A G R E E M E N T THIS AGREEMENT made and entered into this day of April , 197 9 by and between GENERAL FIRE EQUIPMENT of 109 Rosalia Street, Oshkosh, WI' 549U1 , party of the first part, and the CITY OF OSHKOSH, a municipal corporation located in Winnebago County, Wisconsin, hereinafter referred to as the "City", and party of the second part. WITNESSETH: WHEREAS, the Common Council of the City of Oshkosh by resolution duly adopted on the 5th day of April , 197 9 , accepted the bid of the first party and authorized and directed the proper City officials to enter into an agree- ment with the party of the first part for: TURNOUT COATS AND BOOTS FOR FIRE DEPARTMENT $6,851.60 — Total Bid on Coats $2,546.75 — Total Bid on Boots according to the specifications and bid for same on file in the office of the City Clerk. NOW, THEREFORE, pursuant to said resolution of the Common Council of the City of Oshkosh, the parties hereto agree as follows : 1 . That the party of the first part will furnish same to the City, all in accordance with the specifications and bid on file in the office of the City Clerk. 2. That no assignment of this agreement or of any rights thereunder by said party of the first part, shall be valid without the written consent of the City; and that this document including the specifications and bid , constitutes the entire agreement between the parties hereto and that any understanding either oral or written, not a part hereof shall not be binding on either party. 3. That in consideration thereof, the City will pay to the first party the sum of $ As Above , upon presentation of a proper voucher, and delivery and acceptance by the City in conformity on said specifications and bid. We are submitting herewith for your consideration an invitation to bid on: FIRE FIGHTER (TURNOUT) COATS AND DAY BOOTS FOR THE OSHKOSH FIRE DEPARTMENT 2. Bids must be addressed to Oshkosh Purchasing Division, Department of Administration, City Hall , Oshkosh, Wisconsin. Envelope shall show name of bidder, and must be plainly marked in the lower left hand corner "Bid for Coats and Boots" . 3. Bids must be on file in the office of the Purchasing Agent no later than 10 :30 a.m. , C.S.T. , Wednesday, March 14, 1979 Any bids received after that hour and date will not be opened and will be returned to the bidder unread. 4. A written request for the withdrawal of a bid or any part thereof may be granted if the request is received by the City prior to the specified time of opening. 5. All formal bids submitted shall be binding for thirty-five calendar days following bid opening date, unless the bidder(s) , upon request of the Purchasing Agent, agrees to an extension. 6. Bids will be publicly opened and read at the hour an date above stated. Award, if any, will be made as soon thereafter as practical . 7. Although no certified check, cashier' s check, or bid bond must accompany the proposal , if the bid is accepted, the bidder must execute and file the proper contract within ten (10) days after award by the Common Council and receipt of the contract form for signature. 8. The City reserves the right to reject any and all bids and to waive any informalities in bidding. 9. Frueh City Manager PUBLISH: February 28th & March 3rd, 1979 GENERAL PROVISIONS 1 . Proposals shall be submitted on the sheets provided by the City of Oshkosh and proposals not submitted on those forms will be considered irregular and will not be read. 2. Unless stated otherwise in the specifications, all equipment or commodities shall be new and the manufacturer's current model , complete with all standard equipment and accessories. 3. Full identification of equipment or commodities quoted upon, including brand, make, model , catalog identification number (if any) , and descriptive literature where possible, must be furnished with the bid as an aid in checking the bid against specifications. If the item bid varies in any way from these specifications, special mention must be made of such points or it will be understood that the bidder proposes to meet all details of the specifications. 4. Unless stated otherwise in the specifications, all prices shall be F.O.B. Oshkosh, Wisconsin, stated destination, with all Federal Excise and Wisconsin Sales taxes deducted. The City of Oshkosh is exempt from these taxes and will furnish proper exemption certificate, if requested by the successful bidder. 5. If a warranty applies, the bidder shall state the conditions of warranty. 6. When requested in the specifications, the bidder must state the nearest location were parts and repair service will be available. 