PURPOSE: APPROVAL OF AGREEMENT FOR PROFESSIONAL SERVICES
WITH HYDRODESIGNS, INC. TO ASSIST WITH MANAGEMENT OF
A POTABLE WATER SYSTEM BACKFLOW CONTROL PROGRAM
IN THE AMOUNT OF $143,760.00

BE IT RESOLVED by the Common Council of the City of Oshkosh that proper City
officials are hereby authorized to enter into and take those steps necessary to implement
an appropriate professional services agreement with HydroDesigns, Inc. for assistance
with management of a potable water system backflow control program including a review of
the current program, public awareness, educational material, preparation of reports and a
policy manual, ordinance review and recommendations, and 660 industrial and commercial
inspections each year for a period of two years in the amount of one hundred forty-three
thousand seven hundred sixty dollars ($143,760.00).

RE: Approval of Agreement for Assistance with Performance and Management of a Potable
Water System Backflow Control Program/ HydroDesigns, Inc. (HDI) ($143,760)
BACKGROUND
In 2012, the Wisconsin Department of Natural Resources (WDNR) updated the Administrative Code
requirements for the cross-connection control program for industrial, commercial, public authority, and
residential properties connected to the water distribution system. A cross-connection is a physical
connection between the water supply and another water source that that can cause a back-siphon effect
and contaminate the public water supply. Cross-connections are currently prohibited by the City of
Oshkosh Municipal Code.
The WDNR rules require that a comprehensive cross-connection control program be implemented for
elimination of existing cross-connections and prevention for future cross connections. This is to be done
through an inspection program for industrial and commercial properties every two years.
ANALYSIS
The City entered into a two-year agreement with HDI in February 2012 to provide these services. HDI has
provided a proposal to continue providing assistance to the City's cross-connection control program
program for another two years. The elements in the HDI proposal includes a program review meeting,
public awareness program, assistance with educational material, preparation of management reports,
review of cross-connection control ordinance, preparation of a policy manual, and 660 industrial and
commercial inspections each year over the two-year program for a total of 1,320 inspections. Data
management will be also provided throughout the contract period using the HDI Software management
program.
FISCAL IMPACT
The total cost of the program for the 2014 to 2016 time period is $143,760 and is funded in the Water
Utility operating budget. This proposed program cost compares to a $159,600 expense for 2012 to 2014.
RECOMMENDATIONS
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a
specialized nature may be procured without the use of formal, sealed quotes. I have reviewed this
agreement and in accordance with Section 12-16 of the Code, I am hereby recommending that the
Common Council approve this agreement.
