BE IT RESOLVED by the Common Council of the City of Oshkosh that the disposition of Outlot 3 in River Mill Subdivision, to Michael Weber, is hereby approved with the following conditions 1. Outlot 3 shall be attached to 1695 River Mill Road (Parcel #12-2437-0000) 2. Outlot 3 shall continue to function as part of approved grading and drainage plan. 3. Storm sewer easement shall be extended to cover existing storm sewer inlet and allow for maintenance and reconstruction. O 1HKOlH ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Pianning Services DATE: October 9, 2014 RE: Approve Land Disposition of Outlot 3, River Mill Subdivision (Plan Commission Recommends Approvaf) BACKGROUND The area in this request involves a triangular, 2,247 square foot (0.052 acre) parcel the City obtained as a result of the vacation of a portion of railroad right-of-way and subsequently platted as an outlot of River Mill Subdivision in 1985. When originally platted, an existing rail line resulted in the creation of 12 outlots containing the rail line which has since been removed, vacated and deeded to the city. An additional ten outlots were created from remnant parcels unsuitable for development. Over the years, several of the outlots have been disposed to adjacent property owners, or incorporated into road right-of-way or pedestrian trail (WIOUWASH State Trail). ANALYSIS The subject property, especially given its small size and shape, serves no real practical use to the City and its disposition would no longer make the City responsible for maintenance of the property and could then be combined with the adjacent property to the east. The Department of Public Works has reviewed the request and is in support of the disposition providing that an existing storm sewer easement be amended to include the existing storm sewer inlet and allow for maintenance and reconstruction and the subject area's drainage would continue to function per the approved grading and drainage plan. FISCAL IMPACT None anticipated, the disposed land will add back a few thousand dollars to the property tax rolls. RECOMMENDATION The Plan Commission approved of this request at its October 7, 2014 meeting. Approved, ,� City Manager ITEM: LAND DISPOSITION OF OUTLOT 3,RIVER MILL SUBDIVISION Plan Commission meeting of October 7, 2014 GENERAL INFORMATION Applicant/Owner: City of Oshkosh Actions Requested: The City of Oshkosh requests the land disposition of Outlot 3 of River Mill Subdivision. Applicable Ordinance Provisions: N/A Property Location and Background Information: On July 31, 2014 Michael Weber, owner of 1695 River Mill Road (Lot 37, River Mill Subdivision) approached the City to purchase Outlot 3, adjacent to his property. ANALYSIS Staff reviewed this request and is in support of the disposition of the outlot. The land serves no practical use to the City and the disposition would no longer make the City responsible for maintenance of the property. Staff does recommend that once disposed, the outlot should be combined with the adjacent property to the east (1695 River Mill Road). The Department of Public Works reviewed the request and is also in support of the disposition. They reported that there is an existing storm sewer easement containing a storm inlet near the common property line. Therefore, they are recommending the storm sewer easement be amended to include the existing storm sewer inlet and allow for maintenance and reconstruction. Also, the Department of Public Works requests a condition that the subject area's drainage will continue to function per the approved grading and drainage plan. RECOMMENDATI ON/CONDITIONS Staff recommends approval of the land disposition of Outlot 3 of River Mill Subdivision with the following conditions: 1. Outlot 3 shall be attached to 1695 River Mill Road(Parcel #12-2437-0000). 2. Outlot 3 area shall continue to function as part of approved grading and drainage plan. 3. Storm sewer easement shall be extended to cover existing storm sewer inlet and allow for maintenance and reconstruction. The Plan Commission approved the land disposition of Outlot 3 of River Mill Subdivision as requested with revised conditions. The following is the Plan Commission's discussion on this item. Mr.Nau presented the item and reviewed the site and surrounding area and reviewed the original plat from when the subdivision was created. He explained how the outlots were created due to the removal of the rail line that was then deeded to the City and that this was the last outlot remaining in this area of the plat. The adjacent property owner has currently been maintaining the area and has approached the City with the desire to acquire the outlot and combine it with his parcel. The parcel serves no purpose to the City and the disposition would result in the City no longer being responsible for maintenance of this site. The Department of Public Works has reviewed the request and recommended approval with a revision to the conditions stated in the staff report to change condition#3 to "grading and drainage easement be placed over all of Outlot 3". Mr. Nau also reviewed the revised conditions recommended for this request. Ms. Propp questioned if the property owner would be prevented from placing any structures or landscaping in this area if a grading and drainage easement was to be placed over the entire area. Steve Gohde, Assistant Director of Public Works, responded that the City would not allow structures, mulch, or low growing vegetation in this area however light landscaping such as small shrubs or trees would be allowed as long as the plantings do not prevent the drainage flow of the area. These provisions would be addressed as part of the grading and drainage easement document. Motion by Vajgrt to approve the land disposition of Outlot 3, River Mill Subdivision with the following conditions: 1. Outlot 3 shall be attached to 1695 River Mill Road(Parcel#12-2437-0000). 2. Outlot 3 area shall continue to function as part of approved grading and drainage plan. 3. Grading and drainage easement be placed over all of Outlot 3. Seconded by Borsuk. Motion carried 8-0.
