HomeMy WebLinkAbout02. 14-467 OCTOBER 28, 2014 14-467 RESOLUTION (CARRIED__7-0______ LOST________ LAID OVER________ WITHDRAWN_______) PURPOSE: APPROVAL OF FINAL RESOLUTION AUTHORIZING REASSESMENTS OF TAX PARCEL 15-1898-1000 PURSUANT TO SECTION 66.0703(10) WISCONSIN STATUTES BY EXERCISING SPECIAL ASSESSMENT POLICE POWERS UNDER SECTION 66.0703(1)(b) WISCONSIN STATUTES FOR THE JACKSON-MURDOCK INTERSECTION RECONSTRUCTION PROJECT INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the Common Council of the City of Oshkosh held a public hearing on th the 28 day of October, 2014, at 6:00 p.m., for the purpose of hearing all interested persons concerning the Preliminary Resolution and Report of the City Manager (Board of Public Works) dated September 23, 2014, for the reassessments of Tax Parcel 15-1898- 1000 for the Jackson Street-Murdock Avenue intersection reconstruction project that included the construction of a roundabout to replace traffic signals; concrete paving; asphalt paving; sanitary sewer laterals (new and relaid); sanitary sewer main; water main; water laterals (new and relaid); storm sewer laterals; sidewalk replacement and repair; concrete driveway approaches; and streetscaping / landscaping improvements in the following determinable area: Jackson Street – 100’ south of Hobbs Avenue to 500’ north of Murdock Avenue Murdock Avenue – 450’ west of Jackson Street to Burdick Street Hobbs Avenue – Jackson Street to 25’ west of Jackson Street Kentucky Street – Murdock Avenue to 25’ south of Murdock Avenue. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh as follows: 1. That the report of the City Manager, acting as the Board of Public Works, dated October 28, 2014, is hereby approved and adopted and incorporated herein, and the reassessments of Tax Parcel 15-1898-1000 be levied in accordance with the report. 2. Tax Parcel 15-1898-1000 is declared to be specially benefited by the project, by a substantial increase in accessibility which includes safer, lower cost and shorter travel times for customers, deliveries and employees, and by streetscape improvements which enhance aesthetics of the area around the property. The reassessments of Tax Parcel 15-1898-1000, as shown in the Schedule of Reassessments, represent an exercise of the police power and have been determined on a reasonable basis. 4. That the reassessments for all improvements are combined for each street frontage as a single reassessment as follows: Murdock Avenue - $19,241.73 and Jackson Street - $19,404.93. The property owner shall be entitled to object to each reassessment separately or both reassessments jointly for any purpose. 5. That the assessments may be paid in cash, or in installments pursuant to Section 25-83 thru 25-89 of the Oshkosh Municipal Code, said deferred payments to bear interest at the rate of six percent (6%) per annum on the unpaid balance. The City Clerk shall publish an installment assessment notice in accordance with Section 66.0715(3)(e) of the Wisconsin Statutes in the official newspaper of the City. 6. The City Clerk is directed to publish this resolution in the OSHKOSH DAILY NORTHWESTERN, the official newspaper of the City. 7. The City Clerk is further directed to mail a copy of this resolution to every property owner whose name appears on the assessment roll whose post office address is known or can with reasonable diligence be ascertained. CI TY CLERK �l #1 SEPTEMBER 23, 2014 14-426 RESOLUTION (CARRIED 7-0 LOST LAID OVER WITHDRAWN _) PURPOSE: APPROVE INITIAL RESOLUTION DECLARING INTENT TO REASSESS TAX PARCEL 15-1898-1000 (RECONSTRUCTION OF JACKSON STREET— MURDOCK AVENUE INTERSECTION) INITIATED BY: CITY ADMINISTRATION WHEREAS, the Wisconsin Department of Transportation and the City of Oshkosh undertook a project to reconstruct the Jackson Street-Murdock Avenue intersection that included, among other improvements, the construction of a roundabout to replace traffic signals; concrete paving; asphalt paving; sanitary sewer laterals (new and relaid); storm sewer main and laterals; sidewalk replacement and repair; concrete driveway approaches; and streetscaping / landscaping improvements; and WHEREAS, the total project cost was $4,060,000 with a City share of$1,449,250 pursuant to a Revised State/Municipal Agreement between the City of Oshkosh and the Wisconsin Department of Transportation; and WHEREAS, by Final Resolution 10-227, adopted July 27, 2010, the City of . Oshkosh levied special assessments for a portion of its cost of the project (for concrete paving, sanitary sewer laterals, storm sewer laterals, sidewalk replacement and repair, concrete driveway approaches and streetscaping/landscaping improvements) against adjacent properties that were specially benefitted, in the limited and determinable area described as follows: Jackson Street— 100' south of Hobbs Avenue to 500' north of Murdock Avenue Murdock Avenue —450' west of Jackson Street to Burdick Street Hobbs Avenue— Jackson Street to 25' west of Jackson Street Kentucky Street— Murdock