HomeMy WebLinkAbout22. 14-373AUGUST 13, 2014 14 -373 ORDINANCE FIRST READING (CARRIED INITIATED BY LOST LAID OVER WITHDRAWN ) REPEAL AND RECREATE A PORTION OF THE STORM WATER MANAGEMENT ORDINANCE/ SECTION 14 -1 DEFINITIONS ► •:► A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING AND RECREATING A PORTION OF THE STORM WATER MANAGEMENT ORDINANCE 1 SECTION 14 -1 DEFINITIONS. The Common Council of the City of Oshkosh does ordain as follows: SECTION 1. That Section 14 -1 (C) (77) of the Oshkosh Municipal Code pertaining to Storm Water Management definitions is hereby repealed and recreated to read as follows: (77) "Routine maintenance" means that portion of a post - construction site where pre - development impervious surfaces are being maintained to preserve the original line and grade, hydraulic capacity, drainage pattern, configuration, or purpose of the facility. Remodeling of buildings and resurfacing of parking lots, streets, driveways, and sidewalks are examples of routine maintenance, provided the impervious surface's granular base is not exposed. The disturbance shall be classified as redevelopment if the granular base associated with the pre- development impervious surface is exposed or if the soil located beneath the impervious surface is exposed. For purposes of this chapter, a post - construction site is classified as new development, redevelopment, routine maintenance, or some combination of these three classifications as appropriate SECTION 2. This ordinance shall be in full force and effect from and after its passage and publication. SECTION 3. Publication Notice. Please take notice that the City of Oshkosh enacted ordinance #14 -XXX (A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING AND RECREATING A PORTION OF THE STORM WATER MANAGEMENT ORDINANCE 1 SECTION 14 -1 DEFINITIONS on August 13, 2014. The ordinance becomes effective on August 26, 2014. The ordinance amends the definition of routine maintenance in relation to redevelopment. Rabe, Civil Engineering Supervisor DATE: August 7, 2014 RE: Repeal and Recreate a Portion of the Storm Water Management Ordinance 1 Section 14 -1 Definitions BACKGROUND On June 26, 2012, the Common Council approved Amending and Creating Municipal Ordinances Related to Storm Water Management (Resolution 12 -345). This resolution created Chapter 14 — Storm Water Management of the Municipal Code. This update to the Municipal Code brought the City into compliance with state and federal requirements for local codes. ANALYSIS It has come to staff attention that Definition (77) "Routine Maintenance" in Section 14 -1 was not clear. The proposed language change clarifies that a project is not considered routine maintenance if the granular base is exposed. Previously, this was not clear, and caused some confusion with developers and design engineers. FISCAL IMPACT There is no direct fiscal impact to approving this language update. RECOMMENDATIONS I recommend the approval of this Municipal Code revision to provide increased clarity to developers and designers working within the City of Oshkosh. Approved: Mark A.
