HomeMy WebLinkAbout23. 14-395 AUGUST 26, 2014 14-395 RESOLUTION (CARRIED___7-0____LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVAL OF BLOCK PARTY REQUEST / SUSAN AMES / WALNUT STREET BETWEEN NEW YORK AVENUE & SHORT AVENUE / SEPTEMBER 20, 2014 INITIATED BY: CITY ADMINISTRATION NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that approval is granted to Susan Ames to close Walnut Street between New York Avenue and Short Avenue on Saturday, September 20, 2014, from 12:00 p.m. to 10:00 p.m.; for their neighborhood block party, in accordance with the municipal code and the attached application, with the following exceptions/conditions: A. B. C. BE IT FURTHER RESOLVED that as a condition of approval, the Event Organizer shall pay the City’s actual costs for extraordinary services. Cost Estimates for Extraordinary Services - none - AUGUST 26, 2014 14 -396 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: DISALLOWANCE OF CLAIM BY TINA PECK INITIATED BY: LEGAL DEPARTMENT WHEREAS, the following claim has been referred to the City's insurance carrier which has recommended disallowance. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to disallow the following claim against the City of Oshkosh: Tina Peck DATE OF LOSS: 4/1112014 (for alleged damages from driving over a piece of metal) BE IT FURTHER RESOLVED that the City Clerk is hereby directed to inform the claimant by certified mail of the disallowance and the fact that the claimant has six months from the date of service to appeal BE IT FURTHER RESOLVED that the City Clerk is directed to send a copy of this resolution and notice of disallowance to the appropriate insurance carrier for the City of Oshkosh. We are in receipt of the "Claim" documentation submitted by Ms. Peck in which she is asserting a claim for damage to her 2013 Ford Focus when she allegedly drove over a piece of metal on the Fox River Bridge on Oshkosh Avenue on 4111/14, Our investigation has revealed that the City of Oshkosh was not negligent or liable for this incident. We've confirmed with City Officials that there was no construction work performed on, or in the dates leading to, 04/11/2014. Additionally, the City had no prior complaints or notice of any such debris in the road on the bridge. Finally, we verified with the City that Winnebago County is responsible for the maintenance and upkeep of the Oshkosh Avenue Bridge which crosses over the l=ox River, Therefore, we are recommending that the City of Oshkosh disallow this claim pursuant to the Wisconsin Statute for disallowance of claim 893.80(1g), The disallowance of the claim in this manner will. allow us to shorten the statute of limitations period to six months. Please send the disallowance, on your letterhead, directly to the claimant at the above listed address. This should be sent certified or registered (restricted) mail and must be received by the claimant within 120 days after you received the claim.
