MAY 13, 2014 14-215 RESOLUTION (CARRIED__6-0______LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVE CONDITIONAL USE PERMIT FOR AUTOMOBILE SERVICE BUSINESS/TOWING OPERATION – 1980 WEST FERNAU AVENUE INITIATED BY: ERIC FELIX, FELIX AUTO & TIRE, PETITIONER PLAN COMMISSION RECOMMENDATION: Found to be consistent with Section 30- 11(D) and approved with condition BE IT RESOLVED by the Common Council of the City of Oshkosh that a conditional use permit for an automobile service business/towing operation, per the attached, is hereby approved at 1980 West Fernau Avenue, with the following conditions: 1) No outdoor/unenclosed storage of tow trucks, service equipment, inoperable vehicles, parts or other materials be allowed on the property with the exception of customer parking. 2) Fence enclosure to be repaired and maintained with complementary materials that are consistent with the existing fence enclosure. 3) Landscaping be installed on the Algoma Boulevard frontage which includes the west 30 feet of the south side of the lot and a detailed landscape plan be submitted for Planning Division staff review. 4) Removal of all gravel within the right-of-way and replaced with turf and the existing drive be repaired where necessary with complementary materials. o.IHKof H ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Darryn Burich Director of Planning Services DATE: May 8, 2014 RE: Approve Conditional Use Permit for Automobile Service Business/Towing Operation 1 1980 West Fernau Avenue (Plan Commission Recommends Approval) BACKGROUND The 0.64 acre site is fully developed with structures totaling 7% of the lot area, driving surfaces occupying 25% and green space occupying the remaining 68 %. The property is currently unoccupied but has been used in the past as an automobile service and towing facility. The property has frontage on W. Fernau Avenue and Algoma Boulevard, and has one access drive to the property off of W. Fernau Avenue. The site has one structure totaling 1,912 square feet and has two large gravel and concrete driving surfaces. There is an existing perimeter fence that is located on the easterly and northerly lot line and approximately 22 feet off the west property line and approximately 21 feet off the south lot line. Substantial green space is located outside the fenced in area to the west that continues for approximately 30' east on the south side of the lot. ANALYSIS The petitioner states that if this request is approved, it will allow the relocation of their existing automobile service and towing business from outside of the City to a larger more appropriate site with a better working environment and future expansion possibilities in a more desirable location. Hours of operation are proposed to be 7:00 am to 6:00 pm Monday through Friday and 8:00 am to 12.00 pm on Saturday with 24 hour emergency towing services. The existing facility will not require any major remodeling for the proposed use other than repairs to the existing security fence, painting of the structure, and removal of existing trees and brush on the site. The enclosed vehicle storage facility will accommodate 20 stalls for service related parking and off - street customer parking on the south side of the facility. All business related materials and vehicles are to be stored out of view inside the security fence with landscaping to be installed on the Algoma Boulevard side wrapping to the east with approval of a landscape plan by the Department of Community Development. Staff is also recommending that the existing gravel drive located within the public right -of -way be replaced with turf and the existing drive be repaired where necessary. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its May 6, 2014 meeting. Applicable Ordinance Provisions: Automobile service and towing uses are permitted only through a conditional use permit in the M -3 General Industrial District as regulated in Sections 30 -30 (A) of the Zoning Ordinance. Criteria used for Conditional Use Pen-nits are located in Section 30 -11 (D) of the Zoning Ordinance. Land I0 -Year Recommended Land Use Plan Commercial 20 -Year Recommended Land Use Plan Commercial ANALYSIS The petitioner states that the conditional use request, if approved, will allow them to relocate their existing automobile service and towing business currently located outside of the City of Oshkosh to a larger more appropriate site within the city, The site provides a better working environment and future expansion possibilities. The applicant finds this site, which is currently vacant, a more desirable location for his business as it is closer to US Highway 41 and surrounding highways, closer proximity to residential neighborhoods while still respecting any sound, odor and light concerns and provides a larger facility that will better accommodate their needs. Hours of operation for the uses on the site are proposed to be between 7x00 am and 6:00 pin Monday to Friday and 8:00 am to 12:00 pm on Saturday. In addition to regular work hours, the business will accommodate 24 hour emergency towing and temporary storage of vehicles. The tow truck driver on duty will have the tow truck off -site at night and will return the vehicle during the work