HomeMy WebLinkAbout12. 14-108 MARCH 11, 2014 14-108 RESOLUTION (CARRIED__6-0_____LOST_______LAID OVER_______WITHDRAWN_______) PURPOSE: APPROVE LAND EXCHANGE WITH UNIVERSITY OF WISCONSIN-OSHKOSH / WEST 3RD AVENUE, CENTRAL GARAGE DEVELOPMENT PROJECT INITIATED BY: PUBLIC WORKS DEPARTMENT PLAN COMMISSION RECOMMENDATION: Approved WHEREAS, the City has reached an agreement with the University of Wisconsin-Oshkosh to facilitate an exchange of properties along West 3rd Avenue to make the new Central Garage more efficient and usable; and WHERES, the City proposes to dispose of a vacant lot on the south side of West 3rd Avenue, east of and adjacent to 663 West 3rd Avenue, to the University of Wisconsin-Oshkosh, per the attached; and WHEREAS, the University desires to exchange the northern portion of 662 West 3rd Avenue, per the attached, to the City for the vacant lot on West 3rd Avenue. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that a land exchange between the University of Wisconsin-Oshkosh for the northern portion of 662 West 3rd Avenue, and the City of Oshkosh for the vacant lot east of and adjacent to 663 West 3rd Avenue, is hereby approved. Td Avenue, a parallelogram- shaped parcel, approximately 134 feet wide by 150 feet deep (0.46 acres). Currently, the property is unimproved with exception of graveled area occupying the northern 113 of the property. The property is bounded by light industrial/institutional uses to the north, commercial and residential to the east, residential to the south and light industrial/institutional (UWO) to the west. The property the city is requesting to acquire is located at the northern portion of 662 W. V Avenue. The property is owned by the State of Wisconsin, and has two storage buildings being used as a University maintenance facility. The portion the city is requesting to acquire is irregularly shaped, approximately 183 feet wide by 89 feet deep (0.38 acres) and is unimproved, but currently used for outdoor storage. The area is surrounded by industrial institutional uses, most notably the City's Central Garage facility to the north, which is currently under renovations and modernization. ANALYSIS The city has been working with the University of Wisconsin-Oshkosh to facilitate an exchange of properties along W. 3rd Avenue. The land that is proposed to be acquired by the city will be combined with the Central Garage property and is needed to allow the site to function more efficiently. The land that is proposed to be disposed of was most recently used as an outdoor storage area and is located adjacent to another State-owned parcel and will enable the State to consolidate the two parcels into one. The land swap is contingent on the city improving the parcel to be disposed of to allow it to be used for outdoor storage including screening, paving, and storm sewer and drainage improvements. The proposed land transaction will not adversely affect the surrounding area and is consistent with the City's Comprehensive Plan. FISCAL IMPACT None anticipated. Public Institutional 20 Year Land Use Recommendation Public Institutional ANALYSIS The city has been working with the University of Wisconsin Oshkosh to facilitate an exchange of properties along W, 3`d Avenue. The land the city is proposing to acquire will be combined with the Central Garage property and is needed to allow the site to function more efficiently. The new proposed lot line where the parcel will be split is located 20 feet north of the existing buildings which exceeds the rear yard setback required in the M-2 District and allows the University adequate space to access the tear of the buildings and property. The property the city is requesting to dispose of was most recently used as an outdoor storage area by the City Water Utility. The property is located next to another State-owned parcel and will enable the State to consolidate the two parcels into one. The land swap is contingent on the city improving the vacant lot east of 663 W, 3`d Avenue to allow it to be used for outdoor storage. The improvements required include solid screening around the storage area, paving the storage area with asphalt and construction of storm sewer and drainage swale which will improve drainage in the area. Staff feels that the proposed land disposition and acquisition is in the best interest of the city as it adds needed land area to the Central Garage property and eliminates the city's continued maintenance of the vacant lot on the south side of W. 3`d Avenue. The proposed land transaction will not adversely affect the surrounding area and is consistent with the City's Public Institutional Comprehensive Plan Land Use recommendation. RECOMMENDATIONS Item A - Staff recommends approval of the disposition of the property located east of 663 W. 3`d Avenue, as requested, Item B - Staff recommends approval of the acquisition of the northern portion of 662 W. 3`d Avenue, as requested. The Plan Commission approved of the disposition of the property located east of 663 W. 3`d Avenue and the acquisition of the northern portion of 662 W. 3`d Avenue as requested. The following is the Plan Commission's discussion on this item, Item-Land Acg1Disp 600 block it'.3"Are. Mr. Nau presented the item and reviewed the site and surrounding area as well as the zoning classifications in said area. He reviewed the two sites involved in this request and explained the reasoning for the land exchange between the two entities. He also commented that the land swap is contingent on the city improving the vacant lot to be disposed of to allow it to be used for outdoor storage by the University. Ms. Lohry questioned if we knew what type of storage use was planned for the University's property, if this request was approved. Joann Rife,University of Wisconsin-Oshkosh, 800 Algoma Boulevard,responded that the site will be used for storage of the items that are currently stored on their site that the city is seeking to acquire as well as some storage of vehicles. The items will be outdoor storage. Motion by Borsuk to approve the land disposition ofproperty located east of 663 TV. Third Avenue and the land acquisition of the northern portion of 662 TV. Third Avenue. Seconded by Propp. Ms. Propp inquired if there were any zoning regulations that needed to be addressed for the outdoor storage use. Mr. Burich replied that the storage area would be required to be screened, Mr. Nau added that asphalt paving was also to be added to the site and Board of Appeals variances may be required as well. Steve Gohde, Assistant Director of Public Works, commented that variances would be necessary for the reduction of the front yard setbacks from 25 feet to 15 feet to buffer the residential use adjacent to the site and increase the amount of storage area available on the site. Ms. Lohry commented that it looks like a rather blighted area due to the amount of storage use. Mr. Burich responded that some of the visible storage should be addressed with the renovations to the Central Garage structure. Mr. Gohde added that fencing and berms will be installed to screen the storage on the Central Garage property. DATE: February 18, 2014 RE: Proposed band Swap between City and Board of Regents/UW-O The Department of Public Works has been working with the university of Wisconsin —Oshkosh (UW-03 to facilitate a land swap of property along West.31d Avenue. The land area from the University is needed to make the Central Garage site function more efficiently. The property the Ci�owns is adjacent to another UW-0 property allowing them to have a larger area on the south side of 3` Avenue. The attached map shows the proposed land swap areas. Currently, the UW uses the area at the rear of their property located at 662 W. 3Td Avenue for outdoor storage of materials. The City property was formerly used by the City Water Utility as a storage area. Currently, the property is vacant and partially covered with a very poor condition asphalt and gravel. The land swap-Is contingent'on the City improving the parcel of land adjacent to 663 W. 3rd Avenue to allow it to be used for outdoor storage. The City will construct a solid screening fence around the storage area and pave the storage area with asphalt. The proposed project also includes a storm sewer and swale to improve drainage in the area. A variance from the Board of Appeals will be needed to reduce setbacks. The proposed land swap will consolidate City owned land to make the Central Garage a more efficient and usable area while eliminating the need to maintain a vacant lot. The University will gain a slightly larger area of land overall and have the ability to consolidate the two parcels into one lot for redevelopment In the future.
