PURPOSE: APPROVE CONDITIONAL USE PERMIT FOR EXCEPTIONS TO
THE PROVISIONS OF THE DOWNTOWN OVERLAY DISTRICT
STANDARD MODIFICATION; 502 NORTH MAIN STREET / SKI’S
MEAT MARKET

PLAN COMMISSION RECOMMENDATION:
Approval of south façade sign; denial of
dumpster enclosure
WHEREAS, the applicant desires to make the following improvements/alterations
at 502 North Main Street that do not comply with the Downtown Overlay District.
1) Installation of a wall sign on the south façade along Merritt Avenue
2) Construction of 20 foot X 16 foot wood dumpster enclosure on the east side of an
existing masonry accessory structure.
AND WHEREAS, the Plan Commission recommends approval of the wall sign on
the south façade, and
WHEREAS, the Plan Commission recommends denial of the exception request to
construct a dumpster enclosure using wood planks for finish material.
NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of
Oshkosh that a conditional use permit is hereby approved under Section 30-11 of the
Oshkosh Zoning Ordinance for exceptions to the building design standards of the
Downtown Overlay District to install a wall sign on the south façade and construct a
dumpster enclosure using wood planks for finish material per the attached, with the
following condition:
1) Proposed signage on south façade shall be the same size with channel letters
being the same size and font and color scheme to be complimentary with the
existing Winnebago Bicycle sign.

BACKGROUND
The subject property is a 0.78 acre parcel of land located at 500 -502 North Main Street at the
northeast corner of N. Main Street and Church /Merritt Avenue. The four - story, three level
brick building is historically known as the Wagner Opera House. It was originally an opera
house /concert hall designed by famous local Oshkosh architect William Waters and
constructed in 1874. It is a brick Romanesque Revival building with additions constructed in
1924 and early 2000's It has been sensitively maintained over the past 940 years and is
considered a pivotal structure within the National and State Register of Historic Places — a
contributing building of the North Main Street Historic District (Listed in 1995 as the First
Methodist Church). The first floor is currently occupied by one commercial tenant,
Winnebago Bicycle, 500 N. Main Street, located at the southern portion of the building. The
northern portion of the first floor formerly occupied by Great Estates Furniture Store is
currently being renovated for Ski's Meat Market, with anticipated opening in mid - September,
2014 and the basis for this Conditional Use Permit request.
ANALYSIS
The applicant is in the process of obtaining approval for four wall signs for Ski's Meat Market
with one sign proposed for each facade with the signage for the east and west facades
meeting the design standards of the Downtown Overlay District. Signage for the south
facade is proposed to be a second raised channel letter /corporate logo sign placed above the
existing sign for Winnebago Bicycle facing Merritt Avenue. The proposed sign is designed to
be similar to the existing sign but will exceed the amount of signage allowed by the
Downtown Overlay and the placement is proposed above the bottom sill of the second story
window which is also prohibited in the Downtown Overlay District. Considering the
exceptionally large area of the south facade, staff is in support of this exception to exceed the
allowed square footage providing the proposed sign matches the existing sign including the
height of the channel letters. Staff is also supportive of allowing a second sign on this facade
again due to the building size and ability to have multiple tenants providing it complements
the existing sign in size and style. Staff also reviewed the proposed location immediately
above the Winnebago Bicycle sign and found it to be the least intrusive location available and
will maintain a consistent look for the signage. Signage for the north facade was withdrawn
by the petitioner at the meeting. The request was presented to the Landmarks Commission
for review and the Commission was supportive of the exception requests with
recommendations. An additional exception to the Downtown Overlay was requested for the
exterior finish materials for a proposed dumpster enclosure which the applicant is proposing
to construct of horizontal wood planks where the Overlay requirements are for it to be
constructed of similar materials used on the principal structure. As this enclosure will be
visible from both Merritt Avenue and Jefferson Street, staff is recommending denial of this
exception request.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of the sign variance for the south facade at its August 19,
2014 meeting.
The Plan Commission did not approve of the variance request for the dumpster enclosure
materials.
The Resolution before Council is to approve both the exception for the sign on the south
fagade and the exception for the wooden dumpster enclosure materials. If Council desires to
not approve of the wooden dumpster enclosure material, a Council member will need to
make a motion to amend the Resolution to delete the reference to 'construct a dumpster
enclosure using wood planks for finish material'.