Avenue to 25' south of Murdock Avenue. WHEREAS, under Final Resolution 10-227 the assessment rate was $125.81 per assessable lineal foot; the total assessment was $299,272.13; and the assessments for Tax Parcel 15-1898-1000, owned by CED Properties LLC, was $19,241.73 for the Murdock Avenue frontage and $19,404.93 for the Jackson Street frontage; and SEPTEMBER 23, 2014 14-426 RESOLUTION CONT'D WHEREAS, CED Properties appealed its assessments on grounds that there were no special benefits to its property, and that the City of Oshkosh failed to comply with statutory requirements; and WHEREAS, the special assessments for CED Properties, LLC, were declared invalid for failure to comply with statutory assessment requirements by an Amended Judgment in Case No. 10-CV-1866, Winnebago County Circuit Court; and WHEREAS, Section 66.0703(10) Wis. Stats., authorizes the governing body to reassess properties where the special assessment is found to be invalid, NOW THEREFORE, BE IT RESOLVED by the City of Oshkosh Common Council as follows: 1. The City of Oshkosh Common Council hereby declares its intent to exercise its police powers under Sections 66.0703(1)(b) and 66.0703(10) Wis. Stats., to reassess Tax Parcel 15-1898-1000 for special benefits from the Jackson-Murdock intersection reconstruction project. 2. The intersection reconstruction improvements included the construction of a roundabout to replace traffic signals; concrete paving; asphalt paving; sanitary sewer laterals (new and relaid); storm sewer main and laterals; sidewalk replacement and repair; concrete driveway approaches; and streetscape/ landscaping improvements. 3. The City of Oshkosh Common Council hereby finds that the reconstruction project provided special benefits to Tax Parcel 15-1898-1000 and that the project promoted the public health, safety, comfort, convenience and welfare of the City of Oshkosh and the assessment area as described above. The purpose of the project is to reduce congestion at the intersection, increase traffic safety, renew utilities and enhance aesthetics. 4. The City of Oshkosh Common Council determines that the special assessment be made under the police power of Section 66.0703(1)(b) Wis. Stats., and that the amount assessed against Tax Parcel 15-1898-1000 shall be made upon a reasonable basis not to exceed total construction and material costs, including engineering fees, attorneys' fees, publication expense and other appropriate administrative expenses. 5. The City of Oshkosh Common Council declares its preliminary intent that the reassessments against the benefited property may be paid in cash or in installments pursuant to Section 25-83 thru 25-89 of the Oshkosh Municipal Code, said deferred payments to bear interest at the rate of six percent (6%) per annum on the unpaid SEPTEMBER 23, 2014 14-426 RESOLUTION CONT'D balance. The City of Oshkosh Common Council also declares its preliminary intent that one consolidated assessment for each street frontage be levied, and that assessment payments be allocated to the proper account. 6. The Project Report, consisting of plans and specifications; sources of funding; maps of the proposed assessment area and property; an estimate of the entire cost of the project; the purpose of the project; a statement that the property against which the assessments are proposed is benefited; and the schedule of proposed reassessments, is attached. 7. The City Clerk is directed to prepare and publish a Class One Notice of Public Hearing as specified in Section 66.0703(7) Wis. Stats. The Notice of Public Hearing shall state the time and place at which all persons interested, or their agents or attorneys, may appear before the City of Oshkosh Common Council and be heard concerning the matters contained in the Preliminary Resolution and Project Report, which shall be a public hearing. A copy of the Notice of Public Hearing, and the Preliminary Resolution together with the Project Report shall be mailed at least 10 days before the hearing date to all interested persons whose post office addresses are known, being the abutting property owners in the assessed area. The public hearing shall commence not less than 10 days nor more than 40 days after publication. PROJECT PLANS AND SPECIFICATIONS. The Project has been completed. Photographs of the Jackson-Murdock intersection before and after the project are part of Attachment 2, pp. 2-11 to 2-13. A detailed cost breakdown of construction items is contained in Attachment 2, pp. 2-1 to 2-10. Engineering sheets are available for inspection from the City Clerk. Maps of the Project area and affected assessed properties are contained in Attachment 2, pp. 2-14 to 2-17. Assessment schedules of the previous assessment are contained in Attachment 2, pp. 2-18 to 2-21. Tax Parcel 15-1898-1000, for which this reassessment applies, is highlighted in the maps and schedules. The Parcel is owned by CED Properties, LLC, and has an address of 1800 Jackson Street. 