PURPOSE: APPROVE CONDITIONAL USE PERMIT/PLANNED
DEVELOPMENT AND ARCHITECTURAL DESIGN FOR
CONSTRUCTION OF PUBLIC RESTROOMS/SHELTER AND
ASSOCIATED AMENITIES FOR BOATWORKS RIVERWALK/
PARK DEVELOPMENT

PLAN COMMISSION RECOMMENDATION: Approved
WHEREAS, as part of the Southshore Riverwalk improvements, the
Redevelopment Authority and City of Oshkosh desire to construct a public park west of
the former Boatworks property to include a restroom/shelter, off street parking area,
kayak/canoe launch, and associated amenities; and
WHEREAS, pursuant to Section 62.23(5) of the Wisconsin Statutes, the Plan
Commission reviewed and recommends approval of the location and design of a public
restroom and shelter facility.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the architectural design of the restroom/shelter at the Boatworks
Riverwalk, per the attached, is hereby approved and that the proper City officials are
authorized to undertake all necessary tasks with a purpose of constructing a public
restroom facility and shelter, off-street parking area and kayak/canoe launch west of the
former Boatworks property on Michigan Street with the understanding that such further
specific reviews and approvals will be appropriately sought as necessary under
Wisconsin Statutes, the City of Oshkosh Municipal Code and policies.
BE IT FURTHER RESOLVED by the Common Council of the City of Oshkosh
that a conditional use permit for the planned development of a public park, west of the
Boatworks property, and associated amenities and Riverwalk improvements on the
Boatworks property on Michigan Street, per the attached, is hereby approved.

BACKGROUND
The City of Oshkosh is seeking approval for construction of a new public restroom facility and shelter
to serve users of the riverwalk, William A. Steiger Park and Michigan Street fishing pier. The restroom
is to be constructed in conjunction with the Boatworks pedestrian bridge/riverwalk (currently under
construction), off-street parking area and other site improvements. The subject site where the
restroom is to be constructed is currently Michigan Street right-of-way; which the City plans to vacate
later this year. The off-street parking area is proposed to be located on both the Sanitation Garage
property and adjoining City vacant lot to the west. The City is in the process of preparing a three-lot
certified survey map which will re-divide separate parcels for the Sanitation Garage, Parks property
and Boatworks property for redevelopment.
ANALYSIS
The proposed building is to be located in the "loop" of the riverwalk leading up to the bridge crossing
of the lagoon/marina and will house handicap accessible restroom facilities, a mechanical and storage
room, and an additional roof area which will serve as the shelter area. The design of the building is
very similar to the restroom shelter constructed in Menominee Park in 2011 although slightly smaller
in size. The proposed off-street parking area is to be located on the west side of Michigan Street
north of W. 4th Avenue containing 14 stalls and a circular biofilter assisting in quality control of storm
water runoff. The proposed plans also include a pedestrian walkway outside of the parking area with
a bench bump out area that connects to the shelter facility, riverwalk, and public sidewalk on W. 4tn
Avenue. Additional improvements include a kayak and canoe launch near the southwest corner of the
Boatworks lagoon and a playground area northwest of the shelter building. Landscape plans have not
yet been submitted but will be required to meet zoning ordinance standards. This project is scheduled
to be completed in 2014 and costs have been included in the 2014 Capital Improvements budget and
will also be partially funded by a grant from the Wisconsin Department of Natural Resources.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its September 16, 2014 meeting.

Applicable Ordinance Provisions:
Public facilities are permitted only through conditional use permits in the C-3 Central Commercial
District as regulated in Section 30-26 (A)(16) of the Zoning Ordinance. Standards imposed on
Conditional Use Permits are located in Section 30-11 (D) of the Zoning Ordinance.
The site is also located within a Planned Development Overlay District, which standards are
located in Section 30-33(E)(3) of the Zoning Ordinance.

ANALYSIS
The City is cunently in the process of designing and constructing a series of site improvements
west of the former Boatworks Marina, currently owned by the City of Oshkosh Redevelopment
Autharity. Proposed improvements include a restroom/shelter facility, off-street parking area,
kayak launch and future playground area.
Restroom/Shelter Facility:
The proposed building is shown to be located in the "loop" of the riverwalk leading up to the
bridge crossing of the lagoon/marina. Plans show the new restroom/shelter building to be 32 feet
by 15-feet, eight inches and approximately 501 square feet with an additiona149 foot by 30 foot
roof area, off set from the center of the main building to serve as the shelter area. The main
building houses handicap accessible restroom facilities, mechanical room and storage room. The
building will be placed on a 53-foot by 30-foot, eight-inch 1,626 square foot concrete slab.
The design of the building is very similar in design to the restroom shelter constructed in
Menominee Park in 2011, although slightly smaller in size. The finish material for the structure is
proposed to be 6 inch horizontal fiber cement siding with eight inch trim with an approximately 3-
foot, six inch split-faced concrete masonry unit knee wall. The roof will be partially supported by
several eight inch by eight inch Douglass fir columns.
Off-street Parking Area:
The proposed off-street parking area is shown to be located on the west side of Michigan Street,
approximately 350 north of W. 4th Avenue. The lot is cul-de-sac shaped with 14 stalls (13 plus
one handicap)placed parallel to the outside periphery of the bulb. The center of the bulb features
a 45-foot diameter circular biofilter which will assist in quality control of storm water runoff. The
outside of the parking area shows a pedestrian walkway with a bench bump out area that connects
to the shelter facility, riverwalk and public sidewalk on W. 4t''Avenue.
Other Amenities:
The proposed plan shows additional improvements including a kayak and canoe launch located
near the southwest corner of the Boatworks lagoon. The launch will be accessed by a pedestrian
walk and provides a nearby handicap parking stall.
Lastly the plan shows a playground area immediately northwest of the shelter building. The
playground area is also located in the "loop" area, however, at this time there are no plans to install
playground equipment.

