FOR SANITARY SEWER LATERAL TELEVISING ($5,217.02) INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the City and Mi-Tech Services, Inc. previously entered into a professional services agreement in which Mi-Tech Services, Inc. would provide the City with services for sanitary sewer lateral televising; and WHEREAS, additional engineering services were necessary including additional manhole set-ups, additional sanitary lateral launches, additional main line and lateral televising, and capped lateral verification. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are authorized and directed pursuant to Section 12- 16 of the Municipal Code to enter into an amended agreement with Mi-Tech Services, Inc. BE IT FURTHER RESOLVED that an amendment to the agreement with Mi-Tech Services, Inc. is approved and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the final agreement. Gohde, Assistant Director of Public Works�`'� DATE: October 21, 2014 RE: Amendment to Engineering Services Agreement for Sanitary Sewer Lateral Televising Services Mi-Tech Services, Inc. (Mi-Tech) /$5,217.02 BACKGROUND A professional services agreement for sanitary sewer lateral televising services was awarded to Mi-Tech in December of 2013. During the course of performing the services within this agreement, it was determined that additional services were necessary in order to complete these services. ANALYSIS The services provided by Mi-Tech included additional manhole set-ups, additional sanitary lateral launches, additional main line and lateral televising, and capped lateral verification. These services were necessary in order to finish the televising of all the sanitary laterals in the 2014 Capital Improvements Program. FISCAL IMPACT Staff has reviewed the amendment and costs. The amount of this contract amendment is $5,217.02. This will raise the total agreement amount to $90,097.13 (not to exceed). These services will be funded through the Wastewater Utility. Funds are available within the Wastewater Capital Improvements Program for these additional services. RECOMMENDATIONS Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature may be procured without the use of formal, sealed quotes. I have reviewed this amendment and in accordance with Section 12-16 of the Code, I am hereby recommending that the Common Council approve the award of this engineering service amendment. Paragraph C in ARTICLE VII. PAYMENT included the provision that costs for additional services shall be negotiated and set forth in a written amendment to this AGREEMENT executed by both parties prior to proceeding with the work covered under the subject amendment. THEREFORE, the CITY and the CONSULTANT agree to insert the following paragraph after the first paragraph in ARTICLE III. SCOPE OF WORK: The CONSULTANT shall provide the services described in the CONSULTANT's Change Order dated September 12, 2014. The CITY and the CONSULTANT further agree to insert the following bullet point after the second bullet point in Paragraph A of ARTICLE VII. PAYMENT: • Payment for Amendment No. 9 shall be a Time and Materials Sum not to exceed Five Thousand Two Hundred Seventeen Dollars and Two Cents ($5,217.02) All other terms contained within the December 11, 2013 agreement remain unchanged and in effect.