3. BENEFIT ANALYSIS FOR TAX PARCEL 15-1898-1000. Tax Parcel 15-1898-1000 is located at the northeast corner of the Jackson- Murdock intersection. It has approximately 236 feet of frontage on Murdock Avenue and approximately 154 feet of frontage on Jackson Street. The property has access, via easements, from Jackson Street and from Murdock Avenue. See Attachment 2, p. 2-11. Jackson Street is classified as a Principal Arterial Street without full access control. As such, the primary function of Jackson Street is moving and carrying traffic—a community benefit. Because abutting properties also have access, Jackson Street has a secondary function of providing access — a special benefit to the abutting properties. Murdock Avenue from Jackson Street east to Bowen Street is classified as a Minor Arterial. As such, it too functions mostly to move and carry traffic — a community benefit. With access by abutting properties, Murdock Avenue also has a secondary function of providing access — a special benefit to abutting properties. See Attachment 3, pp. 3-6 to 3-7. For 2010, Average Daily Traffic on Jackson Street just north of Murdock Avenue is 14,400 vehicles per day. Average Daily Traffic on Murdock Avenue just east of Jackson Street is 10, 600 vehicles per day. Jackson Street south of Murdock Avenue has an Average Daily Traffic of 12, 500 vehicles per day, and Murdock Avenue west of Jackson Street has an Average Daily Traffic of 10,'100 vehicles per day. The intersection generally serves approximately 25,000 vehicles per day. See Attachment 3,p. 3-1. With the previous traffic signals, the average delay was 37.9 seconds per vehicle (level of service). With a roundabout, the average delay is projected at 10.5 seconds per vehicle (level of service). See attachment 3 at 3-3. With the previous traffic signals, queue lengths for southbound traffic on Jackson .Street were 651 feet for right turns and through traffic, and 364 feet for left turns. Queue lengths for westbound traffic on Murdock Avenue were 563 feet for right turns and through traffic, and 180 feet for left turns. With the roundabout, maximum queue lengths are estimated at 11 vehicles, or 220 feet (20' x 11). See attachment 3 at 3-3, Tax Parcel 15-1898-1000 is developed and used as a fast food restaurant under a Taco Bell franchise. The restaurant is 2,566 square feet in area (from City Assessor). It has a drive-through facility. According to the Institute of Transportation Engineers, !�ip Generation (5th ed.), a fast food establishment with a drive-through generates 632.1.2 vehicle trips per day per 1,000 square feet (Attachment 3, p. 3-2). For the Taco Bell restaurant, this would result in 1,973 trips per day (2,566 square feet '• 1,000 = 2.566 x 632.12 trips = 1,973 trips). Tax Parcel 15-1898-1000, generating 1,973 vehicle trips per day, accounts for 7.9 percent of the 25,000 vehicle trips per day through the Jackson-Murdock intersection. As a destination, the Parcel contributes 7.9 percent of the vehicles. As a use, 7.9 percent of the vehicles in the intersection area access the Parcel. The Murdock Avenue proposed assessment of $20,616.57 and the Jackson Street proposed assessment of$19,486.36, together amount to $40,102.93, and account for only 0.99 percent of the estimated total Project costs. 4. STATEMENT OF BENEFITS. Tax Parcel 15-1898-1000, the property against which the reassessment is proposed, is specially benefited by the Project. Queue lines, which prior to the Project extended well beyond the Jackson Street and Murdock Avenue driveways serving the Parcel, are reduced by well over half. Prior to the Project, the average intersection delay was 37.9 seconds per vehicle. After the Project, the average intersection delay is 10.5 seconds per vehicle, less than one-third the previous delay. Sidewalk sections with defects were identified prior to the project. Defective sidewalk sections include those with open cracks, offset joints or other defects that create a hazard to those using the sidewalk. Removal of these hazards provides a safe corridor for pedestrians to access the site. Tax Parcel 15-1898-1000 will be specially benefited by a substantial increase in accessibility, which includes safer, lower cost.and shorter travel times for customers, deliveries and employees. These special benefits are different in kind than those enjoyed by the public for through traffic. Tax Parcel 15-1898-1000 is also specially benefitted by the streetscape improvements and the enhanced aesthetics they provide. The proposed assessment will specially benefit Tax Parcel 15-1898-1000. The proposed assessment is reasonable and made on a reasonable basis. 5. SCHEDULE OF REASSESSMENTS. The reassessments of Tax Parcel 15-1898-1000 are the same amount as the initial assessments, and are determined on the same basis as the initial assessments for the Parcel, as well as the other parcels that were previously assessed. The reassessment amount for Tax Parcel 15-1898-1000 is $20,616.57 for the Murdock Avenue frontage and $19,486.36 for the Jackson Street frontage.