7. Delivery date must be stated in realistic terms to enable the bidder to adhere to them. 8. Indicate your terms of payment. The City of Oshkosh pays invoices on the first and third Thursday of the month. 9. If there are several items in the bid, the City of Oshkosh reserves the right to accept separate items or to award the total bid to one supplier, whichever is in the best interest of the City. If you bid is qualified in this respect, clearly state whether your bid is for "all or none" or to what extent it is qualified. 10. If there is a trade-in, the City of Oshkosh may elect to accept the bid with trade-in or without trade-in, whichever is in the best interest of the City. 11 . Equipment or items must conform to all applicable Federal Occupational Safety and Health Act provisions. 12. If two or more bidders submit identical bids and are equally qualified, the decision of the City to make award to one or more of such bidders shall be final . Selection shall be made by drawing lots. Cash discounts, when 10 days or longer are allowed will be considered. SPECIFICATIONS FIRE FIGHTER'S TURNOUT COATS SCOPE AND This specification describes the requirements for a fire PURPOSE: fighter's turnout coat for use by the fire fighters in the City of Oshkosh Fire Department. These requirements include an outer Nomex shell which is fire resistant, and a de- tachable vapor barrier of Nomex/Neoprene. SCHEDULE As specified for each coat subject to individual measure- OF SIZES: ment. Total coats 56 (more or less) . GENERAL: The coat is a single breasted model , with a wide storm collar, long sleeves with knitted wristlets, side patch pockets with flaps , a front storm flap and reflective stripes. It is designed to be worn over standard uniform shirt and trousers. MATERIALS: 1 . Basic Outside Fabric The basic fabric for the outer shell of the coat shall be a duck weave of 100% Nomex Flame-resistant Aramid with a weight of 7.5 oz. per square yard finished with a heavy duty Zepel finish for water repellency and to give a proper hang to the Nomex fabric. Color of the Nomex shell is to be yellow. All parts of the outer shell shall be fabricated of the same material except where other materials are specifically called for. The outer shell material will meet the requirements as specified in NFDA #1971 . 2. Inner Lining or Vapor Barrier The vapor barrier will have double stitched and sealed seams. Inner lining to be attached to coat by snap fast- eners. The fasteners shall comply with Military Specifi- cations MIL-F-10884D, Style 2. Fasteners shall be posi- tioned as follows : One on the inside of each sleeve just above the wristlets, five fasteners five inches apart along each front face, and four fasteners four inches apart around the neck. A total of 16 fasteners are to be used, bonded material system only. Insulation Liner or Winter Liner Detachable Insulation Liner is to have one inside pocket on left side, size 8 x 9 inches. Liner to be attached to coat with snap buttons and so placed so that liner will be held securely in place. The liner shall cover the body and the arms. Insulation Liner to be attached to coat by snap fasteners. The fasteners shall comply with Military Speci- fications MIL-F-10884D, Style 2. The Insulation Liner shall consist of 6 oz. Nomex needle-punch with 10 oz. neoprene. OPTIONAL: 3. Optional Liner Shall be the same as specified in paragraph #2 except no neoprene backing. GENERAL CON- Coat seams will be double stitched throughout, and all seams STRUCTION: will be doubled feld, so no fraying will occur. Coats will be reinforced with bar tacks on pocket corners, on storm flap, and top pocket flaps. Stitching to be approximately 8 stitches per inch. Workmanship to be first quality through- out. PELLON: Non-woven pellon material shall be located in the front of the coat on both sides on a width not less than 6 inches and to run the length of the entire coat. This material acts as a reinforcement and padding. COLLAR: The collar and throat strap shall be Nomex on both sides, same material as outer shell . The collar shall be snug fitting and comfortable and shall completely cover the neck and throat when in the raised position. The height of the collar shall be a minimum of 3 inches at the center back to a maximum of 5 inches at the throat when in the raised closed position and shall be varied to provide a comfortable fit for each size of coat. A throat strap of at least 3 inches in width shall be closed by means of snap fastener which allows for adequate collar adjustment. It shall be held in