A landscape plan has not been submitted, but will need to meet the minimum requirements of the
Zoning Ordinance.
This project was included in the 2014 Capital Improvements budget and will also be partially
funded from a grant received from Wisconsin Department of Natural Resources for riverwalk and
park developments. Construction is scheduled to start in the fall of 2014 with projected
completion in December, 2014.
RECOMMENDATION/CONDITIONS
Staff believes that the proposed CUP/PD request will not have a negative impact on surrounding
area, will be harmonious with the intended character of the general vicinity, and will not be
detrimental to neighboring property or the community as a whole and recommends approval of the
conditional use permit/development plan as requested.
The Plan Commission approved of the conditional use permit/planned development as requested.
The following is the Plan Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area as well as the land use and
zoning classifications in said area. He discussed the history of the site and the riverwalk
development plans which part of the riverwalk has already been constructed on this side of the
river and the remainder is still in progress. He reviewed the site plan and the building elevations
for the proposed restroom and shelter facility and discussed features of the structure. He reviewed
the building design which is similar to the restroom and shelter facility that was constructed in
Menominee Park a few years ago and displayed a rendering of the proposed structure. He also
discussed the parking area and the kayak and canoe launch feature and the street vacation of the
terminus of Michigan Street and certified survey map to divide the parcels which will both be
brought forward in the future. He also indicated that the costs for these amenities are included in
the 2014 CIP and will also be partially funded from a grant received from the Wisconsin
Department of Natural Resources (DNR). The proposed facility and related amenities are
proposed to be constructed in 2014.
Mr. Borsuk commented on the riverwalk design concept that was displayed on the screen and
questioned if it was proposed to be residential land use in this location.
Mr. Burich responded that the vacant area that used to be occupied by the Jeld-Wen factory was
most likely going to be developed as single family homes or townhouses.
Mr. Borsuk then questioned the storage unit type huts that remain on the site.
Allen Davis, Directar of Community Development, stated that this would be a short term use on
the site and the remaining property would most likely be combined with the redevelopment of the
Boatworks property.
Mr. Fojtik inquired if the City has a standard for this type of structure.
Mr. Davis responded that the Parks Department wanted this facility to match other restroom
facilities that have been constructed in other park locations.

Mr. Borsuk questioned the statement that the landscape plan would meet the minimum standard
requirements of the zoning ordinance.
Mr. Burich indicated that this was required.
Mr. Borsuk commented that it was disturbing that we will only meet the minimum standards in
this regard as he felt since it was on the riverwalk we would desire to exceed the landscaping
standards.
Mr. Thoms inquired if all the utilities in this area were city utilities.
Mr. Nau responded that there are permanent easements over the right-of-way and any other
utilities would be located through the Boatworks property.
Mr. Gohde added that the Department of Public Works would need to review the proposed
restroom/shelter facility's location compared to the location of any existing underground utilities.
Mr. Thoms commented that the conditional use permit allows the Plan Commission to set the
standards for any landscaping features for this area.
Mr. Gray commented that he had concerns about moving forward with this request prior to the
vacation of Michigan Street and the approval of the certified survey map. He felt these items
should have been completed first before requesting approval of the building design.
Mr. Davis responded that it was a timing factor as the DNR has approved grant funding for
completion of a portion of this work however we have to accommodate the construction to use the
grant funding yet this year.
Mr. Gray then questioned if there were any requirements for a specific distance between these
types of shelters.
Mr. Davis indicated that he was not aware of any requirements restricting the proximity of shelter
structures however there are no other restroom/shelter facilities in this area that he is aware of.
Mr. Gray also questioned if the City had considered offering food concessions at this location as it
could be a source to generate revenues.
Mr. Cummings left the meeting at 4:40 pm.
Mr. Fojtik stated that things such as concessions was not part of the approval of the building
design and would be an item to be considered at the Common Council level.
Mr. Thoms inquired if the biofilter system referenced in the staff report would be to service the
restroom facility development only.
Mr. Gohde responded that this system was just to address the site development for the impervious
surface being installed in the area of the restroom/shelter facility.

Mr. Borsuk voiced his concerns with spending millions of dollars on the riverwalk without a very
well planned restroom/shelter facility.
Mr. Davis replied that the Parks Department was very happy with the Menominee Park facility and
although an upper scale design for future development may be a better choice, the development of
the remaining area could be commercial and it an unknown factor at this time. The design of the
facility could probably be better matched at a later date when more of the remaining development
has been decided however the grant funds currently approved by the DNR to help offset the costs
of this construction would no longer be available at that time.
Ms. Propp commented that she would like to see the big picture of the riverfront development
plans as a whole as the current plans are conceptual only however she would support this request
due to the funding conditions.
Motion by Vajgrt to approve a conditional use permit/planned development to allow
placement of a public restroom and shelter facility and associated amenities located west
of 362 Michigan Street (former Boatworks property).
Seconded by Bowen.
Mr. Thoms agreed with Ms. Propp on the grant funding issue however he stated that the City has
known that the riverwalk was going to be constructed far quite some time and he was not satisfied
with the design standards and the landscaping plans may not be adequate either. He would support
the request due to the grant funding issue.
Mr. Borsuk stated that he did not feel this was justified by a lack of planning on the City's part and
the shelter constructed in Menominee Park should not have been used as an example for what
would be appropriate on the riverwalk. He felt the City should go beyond just settling for what
was already designed for another use and he would not support this request.
