FIRE STATION MANPOWER SERVICES
WITTMAN FIELD AIRPORT
WINNEBAGO COUNTY
THIS AGREEMENT , made and entered into this _212d___ day of
October , 1987 , by and between the CITY OF OSHKOSH , A State of
Wisconsin Municipal Corporation, hereinafter called "City", and
WINNEBAGO COUNTY , a State of Wisconsin Municipal Corporation ,
hereinafter called "County" .
WHEREAS, Wisconsin Statutes, Section 66.30 , authorizes
municipalities to enter into government contracts to provide
services authorized by Wisconsin Statutes , and
WHEREAS, it is mutually beneficial for the City and the County
to enter into a fire services agreement for Wittman Field Airport ,
and
WHEREAS, the governing bodies of the City and County have duly
adopted resolutions authorizing the execution of this Agreement ,
NOW, THEREFORE, BE IT RESOLVED that the City and the County for
and in consideration of the mutual covenants and undertakings herein
contained do agree as follows :
,SECTION I
FIRE ,STATION
The County will provide and maintain, and the City will man and
operate , the fire station located on Wittman Field Airport , City of
Oshkosh, Winnebago County , Wisconsin. Except as hereinafter
provided , the City shall not be liable for any portion of the cost

of equipping or operating said fire station except through the
annual County tax levy .
SECTION II
EQUIPMENT
The County will , at its own expense , provide and equip the fire
station with whatever fire fighting and rescue equipment the County
is required to have at Wittman Field to satisfy the requirements of
Part 139, Title 114 of the Code of Federal Regulations. The City
will , at its own expense , provide and equip the fire station with
whatever fire fighting and rescue equipment deemed necessary by the
City. The County CFR vehicles may be used only in major off-airport
emergencies requiring a foam agent when , in the judgment of the
responsible City fire commander, such major emergency exceeded the
City's regular and on call equipment capabilities , and is subject to
the following conditions :
1. Petrochemical type of fire requiring foam capacity above
the capacity of the City Fire Department .
2 . County CFR vehicles will be the last unit on the call list .
3 . The duty chief will notify the Airport Manager or his
designated representative when it becomes necessary to use the
County CFR vehicles. The Airport Manager will then declare an
emergency and immediately issue a notice to airmen, limiting the air
carrier user operations on the airport to the requirement of the
index (no lower than Index A) prescribed in FAR 139.149 that provides
the protection capability of the airport's remaining equipment.
Only then will the County CFR vehicles be released for off airport
use .

4. A written report describing the emergency and all actions
involving airport fire fighting resources shall be furnished within
twenty-four (24) hours to the Airport Manager by the City Fire
Department. A like report will be furnished the F.A.A. Great Lakes
Region , Airports Division , Certification Staff, within forty-eight
( 48) hours .
The City agrees to replace any County owned extinguishing
agent , fuel and the like expended by City from County owned fire
fighting and rescue equipment at or in response to a City fire call ,
and to do so at the earliest possible opportunity so as to insure
that County owned fire fighting and rescue equipment will not be out
of service at the airport. County agrees to replace any City owned
extinguishing agent , fuel and the like expended by the City in
response to an airport fire call .
SECTION III
UTILITIES
The County will pay for all utilities necessary to operate the
said fire station to include heat, light , sewer and water and
telephone charges .
SECTION IV
INSURANCE
The County will provide fire insurance on the fire station and
all County-owned equipment located therein. The County will provide
public liability and other insurance necessary to protect the
County ' s interests with regard to the said fire station .

The City agrees to provide workmen's compensation insurance
coverage for City employees engaged in fire fighting activities on
Wittman Field .
SECTION V
TRAINING FACILITY
The City may construct and operate a fire fighting training
facility on Wittman Field at a site thereon which is acceptable to
the City and the County . The County will not be liable for any
construction, operation or maintenance costs connected with said
training facility unless the County specifically agrees to be
liable. The City will hold the County harmless from any and all
liability which may arise from the operation of said training
facility. The City agrees to construct and operate the said
training facility in accordance with city , county , state and federal
rules and regulations .
aECTION VI
SNOW REMOVAL
The County agrees to remove the snow from all the roads on
Wittman Field leading to and from the fire station .
SECTION VII
MANNING OF EQUIPMENT
The City agrees to provide properly trained personnel at its
own expense to effectively operate the County-owned fire fighting
and rescue equipment located in the fire station on Wittman Field.
Properly trained personnel is defined as one ( 1) fire fighting

company consisting of nine (9) men. Any additional fire fighting
personnel required by Winnebago County shall be at the expense of
the County .
SECTION VIII
TERM
The term of this Agreement shall be for one year , from October
1 , 1987 , through September 30 , 1988, except that the parties may
mutually agree to extend this Agreement upon notice to the parties.
Said notice to be addressed to the Clerk of the respective party.
The City agrees to remove it's personal property from the fire
station and training facility forthwith on the effective date of
termination .
SECTION IX
FIRES ON WITTMAN FIELD
The City will , at no cost to the County , respond to any type of
fire which may occur on Wittman Field provided it receives a proper
request to do so. For purposes of this Agreement , a proper request
of the City for fire fighting service shall be one received in
accordance with the Standard Operating Procedures for aircraft
incidents and accidents contained in the Wittman Field Airport
Operations Manual and Emergency Plan. A copy of this plan is
maintained by the City of Oshkosh Fire Department and updated as
needed. Nothing herein shall limit the City's obligation to respond

to all types of fires or other emergencies which may occur on
Wittman Field , aeronautical or otherwise .
