HomeMy WebLinkAbout05. 14-356 AUGUST 13, 2014 14-356 RESOLUTION (CARRIED__6-0_____LOST_______LAID OVER_______WITHDRAWN_______) PURPOSE: APPROVE ACCEPTING STORM SEWER EASEMENT; APPROVE AGREEMENT/EASEMENT WITH UW-OSHKOSH FOR CROSS ACCESS INITIATED BY: CITY ADMINISTRATION PLAN COMMISSION RECOMMENDATION: Approved WHEREAS, the Common Council previously approved the exchange of lands rd between the City and UW-Oshkosh on West 3 Avenue in conjunction with the construction of a new Central City Garage on Witzel Avenue, with one of the conditions being the City install pavement and fencing on the City’s lot on the south side of West rd 3 Avenue, prior to the transfer to UW-Oshkosh; and WHEREAS, in order for said improvements to be installed, it was determined that a storm sewer along the eastern lot line and inlet at the rear of the property, per the attached “Exhibit A”, would improve stormwater runoff on said property and also collect runoff from adjacent properties; and WHEREAS, in order for the City to access and maintain the storm sewer and inlet a gate will be installed at the south east corner of the property to allow cross access for both the City and UW-Oshkosh, per the attached “Exhibit B”. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to accept a rd storm sewer easement on the south side of West 3 Avenue, along the eastern rd property line of the property generally located between 625 and 663 West 3 Avenue, per the attached “Exhibit A”, and the proper City officials are authorized and directed to execute any and all documents necessary for purposes of same. It is a city -owned lot that has recently been improved with asphalt paving and landscaping and is also scheduled to have fencing installed. The surrounding area includes light industrial/institutional uses to the north, commercial and residential to the east, residential to the south and light industrial/institutional (UWO) to the west. ANALYSIS In March of 2014 the City and University of Wisconsin -- Oshkosh came to an arrangement to exchange two areas of land along West 3rd Avenue with the University receiving the subject property. As part of the agreement, the City is improving the site with pavement, landscaping, and fencing which require management of storm water runoff. Construction of a storm sewer and inlet at the rear and east side of the property will allow collection of associated runoff from this site as well as from the adjacent lots. The easement is proposed to be 20 foot by 150 foot extending the full length of the east property line and is necessary to provide the City the ability to maintain the storm sewer and inlet after the transfer of ownership is complete. The Department of Public Works and City Attorney is drafting appropriate easement documents which will be signed and recorded at the Winnebago County Register of Deeds. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its August 5, 2014 meeting. Approved, ZP City Manager ITEM: GRANT AND ACCEPT STORM SEWER EASEMENT FOR PROPERTY LOCATED EAST OF 663 WEST 3x" AVENUE Plan Commission meeting of August 5, 2014 GENERAL INFORMATION Petitioner /Owner: City of Oshkosh Action Requested: The City of Oshkosh requests the granting and acceptance of a storm sewer easement to allow future maintenance of a storm sewer and inlet at property located east of 663 West 3rd Avenue. Applicable Ordinance Provisions: N/A Property Location and Type: The subject property is a 0.46 acre parcel located on the south side of West 3rd Avenue, east of and adjacent to 663 West 3rd Avenue. It is a city -owned lot that has recently been improved with asphalt paving and landscaping and is also scheduled to have fencing installed. These improvements are currently underway and require management of stormwater runoff. Construction of a storm sewer and inlet at the rear and east side of the property allows collection of associated runoff from the site and will also collect runoff from the adjacent lots. Prior to the transfer of the land to the University, an easement is needed to provide the City the ability to maintain the storm sewer and inlet for the system on land that the City will no longer own after the transfer of ownership. The needed easement is proposed to be 20 foot by 150 foot running along the fall length of the east property line and is sufficient to allow maintenance equipment suitable area for work. Also, due to the inclusion of fencing, the easement will include cross - access over the lot to gates that will be in the fencing, allowing access to the system without the need to remove fencing. The Department of Public Works and City Attorney is drafting appropriate easement documents which will be signed and recorded at the Winnebago County Register of Deeds. RECOMMENDATION /CONDITIONS Staff recommends approval of the granting and accepting of the proposed easement as requested. The Plan Commission approved of the granting and accepting of the proposed easement. The following is the Plan Commission's discussion on this item. Mr. Buck presented the item and reviewed the site and surrounding area and discussed the land exchange that was approved recently between the City and University of Wisconsin - Oshkosh. He also discussed the improvements to the site that the City was required to install prior to the land disposition to the University which initiated the need for the storm sewer connection to handle the collection of associated runoff from the site. He also discussed the cross - access over the lot which was required due to the installation of fencing on the property. As with the last two items, the Department of Public Works and City Attorney will draft appropriate easement documents to be signed and recorded at the Winnebago County Register of Deeds. There was no discussion on this item. Motion by Fajgrt to grant and accept a storm server easement for property located east of 663 W. 3rd Avenue. Seconded by Lohry. Motion carried 9 -0. Item —Grant & .4ccept Fasement/Cast of 663 W 3'd Av 3rd Ave Easement As part of the redevelopment of the Central Garage Site, the City and University of Wisconsin - Oshkosh came to an agreement to exchange two areas of land. The City will be receiving land on the north side of W. 3rd Ave, adjacent to the Central Garage property, and the University will be receiving land on the south side of W. 3rd Ave, adjacent to other property they own. Part of the agreement included the City improving the south side lot with pavement and fencing. These improvements required management of the stormwater runoff. Upon review, it was determined that installation of storm sewer and an inlet at the rear of the property would allow for collection of the runoff from the site and also collect runoff from the adjacent lots. The rear area of the lot was near the low point for the entire block. Prior to installation of the storm sewer and inlet, the low area held water until it would evaporate or infiltrate into the ground. An easement is necessary to allow the City to be able to maintain the storm sewer and inlet for a system collecting runoff from multiple properties on land that the City will not own.
