PURPOSE: APPROVE EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE
GRANT (JAG) FOR POLICE DEPARTMENT IN THE AMOUNT OF
$23,420.00

BE IT RESOLVED by the Common Council of the City of Oshkosh that the
proper City Officials are hereby authorized and directed to approve application for a
grant agreement with U.S. Department of Justice for the Edward Byrne Memorial
Justice Assistance Grant to purchase One (1) Type 2 Indoor Cabinet Magazine, and
One (1) Type 3 Aluminum Day Box Noise Flash Diversionary Device (NFDD) storage
container; Two (2) Ballistic Shields with LED lights; Four (4) Canon EOS Rebel T5i
Digital Cameras and batteries; Two (2) Scout Portable Alarm Systems for the Oshkosh
Police Department and BOSCH Crash Data Retrieval software for the Winnebago
County Sheriff’s Office.
BE IT FURTHER RESOLVED that the proper City officials are hereby authorized
and directed to execute any and all documents required by the U.S. Department of
Justice, Office of Justice Programs, Bureau of Justice Assistance for the purposes of
same, and are further authorized and directed, if said grant is awarded, to accept such
funds pursuant to the terms of the grant application and to purchase the needed
equipment with the funds.

RE: Acceptance of Edward Byrne Memorial Justice Assistance Grant
BACKGROUND
The Oshkosh Police Department has been notified that we are eligible to receive a federal
grant through the Edward Byrne Memorial Justice Assistance Grant(JAG) program.
Program guidelines require that the application be available for review by the governing
body of the unit of local government prior to submitting the application to the Bureau of
Justice Assistance. Grant fund eligibility and dollar amount allocation to local
governments are determined by a formula based on the share of total violent crime
reported within the state, and the city of Oshkosh, as indicated in the annual Uniform
Crime Report(UCR)that we are required to submit. The grant can be used to purchase
equipment needed to support public safety services. The JAG grant application deadline
is June 10, 2014.
The eligible allocation to the city of Oshkosh under the 2014 Edward Byrne Memorial
JAG Grant is $23,420. The Oshkosh Police Department is the only eligible law
enforcement agency in Winnebago County to receive the grant, which creates a disparate
allocation of fiends requiring a Memorandum of Understanding (MOU)to be signed with
Winnebago County officials indicating how the grant will be utilized. However, because
our agencies both have operational needs, this grant will be shared with the Winnebago
County Sheriff's Office. The City of Oshkosh will act as the fiscal agent for this grant,
and the grant will be administered by the Oshkosh Police Department.
ANALYSIS
We reviewed our equipment needs that we believe support our operational priorities and
that are one time purchases that will not have much if any maintenance costs for future
budgets. The Oshkosh Police Department intends to purchase the following equipment
with the grant funds:
A. One (1) Type 2 Indoor Cabinet Magazine, and One (1) Type 3 Aluminum Day
Box Noise Flash Diversionary Device (NFDD) Storage containers, including
one for mobile transport in the Crisis Reaction Team Vehicle while
responding to a critical incident, and one for a stationary and mounted
container inside the Safety Building. The federal Alcohol, Tobacco and
Firearms (ATF) agency regulates storage of Noise Flash Diversionary Devices
relating to law enforcement agencies and we recently learned that we are not

in compliance with the storage of these devices in our inventory due to
changes in regulations. There are separate requirements depending on the
storage type. A Noise Flash Diversionary Device, or Flash Bang, is deployed
by our Crisis Reaction Team when making a high risk entry to a building,
room or structure to enhance officer safety. The cost of the two containers is
approximately $2,864.
B. Two (2) Ballistic Shields with LED lights for use by patrol officers on normal
patrol operations, as well as by the Crisis Reaction Team during operations at
critical incidents for officer and public safety against the threat of firearms.
The cost of the two ballistic shields is approximately $5,060.
C. Four (4) Canon EOS Rebel T5i Digital Cameras and batteries for use by
detectives at crime scenes and other police incidents. These cameras would
be shared among the seven detectives and replace the one-to-one issued older
model 35mm cameras. The older 35mm cameras are starting to malfunction,
are in need of repairs, and are becoming obsolete for our daily operations. We
are using digital technology that is much more versatile and cost effective than
developing 35mm prints. The cost of the four digital cameras and batteries is
approximately $2,547.
D. Two (2) Scout Portable Alarm Systems used as temporary alarm protection at
locations around the community for public and asset protection against
robberies, burglaries and other major crimes. We used to have ten portable
alarms that were rendered inoperable with the migration to a new countywide
radio system. The FCC has not approved the retrofitting necessary to make
our older units operable so we are switching to a new product utilizing the
latest technology. The cost of the two portable alarm systems is
approximately $8,320.
E. The Winnebago County Sheriff s Office intends to purchase BOSCH Crash
Data Retrieval software for the use by the crash team that allows for the
retrieval of vehicle systems data that can be used in major crash investigations
for reconstruction. The cost of the software is approximately $4,629.
FISCAL IMPACT
No Oshkosh Police Department budget dollars will be used to support any of the initial
equipment purchases for this grant, except if additional batteries are needed for the Canon
Digital cameras, and there are no matching funds required. Replacement SD Cards for
the cameras, general maintenance of the cameras, battery replacement, or replacement
LED lights for the ballistic shields will be the only predictable costs in the future as these
items are used,but we don't anticipate that need for a few years. All city purchasing
ordinances and procedures will be followed.
The Winnebago County Sheriff's Office will have annual software maintenance and
update costs that will be funded through their normal budget process.
SUMMARY
If approved, we intent to submit the application by the established deadline of June 10,
2014, accept the grant funds as allocated and purchase the equipment indicated in this
memo within the established grant timelines and guidelines. The Oshkosh Police
Department will act as the fiscal agent for this grant.