day. This need is to facilitate the 24 hour emergency towing needs. The 1,912 square foot building has an existing restroom facility and a 600 square foot customer business and waiting area. The remaining 1,312 square feet of building area will be used as garage space for vehicle repair and service. The building does not need any major remodeling to fit the applicant's needs as the building was used as an automobile service facility in the past. The site currently has a 6 foot security fence surrounding the storage lot and an existing gate on the east side of the building. The .fence is in need of repair and the applicant has stated that any repairs to the fence will be completed prior to occupancy. The applicant has also stated that the building will be painted and the existing trees and brush will be removed. The enclosed vehicle storage facility will be designed to accommodate 20 stalls for temporary storage of towed vehicles and service related parking. The site will have off - street parking for customers on the south side of the building, and no service or towing related vehicles or equipment will be visible from the road during closed hours. Staff is in support of the proposed uses as they are similar in scale and scope to the previous use of the lot and the surrounding area. Though the site is surrounded by existing manufacturing and other industrial uses, staff has some concerns about storage of business related equipment and vehicles on site. Staff is making the recommendation that all business related materials be stored out of view and inside the security fence. Staff also recommends that the existing fence enclosure be repaired with complementary materials that maintain consistency with the existing fence. Additionally, staff is recommending that landscaping be installed on the Algoma Boulevard (west side) wrapping to the east approximately 30 feet on the south side of the buildings. Staff requires that a detailed landscape plan be submitted and will be reviewed by Planning Division staff. Staff also has concerns about the existing gravel drive still within the public right -of -way. Staff is recommending that the gravel be removed within the right -of -way and replaced with turf and the existing drive be repaired where necessary. Item — CUP /Aidowhile Service and Tmving -19$0 6V Founder Avenue RECOMMENDATION /CONDITIONS Staff finds that the request for a conditional use permit is consistent with Section 30 -11 (D) of the zoning ordinance and recommends approval with the following conditions: 1, No outdoor /un- enclosed storage of tow trucks, service equipment, inoperable vehicles, parts or other materials be allowed on the property with the exception of customer parking. 2. Fence enclosure to be repaired and maintained with complementary materials that are consistent with the existing fence enclosure. 3. Landscaping to be installed on the Algoma Boulevard frontage which includes the west 30 feet of the south side of the lot and a detailed landscape plan be submitted for Planning Division staff review. 4. Removal of all gravel within the right -of -way and replaced with turf and the existing drive be repaired where necessary with complementary materials. The Plan Commission approved of the conditional use permit as requested with conditions noted. The following is the Plan Commission's discussion on this item. Mr. K-rumenauer presented the item and reviewed the site and surrounding area as well as the land use and zoning classifications in said area. He explained that the site was previously developed with an existing structure and fenced in area and reviewed photos of the site as it currently exists. He further stated that the property is zoned M -3 General Industrial District and is currently vacant but the proposed use is consistent with the City's 10 and 20 -year land use plans. He reviewed the proposed use of the site and the site plan submitted and stated that all service vehicles and materials would be contained on site in the fenced in area and out of view. He also reviewed the conditions recommended for this proposal and discussed the landscaping features for the site which would require approval by the Department of Community Development. He reviewed the graveled area referenced in the staff report that was recommended to be removed and replaced with turf. Mr. Hinz arrived at 4:15 pm, Ms. Propp commented that the staff report indicated that the building would not require any major remodeling however from viewing the photos of the site, it appeared that the structure was in need of repairs. Mr. Krumenauer replied that the structure would be painted, the fencing repaired, and repairs completed on the driveway surface with the addition of landscaping to the site. Mr. Bowen commented about the new zoning ordinance update which would include new zoning maps and questioned how frequently the Geographical Information System (GIS) mapping is updated. He felt that with all the Department of Transportation's reconfigured right-of-ways, it has changed a lot of things and the maps are kind of confusing when they do not reflect the most current changes. ltem— CUP14utomobile Service and Towing— 1980 YVFernatfAvenue Mr. Ea=enauer responded that there