TO CONDUCT A SEDIMENT SAMPLING INVESTIGATION AND SEDIMENT DISPOSAL CHARACTERIZATION FOR THE SAWYER CREEK CHANNEL IMPROVEMENT PROJECT IN THE AMOUNT OF $9,584.18 INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the City and AECOM previously entered into a professional services agreement in which AECOM would determine the nature and extent of contamination in the sediment that was discovered during the dredging process of the Sawyer Creek Channel Improvements project; and WHEREAS, additional engineering services are required to meet requirements from the WDNR. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are authorized and directed pursuant to Section 12- 16 of the Municipal Code to enter into an amended agreement with AECOM to conduct a sediment sampling investigation and sediment disposal characterization for the Sawyer Creek Channel Creek Improvement Project including sampling of the carriage water from the dewatering area for discharging into the Fox River or the City of Oshkosh sanitary sewer system; completion of Discharge Monitoring Reports for the WDNT; and coordination with the WDNR, the City of Oshkosh and the dredging contractor. BE IT FURTHER RESOLVED that an amendment to the agreement with AECOM is approved and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the final agreement. Gohde, Assistant Director of Public Workss,.,9 DATE: February 20, 2014 RE: Amendment to Engineering Services Agreement to Conduct a Sediment Sampling Investigation and Sediment Disposal Characterization for the Sawyer Creek Channel Creek Improvement Project/AECOM ($9,584.18) BACKGROUND Advance Construction, Inc. was awarded Contract 12-03 — Sawyer Creek Channel Improvements at the May 22, 2012 Common Council meeting. While dredging in the area between Sawyer Street and the Fox River, a sheen appeared on the water surface. The appearance of the sheen is an indication of contaminated sediment. The Department of Public Works contracted with AECOM to determine the nature and extent of the contamination and to provide recommendations for the approach for the remainder of the dredging and for disposition of the dredged sediments. Their recommendations were submitted in a report dated February 14, 2013. The report recommended collecting additional sediment samples and providing a summary report. The Wisconsin Department of Natural Resources (WDNR) also added additional requirements. The services needed to meet these requirements included sampling of the discharge water from the dewatering area prior to entering the Fox River or the City of Oshkosh sanitary sewer system; completion of Discharge Monitoring Reports for the WDNR; and coordination with the WDNR, the City of Oshkosh, and the dredging contractor. AECOM submitted an amendment to the engineering services agreement to complete these additional services. ANALYSIS AECOM was chosen due to their experience on previous environmental engineering projects for the City. Staff has reviewed the amendment and costs. The proposed fee is time and materials $9,584.18 for a total contract amount of$136,349.18. FISCAL IMPACT Funding for these services is available in the Storm Water Utility. RECOMMENDATIONS Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature, including engineering services, may be procured without the use of formal, sealed quotes. I have reviewed this amendment and in accordance with Section 12-16 of the Code, I am hereby recommending that the Common Council approve this amendment. Approved, 49.7{4%/1- Mark A.
