proper City officials are hereby authorized and directed to accept two sidewalk

purposes of same.

Approve Accepting Easement at 2401250 and 257 West 9th Avenue (Plan
Commission Recommends Approval)
BACKGROUND
The Department of Public Works is requesting acceptance of two sidewalk easements
located on property at 2401250 W. 91h Avenue and 257 W. 9th Avenue. The existing
pedestrian crossings are proposed to be upgraded at the northeast and southeast corners of
W. 9th Avenue and Minnesota Street to provide a safe and handicap accessible corner ramp.
ANALYSIS
The proposed two sidewalk easements would run east 12.5 feet along W. 9t" Avenue and
north /south 9.5 feet on Minnesota Street in a triangular area at the corner of each property.
The site upgrades will include removing and replacing concrete sidewalk in the corner ramp
area and repairing the pavement in the crosswalk. Flashing warning lights and speed -
displaying signs will be installed as well in conjunction with the Safe Routes to School
Program. The Department of Public Works will work with the property owners to have
appropriate easement documents signed and recorded at the Winnebago County Register of
Deeds.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its August 5, 2014 meeting.

GENERAL INFORMATION
Petitioner: City of Oshkosh Department of Public Works

Actions Requested:
The Department of Public Works is requesting acceptance of two sidewalk easements located on
property at 2401250 W. 9th Avenue and 257 W. 9th Avenue.
Analysis:
The Department of Public Works is proposing to upgrade the existing pedestrian crossings
located at the northeast and southeast corners of W. 9th Avenue and Minnesota Street. In order to
provide a safe and handicap accessible corner ramp, Public Works is seeking acceptance of two
sidewalk easements located on property at 240/250 W. 9th Avenue and 257 W. 9th Avenue. The
easements would run east 12.5 feet along W. 9t11 Avenue and north/south 9.5 feet on Minnesota
Street.
The proposed easement areas would be used to install concrete sidewalk with a curb in a
triangular area at the corner of each property. Site upgrades will also include removing and
replacing concrete sidewalk in the corner ramp area and repairing concrete pavement in the
crosswalk. In addition, flashing warning lights and speed- displaying signs will be installed. The
proposed upgrades are in conjunction with the Safe Routes to School Program and will be
funded through a combination of Federal Grant and City of Oshkosh funds.
The Department of Public Works will work with the property owners to have appropriate
easement documents signed and recorded at the Winnebago County Register of Deeds.
RECOMMENDATIONS /CONDITIONS
Staff recommends approval of the acceptance of the proposed sidewalk easements as requested.
The Plan Commission approved of the acceptance of the sidewalk easement as requested. The
following is the Plan Commission's discussion on this item.
Mr. Nau presented the item and reviewed the sites and surrounding area and described the
purpose for this request which is in conjunction with the Safe Routes to School Program. He
further stated that the Department of Public Works will work with the property owners to have
appropriate easement documents signed and recorded at the Winnebago County Register of
Deeds.
Mr. Gray inquired if the City obtained approval from the property owners for the easement
location.
Steve Gohde, Assistant Director of Public Works, responded that they have contacted the
property owners in advance of this action moving forward and both parties were agreeable to it.
Mr. Gray then questioned what would happen if the property owner would refuse.
Mr. Gohde replied that the City would not be going forward with the easement request if the
property owner was not agreeable to it.
Mr. Gray also inquired how the vision triangle would apply to the placement of the speed -
displaying signs.
Mr. Gohde indicated that the proposed signs were not wide enough to cause any vision issues.
Mr. Hinz arrived at 4:10 pm.
Motion by Vajgrt to approve the acceptance of easements at 2401250 & 257 W. 9fh
Avenue.
Seconded by Cummings. Motion carried 8 -0 -1. (Hinz abstained as he was not present
for the discussion on this item)

I have attached a letter that was sent to the property owner at 257 W 9t' Ave. explaining the need for this corner
easement. This should give you enough information to prepare a short narrative for the easement request at 257 W Stn
Ave and at 240 W 9t' Ave. The easement request for 731 W South Park Ave is to install a concrete base behind the
existing sidewalk for a flashing school crossing and speed displaying sign. I have also attached three letters that were
sent to each property owner with the easement document. If you have any questions, please give me a call. Thank you.
Please note that all three of these easements are for the Safe Routes to School Program.

Dear Ms. Mantei:
The City of Oshkosh is proposing to upgrade the existing pedestrian crossings at W. 9'h Avenue and Minnesota
Street. This work, Safe Routes to School Program, is being funded by a Federal Grant and City of Oshkosh funds.
The work will consist of removing and replacing concrete sidewalk in the corner ramp areas and repairing
concrete pavement in the crosswalk. In addition, flashing warning lights and speed - displaying signs will be
installed.
In order to provide a safe and handicap accessible corner ramp, the City is seeking to acquire an easement from
you to install concrete sidewalk with a curb in a triangular area at the corner of your properly. I have enclosed a
plan showing the limits of the triangular area on your property. There would be no cost to you for this work. We
would like you to grant this easement to the City for no cost. All disturbed grass areas from construction activity
will be graded and restored with top soil, fertilizer, seed and erosion mat.
Please contact me at (920) 236 -5065 to discuss the easement. If you are agreeable to granting the easement, the
City will draft the required documents and send them to you for signature.
We would like to complete this work during July or August of this year. Your assistance in helping us complete
this project would be appreciated.

property. As per our telephone conversations, this easement is granted by you to the City of Oshkosh to install

been signed and notarized, please return it to the Department of Public Works, Room 301 City Hall.
