PURPOSE: APPROVE CONDITIONAL USE PERMIT TO CONSTRUCT
ARMORY PLACE STORM WATER DETENTION BASIN,
GENERALLY LOCATED ARMORY PLACE, KOELLER STREET,
CRYSTAL SPRINGS AVENUE

forth in Section 30-11(D) of the Zoning Ordinance and approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that a
conditional use permit is hereby granted under Section 30-11 of the Oshkosh Zoning
Ordinance for construction of a wet storm water detention basin on vacant land
immediately west of the National Guard Armory at 1415 Armory Place and immediately
east of 1550 South Koeller Street, as well as a vacant lot on Crystal Springs Avenue,
per the attached, with the following conditions:
1) The detention basin is designed without riprap above the water line and native
plants are planted on the side slopes of the basin and emergent plants on the
safety shelf.
2) Landscape plan be approved by the Community Development Department.

BACKGROUND
The subject property is a vacant 19 acre part of a 55.67 acre accumulation of three parcels formerly
used by the Wisconsin National Guard Armory, a commercial shopping center and single-family
home. The area includes a mix of low density residential uses to the north, commercial uses to the
west and National Guard facilities to the south and east. In 2004, the Oshkosh Common Council
approved the official mapping of a portion of the subject site for future use as a storm water detention
basin in the Campbell Creek Watershed. The official mapping action protected this area from private
development. Authorization to acquire the land area was approved by the Common Council in 2010.
ANALYSIS
The Campbell Creek Stormwater Management Plan recommended three detention basins to be
constructed in the Campbell Creek Watershed of which two have already been completed. The
proposed basin at the Armory location is the next project identified for construction with a fourth basin
under consideration. The proposed detention basin will be located on vacant land located west of the
National Guard Armory at 1415 Armory Place and east of Best Buy at 1550 S. Koeller Street and will
also include a vacant lot on Crystal Springs Avenue. The runoff will enter the detention basin at the
northwest corner and will discharge from the northeast corner to the storm sewer in Crystal Springs
Avenue slowing the release of runoff into the downstream areas and reducing the impacts of flooding
in said area. The basin will also allow for the settling of suspended solids resulting in the removal of
48.3 tons of sediment per year from runoff. The proposed detention basin will help remedy existing
flooding issues and will not have a negative impact on the adjacent properties.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of this request at its March 4, 2014 meeting.

The applicant is requesting a conditional use permit to develop a wet storinwater management
basin.
Applicable Ordinance Provisions:
Public utility structures are permitted through conditional use permit in R-1 Single Family
Residence Zoning District as regulated in Section 30-17 (A) of the Zoning Ordinance and also in
the C-2 General Commercial Zoning District as regulated in Section 30-25 (A) of the Zoning
Ordinance. Standards imposed on Conditional Use Permits are located in Section 30-11 (D) of the
Zoning Ordinance.