GENERAL INFORMATION

Action(s) Requested:
The applicant is requesting approval of a conditional use permit for exceptions to the sign design
standards of the Downtown Overlay District to install two wall signs and construction of a dumpster
enclosure which do not meet the criteria listed in the Downtown Overlay District.
Applicable Ordinance Provisions:
SIGN #1 — Wall sign on south facade along Merritt Avenue.
The applicant is proposing to install a second 33 square foot wall sign on the south facade that will
be located above the bottom window sill of the second floor.
Zoning Ordinance Section 30- 27(D)(6)(a) of the Downtown Overlay District's design standards
allow for only one (1) wall sign per storefront operation.
Zoning Ordinance Section 30- 27(D)(6)(b) of the Downtown Overlay District's design standards
allow for total sign area up to 5% of the wall area up to a maximum of 32 square feet with a 5%
increase for signs comprised of approved materials listed in the ordinance.
Zoning Ordinance Section 30- 27(D)(6)(c) of the Downtown Overlay District's design standards
require wall signs to be located no higher than the bottom window sill of the second story or 18 feet,
whichever is less.
SIGN #2 — Wall sign on north facade.
The applicant is proposing to install a 400 square foot vinyl wall sign on the north facade that will
be located more than 18 feet above ground level.
Zoning Ordinance Section 30- 27(D)(3)(g) of the Downtown Overlay District's design standards
prohibit vinyl signage and other thin flat materials.
Also, see above provisions of Sections 30- 27(D)(6)(b) and 30- 27(D)(6)(c) of the Downtown
Overlay District for permissible design standards in regard to size and placement of wall signs.
DUMPSTER ENCLOSURE —
The applicant is proposing to construct a 20 foot by 16 foot dumpster enclosure on the east side of
an existing masonry accessory structure (garage) using 2 x 6 horizontal wood as finish material.
Zoning Ordinance Section 30- 27(C)(7)(k) of the Downtown Overlay District's design standards
require all exterior, exposed walls of a public fagade of any accessory structure to be constructed of
similar materials used on the principal structure in terms of color and texture.
Background Information Property Location and Type:

The applicant is in process of approval for four wall signs for Ski's Meat Market, with one sign
proposed for each fagade of the building. The proposed signage for the east and west facades
include a 4.5 square foot and a 30 square foot raised channel letter /corporate logo, signs that meet
the design standards of the Downtown Overlay.
Item: 502 N. Main — CUP Exceptions to Downtown Overlay
Exception Requests for South Facade Signage:
Signage for the south fagade is proposed to be a second raised channel letter /corporate logo sign
placed above the existing sign for Winnebago Bicycle facing Merritt Avenue. The proposed sign is
designed to be the same size and similar design as the existing sign at 33 square feet (allowed with
the extra allowance for the material of the sign), therefore doubling the amount of signage allowed
by the Downtown Overlay. In addition, placement of the sign is proposed to be located above the
bottom sill of the second story window which is prohibited in the Downtown Overlay.
Staff review of this request first looked at the additional area of the proposed sign which will exceed
the allowed 33.6 square feet. In looking at the south fagade, it can be argued that the exceptionally
large area (50 feet tall by 120 feet wide, 6,000 square feet) could be argued a justifiable hardship to
allow additional area. The existing Winnebago Bicycle sign and proposed Ski's Meat Market sign,
when combined, would total 66 square feet or 1.10% of the wall area, well below the 5% allowed
on smaller buildings, which in staff s opinion, does not seem overwhelming or out of scale with the
code's intent to minimize the proliferation of signage in the Downtown Overlay. Staff is in support
of this exception, however, recommends a condition that the size of the proposed sign matches the
existing Winnebago Bicycle sign, including the height of the channel letters which were approved at
13" tall.
Staff next reviewed the exception request to allow a second sign on the facade. Staff's opinion is
that the additional sign does not seem excessive, again due to the building's size, and the ability to
have multiple tenants. Also, keeping the additional sign the same size, style and look as the
Winnebago Bicycle sign will have them complement each other and lessen the overall impact on the
building.
Lastly, staff reviewed the placement of the additional sign which is proposed to be located above
the bottom sill of the second story window (immediately above the Winnebago Bicycle sign). In
looking at that section of the building, the applicant is limited with viable options for the sign
placement. The applicant does have the option to place the sign further east along the fagade, but
staff feels the sign would look out of place in relation to the existing sign. Also, the location of the
Bent Block building would effectively shield the sign's visibility from vehicular traffic heading
north along N. Main Street. Placement below the existing sign is not viable as it would interfere
with architectural elements and the store front of the building. Staff is in support of the proposed
location as it is the least intrusive location available and together with keeping with the similar look
and style of the existing sign, will maintain a consistent look for the signage.
Exception Requests for North Facade Signage:
Signage for the north fagade is proposed to be a 20 -foot by 20 -foot, 400 square foot mural -type
vinyl sign designed to imitate the look of hand painted signage on large brick fayades which were
common in the late 1800s and early 1900s. The applicant states in his narrative the sign will have a
distressed, aged look and will look like it has been there for many years. The applicant is
requesting exceptions from the Downtown Overlay Standards to allow for additional sign area in
excess of the permitted 32 square feet, placement of the sign which as proposed, exceed 18 feet
above ground level, and the use of vinyl for Signage which is prohibited in the Downtown Overlay.
The applicant is applying for an exception for the additional area of the proposed sign which
exceeds what is allowed by 368 square feet. The north facade has less overall area due to the
addition built in the early 2000s but still is approximately 5,040 square feet. The proposed sign at

400 square feet will consume 7.9% of the wall area. The wall itself is masonry, void of neither
architectural enhancements nor windows. In looking at the request, staff is in support of the
exception as the intent of the sign is to recreate the look of a grand- scale, hand painted sign which
were common in the downtown. Even today, there are still "ghost" images of signs on several
facades and staff feels the proposed sign will enhance the historic look of the building.
Staff reviewed the placement of the proposed sign which appears to begin 25 to 30 feet above
ground level, exceeding the maximum height of 18 feet permitted in the Downtown Overlay. Staff
supports the exception to allow the proposed placement based on that the signage the applicant is
trying to recreate often times took advantage of the height of buildings to maximize visibility. Also,
if the proposed sign were placed lower, an existing tree on the property would hamper its visibility
and function.
Lastly, staff reviewed the exception request to allow the use of vinyl signage on the building. The
20 foot by 20 foot sign is proposed to be printed on sheet vinyl then attached to the building. The
applicant stated in a conversation with city staff that hand painting the sign could be an option
instead of vinyl. Although neither types of signage are allowed in the Downtown Overlay, staff's
preference is the use of vinyl as it is much easier to remove and there is less chance of permanent
damage to the masonry versus painting and staff recommends approval of this exception. Prior to
building permit issuance, staff does want the applicant to provide a sample of the vinyl and
clarification on how the sign will be affixed to the building.
Staff presented the proposed signage to the Landmarks Commission at its August 13, 2014 meeting
for review and recommendations. The Commission was supportive of the proposed signage and
exception requests; however, there was concern with the owner's apparent lack of historic
sensitivity of the building in regard to recent interior and exterior renovations. The Commission did
make recommendations for the proposed signage including:
• Font type /color /style be the same or complementary to the Winnebago Bicycle sign
on the south facade of the building.
• Suggest the incorporation of more elegant or Victorian- styled corners on the border
of the proposed mural sign.
• More information needed on how the mural sign will be affixed to the building.
• Require that all proposed signage be installed and have the ability to be removed
without damage to the masonry or other part of the building.
Exception Request for Dumpster Enclosure Exterior Finish Materials:
On the date this report was being written, the applicant requested to add an exception from the
required exterior finish materials for a proposed 20 foot by 16 foot dumpster enclosure that is to be
located on the east side of an existing accessory structure (garage). The applicant is proposing to
use six foot tall horizontal wood planks for finish material where the Downtown Overlay requires
all exterior, exposed walls of a public facade of any accessory structure be constructed of similar
materials used on the principal structure in terms of color and texture. The proposed location of the
enclosure will be visible from both Merritt Avenue and Jefferson Street. The applicant also stated
that the change to masonry was not planned and cannot be absorbed by his construction budget.
Staff did not have adequate time to properly review this request due to the deadline to publish this
report. However, our initial opinion is that based on the visibility of the enclosure from both Merritt

