HomeMy WebLinkAbout07. 14-307 JULY 8, 2014 14-307 RESOLUTION (CARRIED___7-0____LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVE CONNECTING HIGHWAY CHANGE AGREEMENT WITH WISCONSIN DEPARTMENT OF TRANSPORTATION FOR MAINTENANCE JURISDICTION REVISION ON STATE TRUNK TH HIGHWAY 44 FROM US HIGHWAY 41 TO 20 AVENUE INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Connecting Highway Change Agreement with the Wisconsin Department of Transportation for Maintenance Jurisdiction Revision on State Trunk Highway 44 from US Highway 41 to th 20 Avenue is hereby approved and the proper City officials are hereby authorized to execute and deliver the agreement in substantially the same form as attached hereto, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. Patek, Director of Public Works c-19 DATE: July 1, 2014 RE: Approve Connecting Highway Change Agreement with Wisconsin Department of Transportation (WDOT) for Maintenance Jurisdiction Revisions on STH 44 from US Highway 41 to 20th Avenue BACKGROUND In 2012, the Common Council approved a State/Municipal Agreement for a Highway Improvement Project on this section of STH 44. Based on that agreement, the City of Oshkosh took responsibility for maintaining the landscaping that was installed in these medians in 2013. The WDOT would now like to transfer the maintenance jurisdiction for the remainder of the roadway for this same section of STH 44. ANALYSIS This transfer would require the City of Oshkosh to become responsible for maintenance of the pavement and the traffic control facilities. Maintenance duties would include items such as snow plowing, crack filling, and minor pavement repairs. This responsibility would extend to the interchange ramps on the east side of US Highway 41. This transfer would also allow for more uniform maintenance of this roadway, which is a gateway entrance to the City. FISCAL IMPACT The WDOT has estimated that the addition of this 0.51 miles of roadway to City jurisdiction will result in an increase of approximately $7,500 to our yearly Road Aid payment. Rohloff City Manager DCP/tit I.\Engineering\Tracy Taylor\Memos to Mayor&Common Council\2014\Approve WDOT Connecting Hwy Change Agreemnt-STH 44_7-1-14.docx CONNECTING HIGHWAY CHANGE AGREEMENT BETWEEN THE WISCOSIN DEPARTMENT OF TRANSPORTATION AND THE CITY OF OSHKOSH WINNEBAGO COUNTY The City of OSHKOSH, hereinafter called the City, has been requested by the Wisconsin Department of Transportation, hereinafter called the State, to assume maintenance responsibility of a portion STH 44. WHEREAS, Section 86.32(1), Wisconsin Statutes, enables the State to designate certain marked routes of the state highway system over the streets or highways in any municipality for which the municipality will be responsible for maintenance and traffic control; and WHEREAS, the character of travel service provided by this route, uniformity of maintenance, the effect on the maintaining agency and the municipality's maintenance capability are considerations predicating this designation; and WHEREAS, reimbursement for maintenance of the connecting highway shall be determined using the rates per mile provided for under Section 86.32, Wisconsin Statutes. THEREFORE BE IT RESOLVED, the parties do mutually agree to extend the connecting highway limit on STH 44 from CTH K (W. 20th Ave) to the East interchange ramps of USH 41. ALSO, BE IT RESOLVED, by the Common Council of the City of Oshkosh, Wisconsin, hereby agrees, the City of Oshkosh shall be responsible for future maintenance on this portion of STH 44 as well as all traffic control regulations and all costs associated with any traffic control devices; and BE IT FURTHER RESOLVED, the effective date of the connecting highway change will be effective when the State Division Administrator signs the connecting highway change agreement.
