AN ORDINANCE TO AMEND THE COMPREHENSIVE PLAN OF THE CITY OF
OSHKOSH, WISCONSIN
The Common Council of the City of Oshkosh, Wisconsin, do ordain as follows:
SECTION 1. Daniel Dringoli, Go Green Properties, Petitioner, request a map
amendment to the City of Oshkosh 10 Year and 20 Year Comprehensive Plan Land
Use maps from a residential and industrial land use designation to a commercial land
use designation for properties located between U.S. Highway 45 and County Road S,
south of County Road Y, in the Town of Oshkosh, Winnebago County, Wisconsin.
SECTION 2. The Plan Commission recommended approval of said amendment.
SECTION 3. The City has held a public hearing on this Ordinance, in compliance
with the requirements of Section 66.1001(4)(d), Wisconsin Statutes.
SECTION 4. The Common Council of the City of Oshkosh hereby approves
amending the Comprehensive Plan Land Use Maps changing the land use designation
on the property between U.S. Highway 45 and County Road S, south of County Road Y
from residential and industrial to commercial.
SECTION 5. This Ordinance shall take effect upon passage by a majority vote of
the members elect of the Common Council and publication as required by law.
SECTION 6. Publication Notice. Please take notice that the City of Oshkosh

Dear Mayor Tower and City Manager Rohloff,
I currently have a request before the City of Oshkosh Plan
Commission for a change to the Comprehensive Land Use Plan Map which will be
preliminarily decided on the July 1, 2014 at the Plan Commission public hearing.

is my understanding that assuming (wishful thinking) the Commission supports the
Plan Commission Staff's recommendation, that the matter would go before first
Council meeting July 8th, 2014 and the 2nd meeting July 22nd 2014. This has
been a long process for individuals involved. We really appreciate the efforts
of the Planning Staff at City Hail and the cooperation of the Town of Oshkosh
Board. Unfortunately there was an error in public notification in April by the
Town which put a 6 week delay on this project. There also needs to be approval
by the County before the Town zoning change can officially take place. After
that I can close on the lot.
I was advised by City Staff that upon request for special
circumstances there is a possibility that the 2 meeting rule could be combined
into a single approval meeting by the Council. This would be extremely helpful
to me as I need to close on the lot as soon as possible so I can get the building
process going. I anticipate the time line to erect the structure to take 4
months to complete with State approvals and engineering concerns that need to
occur along with ordering of materials. I respectively request this matter be
heard in one meeting for the following reasons:
We had unforeseen delays because of the Town missing the required
newspaper notice in their process.
We originally were told in February that we would not need to change
the City's Comprehensive Land Use Plan Map which later turned out to be not
correct, otherwise we would have started the process with the City in February.
My current business is out grown our current space. We are bursting at
the seams as we do flood, mold and fire damage work. With the never ending
winter, lack of spring and wet summer, we are (no pun intended) "swamped" with
work
Until the approval is done at the City and County level it would not
make sense to invest more money into environmental plans and research on that
parcel. I received a quote today for $8,000 to do the evaluation and permitting
process which will take some time.
This has gone through the Town of Oshkosh process twice, with 2 public
hearings, notifications by mail and the 2nd time newspaper postings. To date no
one has publicly or privately opposed the change to myself or the Town Board
indicating the change would be a bad idea. We have full support of the Town
Board and Chairman. Jim Erdman indicated he would come to the Plan Commission
and Council Meetings to show his support for the change
In closing, I realize the request for the deviation from the normal process is no
fault of the City or anyone else's. since we started this process and I cannot
think of anything we could have done different to speed up the process. It would
just really, really help me and my business out by getting the ball going sooner
than later.

Waive Second Reading) (Plan Commission Recommends Approval)
BACKGROUND
The petitioner is requesting a comprehensive land use map amendment of a 2.849 acre
parcel located between U.S. Highway 45 and County Road S, south of County Road Y. The
petitioner is interested in purchasing the property to develop a 9,000 square foot commercial
structure to be occupied by PuroClean Disaster Recovery and possibly, a microbrewery.
The property currently has a Town of Oshkosh zoning designation of A -2, General Farming
District and on May 22, 2014 the Town of Oshkosh Planning and Zoning Commission
approved a zone change from the A -2 District to B -3, General Business District to allow the
proposed development, which is consistent with the Town of Oshkosh's Comprehensive Land
Use Plan recommendation. However, the Winnebago County Planning and Zoning
Department will not approve the zone change due to the conflict with the City of Oshkosh's
residential land use recommendation. The petitioner is requesting a waiving of the second
reading for this action in order to move the development process forward to the County to
approve the zone change and ultimately develop the property this fall.
ANALYSIS
In March of 2005 the City adopted the 2005 -2025 Comprehensive Plan which entailed
recommended land use maps intended as a general reference tool for determining
appropriate future land use patterns on a broader scale. This plan requires to be updated
periodically to accommodate logical requests /changes in future land use and the subject site
was designated as residential due to the existing and potential residential uses and the
potential for a future school location which was never developed. During staff review of the
single lot designation change, it was determined that it would be logical to expand the review
area and amend the entire area bounded by Highway 45, County Road Y, Ryf Road and the
WIOUWASH Recreational Trail to be consistent with the Town of Oshkosh Comprehensive
Plan's commercial land use recommendation. County Road S serves as a frontage -style
road for Highway 45 and is appropriate for commercial development as the lot sizes and
availability is suitable and the demand for residentially designated land in this area has
lessened. Staff feels the highest and best future use of this area is for commercial
development and that the map change request is warranted.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its July 1, 2014 meeting.

