HomeMy WebLinkAbout10. 14-328 JULY 22, 2014 14-328 RESOLUTION (CARRIED___7-0____LOST________LAID OVER_______WITHDRAWN_______) PURPOSE: GRANT UTILITY EASEMENT TO WISCONSIN PUBLIC SERVICE CORPORATION/ RIVERSIDE PARK; NORTH MAIN STREET TO CEAPE AVENUE INITIATED BY: WISCONSIN PUBLIC SERVICE CORPORATION PLAN COMMISSION RECOMMENDATION: Approved BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to grant a utility easement to Wisconsin Public Service Corporation in Riverside Park from North Main Street to Ceape Avenue, per the attached, and the proper City officials are authorized and directed to execute any and all documents necessary for purposes of same. The properties, totaling 4.7 acres, are bounded by Main Street to the west, the Convention Center and Ceape Avenue to the north, Leach Amphitheatre and an attorney's office to the east and the Fox River to the south. Wisconsin Public Service is requesting a private utility easement at this location. ANALYSIS Wisconsin Public Service is planning on moving electrical utility lines in conjunction with the Riverside Park parking lot redevelopment project which will require the proposed 12 foot utility easement commencing at an existing electrical utility pad adjacent to the Main Street Bridge and the west property line of Riverside Park. The easement would continue running north and east to its conclusion at Ceape Avenue. The Department of Public Works, Community Development Department and City Attorney will work with Wisconsin Public Service to have the appropriate easement documentation signed and recorded at the Winnebago County Register of Deeds. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its July 15, 2014 meeting. Approved, City Manager ITEM: GRANT PRIVATE UTILITY EASEMENT AT 201 CEAPE AVENUE (RIVERSIDE PARK Plan Commission meeting of July 15, 2014 GENERAL INFORMATION Petitioner: Wisconsin Public Service Corporation Owner: City of Oshkosh Actions Requested: Wisconsin Public Service is requesting a private utility easement located at Riverside Park and adjacent parking lot (101 Ceape Avenue and 201 Ceape Avenue). Analysis: The subject properties are the location of Riverside Park and an adjacent parking lot. The properties, totaling 4.7 acres, are bounded by Main Street to the west, the Convention Center and Ceape Avenue to the North, Leach Amphitheatre and an attorney's office to the east and the Fox River to the South. WPS is planning on moving electrical utility lines in conjunction with the Riverside Park parking lot redevelopment project. The proposed 12 foot private utility easement commences at an existing electrical utility pad located directly adjacent to the Main Street Bridge and the west property line of Riverside Park. Running north from the existing electrical pad for approximately 75 feet, the easement will continue east for approximately 262 feet, then north approximately 29 feet, then east approximately 208 feet then north approximately 254 feet to its conclusion at Ceape Avenue. The Department of Public Works, Community Development Department and City Attorney will work with Wisconsin Public Service Corporation to have appropriate easement documentation signed and recorded at the Winnebago County Register of Deeds. RECOMMENDATIONS /CONDITIONS Staff recommends approval of the granting of the proposed private utility easement as requested. The Plan Commission approved of granting the proposed easement as requested. The following is the Plan Commission's discussion on this item. Mr. Krumenauer presented the item and reviewed the site plan and surrounding area. He explained that the easement was to accommodate electrical utilities and staff had reviewed the request and had no concerns with this issue. Mr. Thoms questioned why there were no stipulations on this request such as its removal if no longer required. Steve Gohde, Assistant Director of Public Works, responded that these stipulations are included in the easement document that is signed and recorded and that those conditions are not part of the approval process at the Plan Commission. Motion by Nollenberger to approve the granting of a private utility easement at 201 Ceape Avenue (Riverside Park). Seconded by Propp. Motion carried 8 -0. Here is a brief narrative (below). Please let me know what else you may need. During the ongoing reconstruction of the City's Riverside parking lot, WPS determined that rerouting some of its underground facilities may be advantageous to both WPS and the City. The easement terms will be relatively consistent with the standard easements the City has drafted for previous WPS easements.
