BE IT RESOLVED by the Common Council of the City of Oshkosh that the
proposed expansion of the existing planned development at 717 West Irving Avenue, to
construct a single story addition at the northeast corner of the existing building, per the
attached, is hereby approved with the following condition:
1) A base standard modification for the front yard setback (West Irving Avenue)
from 25 feet to 6 feet 2 inches.

BACKGROUND
The property is located on the southeast corner of West Irving Avenue and Elmwood Avenue
and is approximately .68 acres. The Women's Center offers a variety of services and
programs that are open to students, faculty, and community members. The subject site is
zoned R -5PD.
The petitioner requests approval of a Planned Development to expand the existing UW-
Oshkosh Women's Center building to the north (closer to Irving Avenue), requiring a base
standard modification for the required 25 foot front yard setback, which is proposed at 6 feet
2 inches.
ANALYSIS
This request was initiated by University of Wisconsin System Board of Regents to expand the
existing UW- Oshkosh Women's Center building to the north by constructing a 293 square
foot single story addition. This addition will allow for an ADA accessible entry and provide
safe and secure access to the building. The addition will be constructed of materials that are
consistent with the existing building.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its July 1, 2014 meeting.

The petitioner requests approval of a Planned Development to expand the existing UW- Oshkosh
Women's Center building to the north, requiring a base standard modification for the required 25
foot front yard setback, which is proposed at 6 feet 2 inches.
Applicable Ordinance Provisions:
The Zoning Ordinance establishes criteria and guidelines for the establishment and /or amendment
of a Planned Development in Section 30 -33.
Background Information Property Location and Type:
The subject property is located on the southeast corner of West Irving Avenue and Elmwood
Avenue and is approximately 0.68 acres. The building formerly housed the Newman Center which
was used for assembly and office space for religious purposes. In 2003, the building was
purchased by the University of Wisconsin- Oshkosh and was converted to a Women's Center. The
Women's Center offers a variety of services and programs that are open to students, faculty and
community members. The subject site is zoned R -5PD.

ANALYSIS
The proposed expansion of the UW -Oshkosh Women's Center consists of a 293 square foot single
story addition located on the northeast corner of the existing building. The present usage of the
facility will not be affected as the intent of this proposal is not to expand the use but to provide
safe and secure access to the building. The addition will allow for an ADA accessible entry to the
lower level eastern wing of the existing building. The current handicap accessible entry for the
eastern wing is located on the south side of the building and is a safety concern for the owner
because it is poorly lit and not visible from the street. The applicant is not proposing any changes
to the existing site other than the new entry.
The addition to the Women's Center is proposed to extend north from the existing building and
would further encroach into the front yard setback on West Irving Avenue and will therefore
require a base standard modification to permit its placement. The existing building is setback 15
feet 4 inches and the applicant is proposing to encroach fiurther into the required 25 foot West
Irving Avenue setback by 9 feet 2 inches thereby providing a 6 foot 2 inch setback.
The Women's Center does have an existing retaining wall and handicap ramp leading to the
western wing of the building which is setback approximately 6 feet from West Irving Avenue. The
new addition will be similar in size and setback to the existing retaining wall and handicap ramp.
Due to the existing site conditions staff felt the additional setback encroachment, as proposed,
would not create traffic site distance issues and the location has little if any impact on surrounding
properties.
The proposed addition will be constructed of materials that are consistent with the existing
building and will include three window openings and an aluminum door with glass insert, which
will blend well and mirror the window openings on the second story of the existing building
facade.
RECOMMENDATION /CONDITIONS
Staff recommends approval of the Planned Development as proposed, with the following
conditions:
1) Base Standard Modification for the front yard setback (West Irving Avenue) from 25 feet
to 6 feet 2 inches.
The Plan Commission approved the expansion of the UW -O at 717 W. Irving Ave. The following
is Plan Commission's discussion on this item.
Ms. Williams stated the building in question is the former Newman Center purchased by the
University in 2003 for use as a Women's Center to provide a variety of services and programs that
are open to students, faculty and community members. The proposed 293 square foot addition will
be located at the northeast corner of the building. The addition will allow for an ADA accessible
entry to the lower level eastern wing of the building. Due to the existing substandard setbacks, the
addition will encroach further into the setback and require a base standard modification of 6 feet 2
inches. The design and materials will be consistent with the existing building.

Narrative of the Proposed Development Plan
1. Existing UWO Women's Health Center is presently used so a UWO facility for students. Tile
proposed addition is to provide a safe and secure visible ADA entry to lower level student area.
2. Structure is existing. All zoning approvals have previously been approved. This envy addition
for safety reasons has to be constructed within set back in Irving Street.
3. Present usage of facility, will not be affected, student clients and staff usage will remain
unchanged.
4. Proposed building area will be increased by 293 sq. ft. remaining land area, building area, parking
and landscaping area.
5. There will be no effect on adjoining properties.
6. Existing structure to remain. New envy will be compatible with existing facility and its
surrounding.
7. No additional traffic will be generated.
8. Addition provides a safe and secure visible entry to the function of this lower level area of the
building.