ANALYSIS
In March of 2005, the City adopted the 2005 -2025 Comprehensive Plan, an update to the previous
plan from 1993. Part of the update entailed refining the 20 -Year Recommended Land Use Map and
the creation of a 10 -Year Land Use Map. The Land Use section of the plan states that, the maps are
used to give the community a better idea of how land in the city will be used in the future. The future
land use maps were created using a variety of resources. These resources include the existing land
use map and special area plans, aerial photography, land use maps of adjoining communities, soils
and environmentally sensitive areas map (which help to understand development limitations), utility
and facility service area maps, and existing and future transportation corridors. The maps show the
general location and type of land uses within the city and on the city's periphery. The maps are to
be used as a basis for making general land use decisions relative to the City's land use control
regulations. Land use designations will be evaluated in terms of their consistency with these maps
and other applicable elements of this Plan and all other applicable Ordinances.
Again, these maps are intended to be used as a general reference tool for determining appropriate
future land use and growth patterns. When creating the maps, recommended uses were determined
on a broader scale rather than a parcel by parcel basis. The County correctly determined that the
rezoning conflicted with the City's future recommended land use designation and denied the
rezoning request.
Staff realizes that sections of the Comprehensive Plan, including mapping portions, need to be
updated or revised periodically to accommodate logical requests /changes in future land use. In this
case, the mapping was completed prior to the U.S. Highway 45 expansion and change in plans of
the Oshkosh Area School District developing their site on Ryf Road. .In looking at the current land
use map, it is understandable why a residential designation was placed on the subject site, with it
containing several existing residential uses, potential residential development to the west and the
potential school location.
During staff review of the single lot designation change, it was determined that it would be logical
to expand the review area and amend the entire area bounded by Highway 45, County Road Y, Ryf
Road and the WIOUWASH State Recreational Trail, to be consistent with the Town of Oshkosh
Comprehensive Plan's commercial land use recommendation. The area contains 20 parcels totaling
approximately 34.1 b acres (including right -of- -way) and consists of 1 I single - family parcels, a stand-
alone accessory structure, mini warehousing, contractor yard and several vacant /undeveloped
parcels and parcel remnants owned by the Wisconsin Department of Transportation. The expanded
amendment area also includes a small portion of industrial designated land which was mapped to
accommodate the quarry operation east of Highway 45 (prior to Highway 45's construction). The
use status of the existing homes would be unchanged as their use allowance is regulated by the base
zoning the property is located in and no zone district changes (other than the petitioner's) is being
proposed.
Upon review of the request, staff supports changing the projected land use from residential and
industrial to commercial. County Road S generally serves as a frontage -style road for Highway 45
and is an appropriate location for commercial development as it is a frontage road similar to Koeller
and Washburn Streets. The lot sizes and potential availability of land along County Road S is

