HomeMy WebLinkAbout11. 14-45 JANUARY 28, 2014 14-45 RESOLUTION (CARRIED___7-0_____LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVAL OF AMENDMENT TO ENGINEERING SERVICES AGREEMENT WITH FOTH INFRASTUCTURE & ENVIRONMENTAL LLC FOR DESIGN OF THE SOUTHWEST INDUSTRIAL PARK EXPANSION IN THE AMOUNT OF $44,501 INITIATED BY: DEPARTMENT OF PUBLIC WORKS WHEREAS, the City and Foth Infrastructure & Environmental, LLC, previously entered into a professional services agreement in which they would provide the City with design related services for Phases 3 and 4 of the Southwest Industrial Park; and WHEREAS, the project was delayed due to wetland delineations and coordination with Wisconsin Southern Railroad for the crossing of Global Parkway requiring additional compensation. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are authorized and directed pursuant to Section 12- 16 of the Municipal Code to enter into an amended agreement with Foth Infrastructure & Environmental, LLC for final engineering design work and the preparation of plans for site grading, storm water management, sanitary sewer, water main, and streets construction for the Southwest Industrial Park Expansion. BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated from: Acct. Patek Tbc4 DATE: January 23, 2014 RE: Approval of Amendment to Engineering Services Agreement for Design of the Southwest Industrial Park Expansion/ Foth Infrastructure& Environment, LLC (Foth) ($44,501) BACKGROUND In 2009, Engineering Division staff requested a proposal from Foth to perform the final design engineering and prepare construction plans/specifications for Phases 3 and 4 of the Southwest Industrial Park. The expansion area is north of the Wisconsin Southern Railroad line, south of the YMCA, and east of Clairville Road. The proposed work included plans for site grading, storm water management, sanitary sewer, water main, and street construction. ANALYSIS The original proposal was requested from Foth due to their involvement and familiarity with the project. Foth performed the preliminary engineering work to lay out the streets/utilities and performed environmental reviews for wetlands/other environmentally sensitive areas. Another amendment is required for this project because it has been delayed due to wetland delineations and coordination with Wisconsin Southern Railroad for the crossing of Global Parkway. Additional compensation is also due Foth for cost of living price increases. FISCAL IMPACT The original agreement for this design was for $120,500. A previous amendment of $50,100 was approved in May of 2012. This amendment is recommended in the amount of $44,501, which would bring the total agreement amount to $215,101. Funding for this project is included in the 2013 Capital Improvement Program in the Tax Increment Financing District Improvements section. RECOMMENDATIONS Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a specialized nature, including engineering services, may be procured without the use of formal, sealed quotes. I have reviewed this amendment and in accordance with Section 12-16 of the Code, I am hereby recommending that the Common Council approve this amendment. Approved: M rk A.
