PURPOSE: APPROVAL OF VARIANCE TO EXCESSIVE NOISE
LIMITATIONS / BEATS 2 GO FOR HIP HOP BENEFIT CONCERT
– THE POWER OF HIP HOP / MAY 31, 2014

WHEREAS, the City of Oshkosh has adopted a noise ordinance limiting the
amount of noise at a property line; and
WHEREAS, the regulation of noise is generally more stringent between the hours
of 10:00 p.m. and 7:00 a.m.; and
WHEREAS, the ordinance provides that the Common Council may waive the
requirements of the ordinance if the Council determines that circumstances exist that
would make compliance with the noise limitations an unnecessary hardship to the
applicant; and
WHEREAS, in making this determination the Council is to consider:
(1) the hardship to the applicant, the community, and other persons of not
granting the variance;
(2) the adverse impact on health, safety, and welfare of persons owning,
residing, or occupying property in the surrounding area and the public
in general;
(3) the adverse effect on surrounding property;
(4) whether the circumstance, hardship, or situation to be addressed by
the proposed variance is unique, and not applicable generally to other
circumstances;
(5) whether the person or entity seeking the variance is otherwise in
compliance with all applicable ordinances, regulations and statutes;
and
(6) any other adverse impacts of granting the variance.
WHEREAS, a request for a variance has been filed by Beats 2 Go for their hip
hop benefit concert, The Power of Hip Hop, on May 31, 2014 at the Leach Amphitheater
to have amplified music until 10:30 p.m.
NOW, THEREFORE, BE IT RESOLVED by the Common Council for the City of
Oshkosh has considered the criteria pertaining to the granting of a variance to the City’s
noise ordinance and hereby grants such variance until 10:30 p.m. to Beats 2 Go for
their hip hop benefit concert, The Power of Hip Hop, on May 31, 2013 at the Leach
Amphitheater.

As an owner of Beats 2 Go Mobile DJ Service and a program staff at the Boys & Girls Club of
Oshkosh, I am trying to help raise money and awareness for the Boys & Girls Club of Oshkosh
and the Oshkosh Masonic Center. I am writing you today to ask you for a sound variance to
have music until 10:30PM for my hip hop benefit concert, The Power of Hip Hop, on May 31St
which is being held at the Leach Amphitheater. It is to my understanding that this is the time
that most other shows in the area, such as Waterfest and Irish Fest, request for as well.
The show is showcasing local hip hop artists throughout the area that are on the more educational
side of hip hop and some of the more comical side of it. The headliner of the show is Spose,
who is the singer of the song "I'm Awesome" from a couple years ago.
There are no expected adverse impacts to surrounding properties since my event is similar to
other events and variances that have been granted for other events in Oshkosh. This is a one-
time event occurring on a Saturday evening and will be in compliance with all other rules and
regulations. Also, this request is only requiring the minimum variance required.
