PURPOSE: APPROVE AGREEMENT FOR TIPPING FEES FOR RIVERSIDE
PARKING LOT PHASE 1 PROJECT (not to exceed $50,000)
INITIATED BY: PURCHASING DIVISION
WHEREAS, the City is reconstructing Riverside Parking Lot; and
WHEREAS, during reconstruction the City will be required to dispose of sub-grade
material at a properly licensed disposal site; and
WHEREAS, Waste Management Inc.’s disposal facility located in Berlin, Wisconsin
is the closest licensed disposal facility able to accept the material.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed pursuant to
Section 12-11 to enter into an appropriate agreement for the payment of tipping fees for
disposal of subgrade materials from the Riverside Parking Lot Phase 1 Project with:
Waste Management, Inc.

Total: not to exceed $50,000.00
BE IT FURTHER RESOLVED that the proper City officials are hereby authorized
and directed to enter into an appropriate agreement for the purpose of same. Money for
this purpose is hereby appropriated from:

RE: Approve Purchase of Tipping Fees for Riverside Parking Lot Phase 1 Project
Pursuant to Standardization Exception(Chapter 12-11).
BACKGROUND
This year's reconstruction of the Riverside parking lot requires the disposal of sub-grade material.
ANALYSIS
Waste Management Inc.'s Berlin facility is the closest licensed establishment to accept this
material. The City Manager has approved this purchase.
FISCAL IMPACT
The total cost of tipping fees will not exceed $50,000. The purchase will be paid for by the
parking lot improvements item in the 2014 CIP's Property Improvements section. On December
10, 2013,the Common Council awarded construction of the Riverside Park Parking Lot to Vinton
Construction Company. The fiscal analysis performed prior to the bid award showed that
adequate funds were available in the CIP for the purchase of light poles and fixtures. Prior to the
purchase, approximately $184,000 remained in the CIP for this project. After this purchase,
approximately $134,000 remains in the CIP for this project. Funding would be charged to the
CIP Property Fund-Riverside Parking Lot Improvements(A/N#: 323-1717-7216-06238).
RECOMMENDATION
Section 12-11 of the Municipal Code provides that subject to approval of the City Manager,
purchases may be made without following a formal competitive bidding process when the
purchase is from only one source of supply or when standardization or compatibility is the
overriding consideration. In accordance with Section 12-11 of the Municipal Code, and because
this purchase is in excess of$25,000, Purchasing recommends the Common Council approve this
purchase for these tipping fees to Waste Management Inc. for$50,000.