the stowed position by another snap fastener. The snap fasteners shall comply with Military Specifications MIL-F-10884D, Style 2. Snaps shall not extend through entire collar. Snaps will be covered from wearer's neck when collar is in upright position. SLEEVES: The sleeves shall be wing-free set-in construction, one piece construction, with all seams double chain stitched and lapped. The sleeves shall be attached to the coat so that there is no restriction and the wrist remains covered when the arms are raised above the head. Outer shell material meeting the requirements of this standard should provide significant wear resistance for the entire sleeve. The cuff shall be reinforced with 7.5 oz. Nomex the full circum- ference of the sleeve, the outside width of reinforcement to be at least 1 inch at outside of cuff and at least 1 inch on inside of sleeve at cuff. WRISTLETS: The coat shall have wristlets designed to keep hot air and steam out of the coat sleeve and off the wrist. The require- ments is also applicable when the arm is extended in the raised position. Each sleeve shall have a knitted writslet made of Nomex. The wristlet ensemble shall be of a con- figuration that will provide a barrier against moisture and debris entering the sleeve. There will also be a water well of neoprene at the cuff. SHOULDER & Back yoke and back panels of shell shall be of two piece BACK YOKE: construction with an interior yoke. The shoulder and back shall be reinforced with the yoke from a point on the crown of the shoulder, 6 inches down the back of the coat by a double thickness of the material used for outer shell . Nomex Aramid shoulder pads as a option. To be specified at the time of ordering. STORM FLAP The storm flap shall not be less than four inches wide and & CLOSURE: shall be 26 to 28 inches long. The flat shall be securely closed by four snaps & four reversed snaps. POCKETS: Coat shall have two outside extra large pouch type pockets, 9 inches wide and 10 inches deep. Drainage of moisture shall be provided for by an eyelet at pocket bottom. There will be a 3 inch deep flap, double thickness, hinge type, wider than pocket with snap closures on each pocket. Pocket will be reinforced with bar tacks at both sides of top and at both sides of flap. Also one breast radio pocket with flap, 2 snaps and one drain hole. The pocket to be located on left side, the size to meet our radio dimensions. REFLECTOR- 3 inch silver trim as shown in illustration below. LENGTH: REJECTION: If any coat is found to be defective the City of Oshkosh Fire Department will notify and an exchange will be made. SPECIFICATIONS DAY BOOT SPEC - STORMKING TYPE (3/4 LENGTH) Total 61 pairs (more or less) Boots shall be full sizes, available in sizes 5 thru 14, in high grade rubber and shall incorporate the following features: 1 . Built-in shin protector 2. Cellular foam insulation 3. Steel toe to meet and surpass ANSI Z41 . 1 , 1967/75 specifications 4. Felt midsole 5. Kleet-grip sole 6. Flexible stainless steel midsole, solid, 1 piece construction 7. Built- in steel shank in the instep 8. Felt lined inside with duraheel 9. FRUEH City Manager FROM: DON LaFONTAINE Purchasing Age 't SUBJECT: TURN OUT COATS AND BOOTS Attached please find a bid tab on turn out coats and boots for the Fire Depart- ment. As you can see, the law bidder meeting specifications on the coats is General Fire of Oshkosh. We also received bids and quotes from Goodall Rubber Company and Servi Fire Control but neither meet the specifications on the coats. Both do not meet the specs in that we asked for a wing free set in construction; in other words, the coats are to be sewn like a shirt, attached at the shoulder rather than at the neck (which prohibits movement by the Fire Fighters) . Also, the outer garment is supposed to be a 3 piece shell; their's is only a single shell. On the boots, all venders meet specifications. It depends on who you want to purchase from. The difference between the low bidder, W. A. Dorpahl and General Fire is $30.50. I think here we should give local preference since General Fire is right here in Oshkosh and service after the sale is very important. However, W.A. Dorpahl of Green Bay is willing to come down and measure eac', man but for time and convenience, General Fire would be there measuring for coats so they could measure for boots at the same time. Chief Phillipps has reviewed these specifications and bids and recommends the low bid on the coats; that being General Fire, and the second low bid, General Fire, on the boots. I would appreciate your comments.
