AUGUST 26, 2014 14-376 RESOLUTION (CARRIED___7-0____ LOST________ LAID OVER________ WITHDRAWN_______) PURPOSE: APPROVAL OF FINAL RESOLUTION FOR SPECIAL ASSESSMENTS FOR VARIOUS WATER MAIN EXTENSIONS / CONTRACT NO. 14-08 INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the Common Council of the City of Oshkosh held a public hearing on the 26th day of August, 2014, at 6:00 p.m. for the purpose of hearing all interested persons concerning the preliminary resolution and report of the City Manager (Board of Public Works) on the proposed improvements as listed below, pursuant to the initial resolution adopted August 13, 2014, by the Oshkosh Common Council of the following: Water Main Extensions: Lake Butte des Morts Drive, from Ryf Road to approx. 1,850’ southeast of Ryf Road Ryf Road, from Edgewood Road to Lake Butte des Morts Drive Edgewood Road, from Shore Preserve Drive to Ryf Road WIOWASH Trail, from River Mill Road to approx. 380’ northwest of River Mill Road NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh as follows: 1. That the report of the City Manager, acting as the Board of Public Works, pertaining to the construction of the above described public improvements, including plans and specifications therefor, is hereby adopted and approved with the following modifications: a. b. c. 2. That the action of the City Manager in advertising for bids and to carry out the work of such improvements in accordance with the reports of the City Manager and in accordance with the said resolution heretofore adopted, is hereby approved, ratified and confirmed. AUGUST 26, 2014 14 -376 RESOLUTION CONT'D 3. That payment for said improvements be made by assessing the cost to the property benefited as indicated in said report, except as modified herein. 4. Assessments shown on the report represent an exercise of the police power and have been determined on a reasonable basis and are hereby confirmed. 5. That the assessments for all projects included in said report are hereby combined as a single assessment but any interested property owners shall be entitled to object to each assessment separately or all assessments jointly for any purpose or purposes. 6. That the assessments may be paid in cash, or in installments pursuant to Section 25 -83 thru 25 -89 of the Oshkosh Municipal Code, said deferred payments to bear interest at the rate of six percent (6 %) per annum on the unpaid balance. The City Clerk shall publish an installment assessment notice in accordance with Section 66.0715(3)(e) of the Wisconsin Statutes in the official newspaper of the City. 7. The City Clerk is directed to publish this resolution in the OSHKOSH DAILY NORTHWESTERN, the official newspaper of the City. 8. The City Clerk is further directed to mail a copy of this resolution to every property owner whose name appears on the assessment roll whose post office address is known or can with reasonable diligence be ascertained. Staff will be available beginning at 5:00 p.m. in the rear of the Common Council Chamber (Room 401) to answer questions about the project and the estimated costs. Residents may also call the Department of Public Works Engineering Division at (920)236 -5065 to have questions answered. The proposed improvements include: water main and the levy of special assessments that partially cover the cost of the improvements. Assessments are not due until the project is certified as complete and then can be paid by any one of the plans as outlined by the City Clerk's information on payment plan options. Based upon the City of Oshkosh assessment policy, the assessable portions of the project have been identified and are outlined on the attached assessment worksh.eef(8). T he- final cost will not increase above the estimated total without another public hearing. Questions in regard to payment of Special Assessments can be answered by calling the City Clerk's office at 020)236 -5011. Questions in regard to the construction project in general can be answered by calling the Department of Public Works Engineering Division at (920)236 -5065. The sequence of construction has not yet been scheduled with a contractor. Residents will be notified approximately one week before construction will begin on a partiouiar strect. All work within this contract is scheduled to be completed by the end of November 2014. The project construction will consist of the following elements: relay or installation of specific segments of water main, If you know of any underground wires and/or piping, (examples: invisible electric fence, conduit for exterior lighting, irrigation system, etc.) on your property near the sidewalk and driveway, please contact the Engineering Division as soon as possible. Prior to the completion of the project, all disturbed areas will be topsoiled, seeded, and covered with eiosion mat (the property owner is responsible for watering the newly vegetated areas). Please set your lawn mower to the highest setting when mowing the new grass areas until the new grass areas are well established. During