ANALYSIS
The Campbell Creek Stormwater Management Plan (2008) recommended three detention basins to
be constructed in the Campbell Creek Watershed. These included basins at Tipler School (34 acre-
feet of storage), the Armory property (27 acre-feet of storage) and Westhaven Golf Course (154
acre-feet of storage). The Tipler basin was constructed in 2009 providing the originally proposed
34 acre-feet of storage. The large Westhaven Golf Course project was removed from
consideration by the Common Council and a smaller 25 acre-foot basin was created adjacent to the
Westhaven Clubhouse. With the removal of the larger capacity at Westhaven, the Armory basin
was expanded to detain approximately 52 acre-feet of water and another basin is currently being
considered near the intersection of West 9"'Avenue and South Washburn Street. The Armory area
detention basin is the next project identified for construction within this watershed, which
necessitates approval of a Conditional Use Permit.
The proposed detention basin will be located on vacant land located immediately west of the
National Guard Armory at 1415 Armory Place, immediately east of Best Buy at 1550 South
Koeller Street, and will also include a vacant (former residential) lot on Crystal Springs Avenue.
The project is designed as a wet detention basin that will receive runoff from the storm sewer
within Menard Drive and behind Shopko at 1300 South Koeller Street. The runoff will enter the
northwest comer of the detention basin, and will discharge from the northeast corner of the
detention basin to the storm sewer in Crystal Springs Avenue.
The detention basin will slow the release of runoff into the downstream areas. Storm sewer
improvements/upgrades as a part of the project will serve to get water from the upstream areas to
the detention basin in a more efficient manner reducing the impacts of flooding in the areas
upstream and downstream of the detention basin. The detention basin will also allow for the
settling of suspended solids prior to discharging back into the storm sewer system and is
anticipated to remove approximately 48.3 tons of sediment per year from runoff. The detention
basin will be constructed in conformance with tecluiical standards including a safety shelf, side
slopes, and fore bay.
Staff feels that this is a good opportunity to help remedy existing flooding issues within the
Campbell Creek Watershed and the development of the Armory Area Detention Basin will not
have a negative impact on the adjacent properties as the primary use of the land will be passive.
Staff suggests the condition that a more natural style of detention basin be utilized involving
planting of emergent plants in the safety shelf area and native plants on the side slopes rather than
the Rill use of riprap as it is better functioning, environmentally friendly, is a deterrent to intrusion
and more aesthetically pleasing.
RECOMMENDATION/CONDITIONS �
Staff recommends a finding that the proposed conditional use permit request is consistent with
Section 30-11(D) of the Zoning Ordinance and be approved with the following conditions:
1. The detention basin is designed without riprap above the water line and native plants are
planted on the side slopes of the basin and emergent plants on the safety shelf.
2. Landscape plan approval by the Department of Community Development.

The Plan Commission approved of the conditional use permit as requested with conditions noted.
The following is the Plan Commission's discussion on this item.
Mr. Buck presented the item and reviewed the site and surrounding area as well as the land use and
zoning classifications in said area. He further commented that the site is currently vacant land and
was officially mapped for this use in 2004 and the land acquisition was approved in 2010. He
reviewed the site plan for the proposed detention basin and discussed the two previously
constructed basins in the city. He also explained how the detention basin would function which
would reduce flooding both upstream and downstream from the basin and allow for the settling of
suspended solids resulting in the removal of 48.3 tons of sediment per year from runoff. The
detention basin will not have a negative effect on the adjacent properties and he reviewed the
conditions recommended for this request.
Mr. Borsuk questioned what level of storm water event the detention basin was designed to contain
and the release rate from the pond after an event,
Mr. Gohde responded that the basin was designed to handle a 100 year storm event and the exact
draw down was unknown at this time but he anticipated it to be about 48 hours or more for the
basin to complete releasing the storm water.

Project Narrative
The Armory Area Detention Basin is situated within the Campbell Creek Watershed in the southwestern
portion of the City of Oshkosh. The Campbell Creek Watershed has historically suffered moderate to
severe flooding in minor to moderate rainfall events. The City of Oshkosh Comprehensive Plan has
identified the Campbell Creek Watershed as having flooding concerns since the 1960's. A detailed
planning level Stone Water Management Plan study began in 2005. As a result of that plan, and
subsequent updates,the Tipler Area Dry Detention Basin, Tipler Conveyance Upgrades, and the
Westhaven Clubhouse Area Detention Basin projects have been constructed. The Armory Area
Detention Basin is the next project identified for construction within this watershed.
The existing property is vacant land located immediately west of the National Guard Armory at 1415
Armory Place, and immediately east of Best Buy at 1550 South Koeller Street. The proposed project
will construct a wet detention basin on this vacant land. The wet detention basin will receive runoff
from the storm: sewer within Menard Drive, and behind Shopko. The runoff will enter the northwest
corner of the detention basin, and will discharge from the northeast corner of the detention basin. The
detention basin will have the capacity to store approximately 52 acre-feet of water.
The detention basin will serve to slow the release of runoff into the downstream areas. The storm sewer
upgrades taking place as a part of this project will serve to get water from the upstream areas to the
detention basin in a more efficient manner. By getting water into the detention basin in a more efficient
manner, and slowing the release, the impacts of flooding in the areas upstream and downstream of the
detention basin will be reduced. The detention basin will also allow for the settling of suspended solids
within the detention basin prior to discharging water back into the storm sewer system, It is estimated
that the detention basin will remove 483 tons per year of sediment from the storm water.