is a timeline for updates to the City's GIS system as all the changes take time to incorporate into it. Mr. Buck commented that the new zoning map will be parcel by parcel and areas that contain both City and Town parcels such as this one make things confusing. Mr. Thoms questioned that the conditional use permit was for the use only and questioned why there was no signage requirements discussed. Mr. Burich responded that this area was not a planned development therefore the signage was considered an accessory use and was permitted in the M -3 zoning district. Any signage on the site would need to meet code requirements or the petitioner would have to request a variance if the proposed signage did not meet code regulation standards. Mr. Thoms voiced his concern about this area being a gateway corridor to the city and the aesthetic effects of this site. Mr. Buck indicated that the landscaping conditions were to address the towing operation as the fenced in area for service vehicles and materials for storage use purposes on the site leaves a blank wall for an extended area. Mr. Burich added that the landscaping will hide the storage use on the site and although it was previously an automobile service and towing facility, the property was located in the Town at that time. Ms. Propp commented that the staff report indicates that the towing truck will be located off-site at night and questioned where it would be located. Mr. Burich replied that since towing services are necessary 24 hours a day, the truck is usually stored in someone's driveway during the night when a driver is on -call which is allowed by City code providing it is only one commercial vehicle and within certain size dimensions. Fernau Ave. This proposal is to accompany our application to the City of Oshkosh for the requested conditional use permit. Felix Auto and Tire LLC is requesting "a conditional use permit at 1980 W. Fernau Ave, to begin business in automotive repair and towing. The existing fenced in yard will allow for temporary vehicle storage. The property at 1980 W. Fernau Ave is currently vacant and was previously used for automobile service and towing. The site contains green space and existing gravel parking lots. Site Data Total Area 27,878 sgft 0.64 acres Building 1,912 sgft Green space 25,426 sgft .Parking 540 sgft The building has an existing restroom and 600 sgft of waiting area. We would not need to modify the building from its current configuration for our operations. The service area will allow for the growth of our business. The current layout is suitable for immediate occupancy. This facility has room for tow truck parking on the north side of the building out of site. The existing fenced area would contain abandoned or wrecked vehicles. The vehicles are towed to the property and stored until all legal obligations are met and then transferred to another facility for repairs or salvage. Our current staff comprises 1 full time and 1 part time employee. With the new facility we hope to add 1 -3 more full time employees within the first calendar year of occupancy. We believe we will have 10 -15 customers a day and 30 -50 phone calls. Rj The set back of the building allows easy traffic flow without any blind spots or backups. All traffic will enter off W. Fernau Ave, which is the only entrance. The traffic to and from the proposed site should not be any greater than the adjacent businesses to the north and east including an automobile repair shop and towing. We anticipate there will be no adverse effects to surrounding properties due to glare, odor, fumes or vibration since this property has functioned as a similar business in the past. Hours of operation will be from lam to 6pm Monday to Friday, Sam to Noon on Saturday. The towing service operates 24 hours a day. The driver will take the tow truck home at night and return at 7am. All scrap metals and parts will be stored inside the facility in appropriate bins for recycling through local salvage facilities. All service work performed on site will be indoors. We will use the existing gravel parking lot, driveway, and fenced in area to keep customer's cars secure. The existing gates will be used, one on the west and east side of the building. Each are drive through and face south. The storage area would be approximately 20 stalls. We will be repairing the existing fence and gates, general lot clean up (brush removal) and painting the building. We will also remove the current gravel, which is over the property line, and replace with grass. We feel our business is very compatible with the surrounding properties. We will buy parts from local auto part stores. We will service many people in the area's residential neighborhoods by providing a wide range of services including, automobile repair, 24 hour vehicle lock out service, jump starting and towing. We will provide 24 hour emergency towing related services for area law enforcement including, Oshkosh Police Department, University of Oshkosh Security, Winnebago County Sheriff Department and the Wisconsin State Patrol. We will also provide towing for many neighboring repair facilities and commercial businesses. It is our intention to bring something positive to the immediate area.