Block East Parking Lot immediately across Merritt Avenue demonstrating the look intended by the
Downtown Overlay, recommends denial for this exception request.
RECOMMENDATIONICONDITIONS
Signage Exceptions:
Staff recommends a finding that the proposed conditional use permit request for exceptions to the
signage design standards of the Downtown Overlay District is consistent with Section 30 -1 l(D) of
the Zoning Ordinance and be approved with the following conditions:
1. Proposed signage on south facade shall be the same size with channel letters being the same
size and font and color scheme to be complimentary with the existing Winnebago Bicycle
sign.
2. Materials and installation method of the proposed north facade sign be reviewed and
approved by the Department of Community Development.
Dumpster Enclosure Finish Material Exception:
Staff recommends a finding that the proposed conditional use permit request for the exception to the
exterior finish material design standards of the Downtown Overlay District is not consistent with
Section 30 -11(D) of the Zoning Ordinance and recommends denial.
The Plan Commission approved of the conditional use permit for exceptions to the signage design
standards of the Downtown Overlay District with conditions noted and denied the conditional use
permit for exceptions to the exterior finish material design standards. The following is the Plan
Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area as well as the zoning
classifications and land use in said area. He discussed the history of the building and the current
tenant and new tenant that will be occupying a portion of the building in the next month. He
reviewed photos of the proposed signage for Ski's Meat Market who is the new tenant. In regard to
the south facade sign, he reviewed the current signage for Winnebago Bicycle who also occupies a
portion of the building and reviewed the exceptions to the Downtown Overlay that were being
requested. He discussed the size of the building which possesses an exceptional amount of area for
signage and the condition recommended for this request that would require the proposed signage to
have the same size with channel letters of the same size, font and color scheme to be complimentary
with the existing signage. He also discussed the location of the sign which is virtually the only
viable option to place it. He then discussed the proposed signage for the north facade and reviewed
a photo rendering of it and reviewed the exceptions to the Downtown Overlay that were being
requested. He explained that the owner was attempting to create a sign with a historical look to it
and the location is in character with signage from that era and the tree adjacent to the building
would block the view of the sign if placed lower on the structure. He further stated that the vinyl
material proposed to be used would have a condition recommended that the materials and
installation method be reviewed and approved by the Department of Community Development. He
also reviewed samples of historic old signage painted on structures in the downtown area. He
reviewed the site plan for the proposed dumpster enclosure and discussed the horizontal wood
planks that were proposed for its construction which according to the Downtown Overlay standards
should be constructed of masonry to match the existing structure. Staff is not in support of the