suitable to allow for future commercial development when the market dictates. In addition, with the
Oshkosh Area School District abandoning its plans to build a school on Ryf Road, the demand for
residentially designated land in this area has lessened. Staff feels the highest and best future use of
this area is for commercial development and therefore believes this map change request is
warranted.
RECOMMENDATION
Staff recommends approval of the Comprehensive Land Use Map amendment from residential and
industrial to commercial for property bounded by U.S. Highway 45, County Road Y, Ryf Road and
USH 45.
At its July 1, 2014 meeting, the Plan Commission approved of changing the land use map
designation for this entire area from residential and industrial to commercial as recommended by
staff. The following is the Plan Commission's discussion on this item.
Mr. Nau stated the applicant desires to purchase the 2.8 acre parcel at the corner of CTH S, CTH Y
and STH 45 to construct a commercial building for his business (PuroClean Disaster Recovery) and
possibly a microbrewery. The property is located within the Town of Oshkosh. The City's 2005
Comprehensive Plan designates the land uses for this area as residential. Based on existing
residential uses in the area and a future Oshkosh school, a residential land use appeared reasonable
at that time. Since USH 45 was reconstructed and relocated within the last few years, commercial
businesses, mini warehousing and other non - residential uses have been built in this area. Based on
these factors, staff reviewed the entire area from Ryf Rd on the south, CTH Y on the north, CTH S
on the west and STH 45 on the east to determine if the City's land use designation for this area
should be changed to correspond with the Town's commercial land use designation. The area
contains 11 single family parcels, a stand alone accessory structure, mini warehousing, contractor
yard and several vacant /undeveloped parcels and remnant parcels owned by Wisconsin DOT. This
entire area has a land use designation of residential with one small section having an industrial
designation. Based on the roadway system as developed, existing uses, and anticipated uses on
nearby properties, staff is recommending the land use designation of this entire area be changed to
commercial. Mr. Nau noted the commercial land use designation would not impact the existing
residential uses due to the Town's base zoning on the properties and any zoning district changes will
require Town of Oshkosh approval.
Mr. Brian Bradley, 4330 County Road S, stated several of the property owners in this area would
like to see their home values remain the same. Businesses in this area would impact the residences.
He did not support this request.
Mr. Dave Jacobson, 4300 County Road S, did not believe this request would impact his home. It is
evident things will change in the future; probably to commercial uses.
Mr. Tom Haber, 4325 County Road S, stated there have been problems with wells in this area for
some time. A microbrewery could increase water problems for the residents. He stated he did not
support this use.
Mr. Dan Dringoli, 477 Dutton Road, stated the 2.8 acre site has gone down in price since it has been

on the market. If this lot has any substantial value as residential due to its location, he could not see
it. Unless the Town is looking to create a park on the parcel, he did not believe residential was an
option for this parcel. He noted that his business is no different than the other small commercial
businesses in the area. The adjacent WIOUWASH Trail is an attribute to the site for a
microbrewery. He was not certain, however, if the microbrewery would be built if there are water
problems. He would have to investigate that issue further.
Mr. Jim Erdmann, Town of Oshkosh Chairman, stated the City supported the Town's commercial
land use designation in 2002. The City approved its residential and industrial land use designations
for this area in 2005 probably because of the proposed school development that did not happen. The
Town supports the map amendment to change the land use from residential and industrial to
commercial as it would then comply with their Comprehensive Plan's Land -Use designation.
Ms. Propp stated a workshop had previously been held with the Plan Commission on this item.
Motion by Propp to amend the land use designation from residential and industrial to
commercial for the area bounded by Ryf Rd., CTH S, CTH Y and USH 45. Seconded by
Thoms. Motion carried 8 -0.

Written Explanation:
We are planning to build a 9000 square ft. steel structure with masonry fagade on County Rd S. The
building height would have 16' walls, single story along with a 4112 roof pitch. The property is located at
the southeast corner of the intersection of CTY 5 & CTY Y in the Town of Oshkosh. The building will
house PuroClean Disaster Recovery which is a water /fire /mold property restoration company.
PuroClean will have office and shop space in the structure totaling approximately 6,500 sq ft. Also with
in the building is plans for 1250 sq ft microbrewery and 1250 sq ft tap room to serve micro brewed beer.
Currently the vacant 2.8 acre parcel is zoned agricultural and is farmed. There are no structures on the
property at this time. There will be no proposed living areas on the lot as well. The Town of Oshkosh
has approved the change from Agricultural to Commercial. It is our understanding the City of Oshkosh
has on the "Future use plan" the lot is designated as residential. This designation may have been done
prior to the new HWY 45. Based on the fact the lot abuts US HWY 45, and the frontage road has
numerous business along the Cty 5 frontage road, we believe the better use for zoning would be
commercial.
PuroClean has 8 employees and rarely has more than deliveries to the business. The anticipated
Brewery traffic will be minimal as well. The tap room is estimated to have 30 -40 visitors a day for the
consumption of beer and the purchasing of take home Y2. gallon "Growlers" of beer., The Wiouwash trail
is expected to bring bicycle traffic in the summer. This would be a great draw for residents of Oshkosh
to use the biking trail from the City and head north. The southernmost business with bathroom and
accommodations would be Two Brothers restaurant at the corner or 21& 43. The next stop north along
the trail with any services would be approximately 15 miles north in the Town of Clayton. Our tap room
would provide bottled soda, tap root beer, regular micro beer and bottled water to patrons using the
trail as well as provide running water and fully functional bathrooms. This could be a great stop for
patrons of the trail to take a nice bike ride orjog and have a place to stop and refresh.
