feet east of the
existing terminus of Farmington Avenue, then turns 90 degrees south 360 feet, then curves west 500
feet to connect with Christian Drive. The placement of the roadway was determined in coordination
with the Department of Public Works and the property owners and was designed to allow the most
desirable configuration for future lots. The official mapping will not dictate dedication or physical
improvement of the street but will reserve the area for future roadway when the lands are eventually
divided and developed and provides for locating future sanitary and water line placement.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its November 4, 2014 meeting.

GENERAL INFORMATION

Officially map public right-of-way beginning at the east terminus of the existing Farmington Avenue
ruruling east,then south, then west to connect with the existing terminus of Christian Drive.
Applicable Ordinance Provisions:
Zoning Ordinance Official Map Section 30-68 (D) states that"The Common Council, whenever and as
often as it may deem it for the public interest, may change or add to the Official Map so as to establish
the exterior lines of planned new streets, highways, parkways, parks, or playgrounds..."
Background Information:
The two properties for which this official mapping request is located are single family residential areas
located at the easterly terminus of Farmington Avenue and the easterly terminus of Christian Drive.
Farmington Avenue, extending approximately 360 feet east of its Anderson Street intersection, was
dedicated in 1992 in anticipation of residential lot development that took place on the north side in
2008 (lots were created and built upon) and on the south side in 2010 (lots not developed to date).
Christian Drive, extending approximately 143 feet east of its Eichstadt Road intersection, was
dedicated as part of the 1996 Vinland Farms Subdivision. Both roadways were terminated without
turnaround features as it was anticipated that they would continue to the east (typically, streets that
terminate within a lot boundary or are not anticipated to be extended are required to have a turnaround
(often a cul-de-sac) of 100 feet right-of-way diameter and a roadway not less than 70 feet in diameter).
Additionally, at the time Farmington Avenue was dedicated, a 60 foot wide storm sewer easement
(and storm sewer) was established running east from Farmington Avenue to the eastern lot line, then
continues to connect to Jackson Street. The placement of this easement also led to the belief that the
continuance of the roadway was forthcoming. However, this did not occur and both Farmington
Avenue and Christian Drive were constructed as dead end streets without appropriate turnarounds.

ANALYSIS
The topic of officially mapping the Farmington Avenue and Christian Drive roadway extensions was
discussed during the review of the 2010 three-lot certified survey map for the south side of Farmington
Avenue as the mentioned turnaround area is required to be dedicated as right-of-way to provide for a
cul-de-sac at the dead end of Farmington Avenue. This requirement is burdensome of the developer as
it takes a considerable portion of one of the lots far a cul-de-sac but is necessary because there is not
anticipated development on the properiy to the east. If an extension to Farmington Avenue is placed on
the official map,the City has the option to install a temporary turnaround within the existing 60 foot
Farmington Avenue right-of-way, thereby allowing the proposed lots to be divided without the loss of
area for right-of-way dedication.

allow the most desirable configuration for future lots. No official mapping of Farmington Avenue or
Christian Drive is proposed to extend further east as it is unneeded for traffic circulation or utility
location and the property owners have not yet determined their intent on future development options
for the easternmost portion of their lots.
The official mapping of roadway from Farmington Avenue to Christian Drive will not dictate
dedication of the road or physical improvement of the street, but will reserve the area far future road
when the lands are eventually divided and developed. Placing the roadway location on the official map
will preserve the integrity of the planned road system in the area and remove potential interim conflicts
as no building permits will be issued far any structure that does not provide the setback required from
the officially mapped roads and the authorization to issue building permits may require the submission
of a plan showing the location of any proposed structures with reference to the officially mapped
streets. Additionally, the placement of the roadway network connecting Farmington Avenue to
Christian Drive provides for locating future sanitary and water line placement and provides the
assurance on the ability to develop desirable "looping" of water utilities. Placing the location of future
roadways on the official map also acts to convey the design intent to the current owners and future
developers of the lands and requires conformity or amendment to the official map for any future land
divisions.
Staff inet with the owners of the affected properties to explain what it means to have an officially
mapped roadway on their property, discuss the need to do it at this time, provide examples of potential
future lot layouts and to address any of questions or concerns. The property owners understand the
need to officially map the roads, do not object to the proposed placement and feel that conceptual lot
configurations may assist in their decision making processes to develop or market their properties.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the official map action as requested.
The Plan Commission approved the official mapping as requested. The following is the Plan
Commission's discussion on this item.

Mr. Buck presented the item and reviewed the site and surrounding area as well as the zoning and land
use in said area. He discussed the history of site development and street construction as both roadways
were terminated without appropriate turnaround features such as a cul-de-sac due to the anticipation
that the these roadways would continue to the east. As this did not occur, a cul-de-sac would be
required at the terminus of Farmington Avenue if additional lots were to be developed which would
take a considerable portion of one of the lots which was discussed during review of a three-lot certified
survey map in 2010. The official mapping of the roadway extensions would alleviate the need for a
cul-de-sac and was discussed with the property owners who did not have any objections to this concept
and would assist in conceptual lot configurations for future development.

Mr. Buck reviewed the site plan for the official mapping proposed as well as a conceptual site plan of
how the area could be developed with additional residential lots with the connection of these two
roadways. He explained that the official mapping would preserve this area as future right-of-way but
the area could be adjusted in the future if development patterns and traffic circulation would change.
Mr. Gray questioned why these two roadways would not be extended to Jackson Street instead of the
connection of the two to the east.
Mr. Buck responded that the lots to the east fronting Jackson Street are zoned for commercial use and
extending these roadways to this point would not be beneficial for the residential area as it would
increase traffic in the neighborhood. This concept would also have to be discussed with the Wisconsin
Department of Transportation as access points to Jackson Street are limited due to its highway
designation. He reiterated that the official mapping could be changed at a later date if desired.
Mr. Gray then questioned why the roadway connection would not be extended to the commercial lots
on Jackson Street.
Mr. Buck replied that this layout would allow for the best scenario for residential lot development in
the remaining area that is not zoned commercially.
Motion by Bowen to approve the official mapping ofpublic right-of-way from the east terminus
of existing Farmington Avenue to connect with the existing terminus of Christian Drive.
Seconded by Hinz. Motion carried 7-0.