materials proposed but is open for suggestions from the Commission as this request was added at
the time staff reports were prepared and there was no time to investigate alternatives. He also
reviewed the conditions recommended for this request.
Mr. Gray commented about the concern with a previous submittal regarding vinyl window
replacements in the downtown district and questioned what the difference was between vinyl
windows and vinyl signage.
Mr. Nau explained that this proposal was for vinyl that would be a thin plastic sheet that will wrap
into the structure.
Mr. Gray then questioned what would happen if the Winnebago Bicycle sign is removed.
Mr. Nau responded that the conditional use permit goes with the building and signage could be
replaced with the name of the new tenant.
Mr. Cummings stated that the Landmarks Commission reviewed this proposal and suggested that
the large sign on the north facade have a more Victorian look and questioned if the Landmarks
Commission would get to have final approval on the signage before permit issuance.
Mr. Thoms commented that the old historic signs were traditionally painted on the structure.
Mr. Buck explained the features of old brick from buildings of that era and stated that staff has not
had adequate time to investigate the result of applying vinyl to brick however he was aware that the
application of latex paint is harmful to the brick as it does not allow it to breathe.
Mr. Nau added that the sign contractor would have more information on that aspect of the proposal.
Mr. Cummings voiced his concern regarding if the business should close their doors, how easy is it
to remove the proposed vinyl signage from the building.
Kris Larson, 502 North Main Street, discussed the methods of painting the sign on the building
instead of going with the vinyl signage proposed and the option to trim out the brick to allow it to
breathe. He distributed samples of the vinyl wrap and a photo example of it for the Commission to
review. He further discussed these issues and stated that after further review of the vinyl sign, he
discovered that it was only likely to have a life span of 18 months to 3 years and he had decided to
not go with this method as it was too cost prohibitive. He also discussed the dumpster enclosure
which is still being addressed as to build it out of masonry material is not affordable to his budget
and he questioned if the development was required to have one.
Mr. Fojtik suggested that the need for the dumpster enclosure should be discussed with staff.
Mr. Thoms questioned what the petitioner was looking to receive approval on at this point.
Mr. Larson indicated that he would like to proceed with the options for the sign on the south facade
of the building as he has to further investigate the possibilities for the signage on the north fagade.
Mr. Thoms clarified that the petitioner would like to table the request for the exception to the
Downtown Overlay for the sign on the north fagade and the Commission would be considering the
sign on the south facade and the materials for the construction of the dumpster enclosure.

Discussion ensued on the changes to the signage on the north fayade and it was determined that the
petitioner desired to removed this from the request.
Motion by Thoms to amend the request to remove condition #2 relating to the materials and
installation method of the proposed north fagade sign.
Seconded by Vajgrt.
Mr. Cummings commented that if the north side of the structure would have the sign painted on it
and the business were to close, what provisions does the City have to ensure that it is properly
removed.
Mr. Burich responded that it would be the usual process of a correction notice being issued followed
by citations if not addressed.
Mr. Buck added that staff has not had adequate time to review the option of painting the sign onto
the brick and the building currently has been well maintained over the years.
.Motion carried 7 -0.
Motion by Thoms to approve the conditional use permit for exceptions to the provisions of
the Downtown Overlay District at 502 N. Main Street with the following condition:
1. Proposed signage on south fagade shall be the same size with channel letters being the same
size and font and color scheme to be complimentary with the existing Winnebago Bicycle
sign.
Seconded by Vajgrt.
Ms. Propp commented that she thought the south fa�adc signage looked good and she would be
supportive of this exception to the Downtown Overlay District's standards but would not support
the exception for the materials for the dumpster enclosure.
Mr. Gray inquired if there was a public safety issue with signs on buildings as it is a distraction to
drivers.
Mr. Burich indicated that signs can be a distraction however he has not seen any convincing studies
on the subject and he would have concerns with the proposed signage if it was an electronic
message center.

Proposed signage variances for Ski's Meat Market at 502 N. Main St. Oshkosh WI.
Sign 1: Location along Merit St. (please see attached picture). We are looking to have
some exposure from Main St. facing North, and would like be in keeping with existing
signage on the building and in keeping with the historic nature of the building (hence no
lights, etc.). We understand that the proposed location of this sign is not in keeping with
current codes, but hope that the out of the ordinary layout of the exterior will allow it as it
is the least invasive location.
Sign 2: In keeping with the historic nature of this building and others in the downtown
area, we thought it would be fun to do a throwback homage in a way to the vintage
