HomeMy WebLinkAbout10. 14-216 MAY 13, 2014 14-216 RESOLUTION (CARRIED __6-0_____LOST_______ LAID OVER _______WITHDRAWN_____) PURPOSE: APPROVE WAIVER TO PLUMBING CODE (SECTION 20-8) RELATING TO MANDATORY CONNECTION OF BURNWOOD DRIVE PROPERTIES TO THE PUBLIC SANITARY SEWER SYSTEM INITATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, when existing public sanitary sewer is available to serve the property, the City of Oshkosh Municipal Code requires all buildings with a private wastewater system to connect to the public sanitary system within a one-year period; and WHEREAS, the City of Oshkosh Municipal Code requires that all buildings served by a private well connect to the public water main and if the well continues to be used it must be tested and permitted by the Plumbing Inspector; and WHEREAS, the City of Oshkosh had previously installed public water main and sanitary sewer main within Burnwood Drive; and WHEREAS, pursuant to a Boundary Agreement with the Town of Algoma, nine properties along Burnwood Drive were attached to the City; and WHEREAS, the City of Oshkosh had proposed to install sanitary sewer and water laterals within the Burnwood Drive right-of-way and extend water main as part of a Capital Improvement Project; and WHEREAS, due to budget and borrowing considerations, that project has been postponed; and WHEREAS, that project is tentatively included in the 2015 Capital Improvement Program; and WHEREAS, one home has a failing private septic system and has indicated that they will hire a contractor to complete the service lateral construction to the public sanitary sewer system. NOW, THEREFORE, BE IT RESOLVED by the Common Council for the City of Oshkosh that a temporary waiver of the provisions of section 20-8 of the City of Oshkosh Municipal Code is hereby granted for the eight remaining properties along Burnwood Drive (2225, 2257, 2277, 2301, 2409, 2453, 2463 and 2491 Burnwood Drive) to continue using their private septic systems and wells subject to inspection and permitting as required by the City Code or State Statutes. MAY 13, 2014 14 -216 RESOLUTION CONT'D NOW, THEREFORE, BE IT FUTHER RESOLVED by the Common Council for the City of Oshkosh that this temporary waiver shall terminate and each of the properties shall be required to connect to the public sanitary sewer system immediately upon failure to comply with any of the requirements of the City Municipal Code or State Statutes pertaining to inspection, permitting or maintenance of a private well or within one year of Notice from the City of Oshkosh that the installation of a service lateral to the property has been completed. Gohde, Assistant Director of Public Works DATE: May 8, 2014 RE: Approve Waiver to Plumbing Code (Section 20 -8) Relating to Mandatory Connection of Burnwood Drive Properties to the Public Sanitary Sewer System BACKGROUND The boundary agreement with the Town of Algoma requires attachment of certain properties at agreed upon dates. In 2013, all township properties located east of Highway 41 were attached to the City. Nine existing homes along Burnwood Drive were included in that attachment. Where existing public sanitary sewer and water main are available to serve the property, Municipal Code Section 20 -8(C) requires that all buildings with a private wastewater system connect to the public sanitary system within a one -year time period. The Plumbing Code also requires that all buildings served by a private well connect to the public water main. The water connection may be terminated inside the building and the well may continue to be used. However, the well must be tested and permitted by the Plumbing Inspector. The City proposed to install sanitary sewer and water laterals within the Burnwood Drive Right -of -Way and extend water main as part of a Capital Improvement Program (CIP) project. Due to budget/borrowing considerations, that project was postponed. The project is tentatively included in the 2015 CIP, ANALYSIS The nine homes along Burnwood Drive that were formerly under Town of Algoma jurisdiction have access to the public sanitary sewer system. Four homes along the east side of Burnwood Drive do not have access to the public water main system. Alf homes are currently served by private septic systems and wells. Currently, one of the homes on Burnwood Drive has a failing private septic system and this property will need to connect to the public sanitary sewer system. That property will need to hire a contractor to complete the service lateral construction at this time. If other properties have issues with their private systems, they will need to connect to the public sanitary sewer or water systems upon the failure of their private septic or well system. Otherwise, there is no immediate need for the other properties to connect to the sewer system. FISCAL IMPACT The property owners will be assessed the full cost of installing the sanitary sewer and water laterals as part of a future CIP project. RECOMMENDATIONS recommend allowing eight properties (2225, 2257, 2277, 2301, 2409, 2453, 2463, and 2491) along Burnwood Drive be allowed to continue using their private septic systems and wells subject to conditions. The private systems are to be inspected and permitted, as required by City Code or State Statute. In addition, these properties will need to connect to the public sanitary sewer system within one year of the installation of the service lateral which is constructed as part of a future CIP project.
