Brennand 977 County Road I Oshkosh, WI 54902 Dear Mr. Brennand: This letter is to confirm the lease agreement for Lot 2 in the Aviation Business Park equating to approximately 33 acres of land at $152 per acre. The lease property shall solely be used for agricultural purposes. Lessee shall not allow recreation activities on the leased property. Recreation activities includes, without limitation, hunting, snowmobiling, motorcycling, or ATV's. Lessee has inspected properties and leases them as is. Lessee cannot sublease or assign its interests in the leased property. Lessee planted winter wheat on the property in the fall of 2013. No additional crops shall be planted on the leased land. The City will be performing soil borings within the next couple of weeks which will disturb/damage/destroy sections of the planted wheat crop. The City will not compensate Lessee for any damage to the crop. Lessee will harvest/remove the wheat crop by October 1, 2014. The City will not compensate Lessee for any damage to crop left on site after this date. Lessee will not remove any iron markers in the field on both the City and County owned lands. Iron markers include boundary and future street markers. Prior to the 2014 EAA fly-in, the City will be installing a large ground sign identifying the future Aviation Business Park, and will hold a ground breaking ceremony, somewhere near the Ripple Avenue right-of-way. The City will not compensate Lessee for any damage to the crop with the installation of this sign. Payment must be sent payable to the City of Oshkosh, mailed to PO Box 1130, Oshkosh, WI 54903-1130 and received by October 31, 2013. As agreed Lessee will lease the land for the term from the date this agreement is fully signed until October 1, 2014. IJ Lessee shall not alter the leased property and agrees to remove all personal property, fixtures, and/or crops by the end of the lease. Lessee affirmatively agrees that any personal property, fixtures or crops remaining on the leased property at the termination of the lease should be considered to have no appreciable value. As part of this lease agreement lessee will protect/hold harmless the City of Oshkosh against any incidents, actions, claims or demands of any kind or character related to the leased property arising during the term of the lease. Lessee further agrees to fully indemnify and refund to the City within 30 days of written demand all such sums the City may be obligated to pay on such actions, claims or demands. The dates identified in this agreement are firm and time is of the essence.