construction, access to commercial properties will be maintained. Access to residential properties will be restricted. There will only be a few instances when this will occur. Typically, short access restrictions occur during the underground utility installation. To minimize the inconvenience, the contractor will provide a one -week notice prior to the access being restricted for concrete work. Per the Police Department, a Construction Parking Permit is not required to park on a street overnight, if you park within two 2 blocks of the street under construction (see attached information). All "No Parking" areas and/or posted time zones must be obeyed. Vehicles parking overnight must be parked on the house address side of the street that corresponds to the current date. On odd calendar dates, the vehicles should be parked on the odd address side of the street. On even calendar dates, vehicles should be parked on the even address side of the street. Provisions will be made with the Fire Department and the Sanitation Division so fire protection and City garbage /recycling collection will continue at all times. Please ensure your garbage /recyclables are at the curbside by 7:00 a.m. on your regular collection day. Crews schedule collection of garbage /recyclables in construction areas at the start of each day. If rural -type mailboxes exist on your street, the contractor will remove them during construction. This removal will make it necessary for you to pick up your mail at the Post Office. The contractor will be responsible so as not to damage the mailboxes. Upon completion of the paving work, the contractor will reset the mailboxes. Brush and volunteer trees within the right-of-way may need to be removed at specific locations. Trees will be preserved as much as possible. Greuel Chief of Police As per Section 27 -27, 27 -23 and 27 -29 of the Municipal Code of the City of Oshkosh, there is no parking on the City streets, 2 a.m. to 5 a.m., unless the owner of vehicle was granted permission or has purchased a City parking permit. If your street or sidewalk is under construction, it is NOT necessary to obtain a parking permit if you park your car within two blocks of the street under construction. All City ordinances and parking rulesiguidelines must be followed. All posted parking restrictions, including time zones and no parking areas, must be obeyed. You will need to follow the odd -even rules. On odd days of the week, the vehicle should be parked on the side of the street with odd - numbered houses. On even days of the week, the permit holder should park on the side of the street with even - numbered houses. Each night, the car should be parked on the opposite side of the street as the night before. NOTE: Odd and Even dates are figured before midnight. If parking is only allowed on one side of the street, the odd -even rules DO apply. Vehicles can only park on the side of the street that does not have restricted parking and are only allowed to park overnight on the appropriate odd -even days. In the case of a declared Snow Emergency, ALL vehicles must be removed from the street or the vehicle will be towed at owner's expense. It is the responsibility of the vehicle owner /operator to find alternate parking in the event of a snow emergency. Disabled vehicles are not allowed to park overnight at anytime and should be moved within 24 hours. Motor busses; truck tractors; semi - trailers; and motor trucks designed, used, or maintained primarily for the transportation of property as defined in City Code 27 -26(3) are not permitted to park overnight on City streets. All street parking is subject to the following guidelines: • May not park in signed / designated "No Parking" areas. • Vehicles may not stop or park in a designated "Fire Lane ". • No parking within 10 feet of a fire hydrant (an official traffic sign may indicated that a greater distance is required). • No parking in loading zones. • No parking within 4 feet of an alley or private roadway or driveway. • No parking within 15 feet to the near limits of a crosswalk. Failure to follow the above rules could result in parking citations being issued. Individuals wishing to "appeal" a parking citation may do so by completing a Request to Review Parking Citation form which is available at the Oshkosh Police Department Telecommunications Desk, on the Police Department website (www.oshkoshpd.com), or on the City of Oshkosh website. The Common Council hereby declares its intention to exercise its police power under Section 66.0703 and 66.0705 of the Wisconsin Statutes to levy special assessments upon property within the following described areas for benefits conferred upon such property by improving the following: Water Main Extensions: Lake Butte des Morts Drive, from Ryf Road to approx. 1,850' southeast of Ryf Road Ryf Road, from Edgewood Road to Lake Butte des Morts Drive Edgewood Road, from Shore Preserve Drive to Ryf Road WIOWASH Trail, from River Mill Road to approx. 380' northwest of River Mill Road 2.
