Box 1130 Oshkosh, WI 54903-1130 SUBJECT: Amendment to Agreement for Costs of Additional Geotechnical Services Proposed North Main Street Reconstruction (Contract 14-02) From New York Avenue and Murdock Avenue Oshkosh, Wisconsin MES Project No. 3-33062 City of Oshkosh Purchase Order No. 121185 Dear Mr. Sargent, The subsurface exploration and subgrade evaluation for the referenced project has been completed, the results of which have been provided previously. The description of services and authorization to perform the subsurface exploration and evaluation were in the form of a City of Oshkosh Consultant Agreement between Midwest Engineering Services, Inc. and the City of Oshkosh, dated July 5, 2013, and referencing MES Proposal No. 3-3057, dated June 19, 2013. As part of MES' Proposal, as well as the Agreement, the total cost for the requested geotechnical services was estimated to be on the order of $4,995.00. Following completion of the requested subsurface exploration and subgrade evaluation, MES submitted an invoice to the City of Oshkosh for the geotechnical services performed as part of the requested evaluation (MES Invoice 3330623-IN, dated August 31, 2013) in the amount of $6,724.00. As such, the amount invoiced exceeded the estimated total cost by $1,729.00. MES is submitting this letter to outline the additional services performed for the requested exploration and evaluation. Geotechnical Services A total of fourteen (14) soil test borings were initially planned along North Main Street between New York Avenue and Murdock Avenue to a specified depth of 20 feet to evaluate the subsurface conditions along the roadway. A total of 280 lineal feet of soil drilling and sampling was originally proposed. However, auger and/or sampler penetration refusal on cobbles, boulders or possible bedrock was encountered in seven (7) of the initially planned borings at CITY OF OSHKOSH DEPARTMENT OF PUBLIC WORKS 215 CHURCH AVENUE, P.O. The Scope of Work described in the existing agreement included the provision that additional products and/or services may be provided if requested in writing by the Authorized Representative of the CITY. THEREFORE, the CITY and the CONSULTANT agree to insert the following paragraph after the first paragraph in ARTICLE III. SCOPE OF WORK: "The CONSULTANT shall also provide the services described in the CONSULTANT's Amendment to Agreement for Costs of Additional Geotechnical Services dated September 10, 2013. These services include additional blind drilling and rock coring services." The CITY and the CONSULTANT further agree to CHANGE the Time and Materials Not to Exceed Fee from $4,995 to "$6,724 (Six Thousand Seven Hundred Twenty Four Dollars)" in ARTICLE VI. PAYMENT. As a result, seven (7) additional borings (B-7A, B-9A, B-10A, B-11A, B-12A, B-13A and B-14A) were drilled without sampling (blind drilled) at offset locations to determine if the boring depths could be extended beyond the initial refusal depths. At B-9A, and B-12A through B-14A, the borings were extended past the initial refusal depths, where sampling resumed to the planned termination depths. At B-7A, B-10A, and B-11A, rotary rock coring of the refusal materials was required in order to advance the borings beyond the refusal materials and to characterize the refusal materials encountered. The rock coring runs extended 4 to 5.5±feet into the refusal materials. Upon completion of the exploration, a total of 262 lineal feet of soil drilling and sampling, 95.5 feet of blind drilling, and 14 feet of rock coring was performed for this subsurface exploration to extend the borings to the specified depth. The estimated cost provided in MES' proposal was based on 280 lineal feet of drilling and sampling by hollow stem augering methods. As such, the total estimated cost outlined in MES' Proposal for this evaluation did not include the costs associated with the additional blind drilling and rock coring services; quantities of which were unknown at the time of the proposal. The cost of the additional services performed totals $1,909.00. After accounting for the difference in soil drilling and sampling footage performed and originally proposed (262 feet - 280 feet = -18 feet x $10/foot = -$180), the cost of the additional services included in MES' invoice equates to $1,729.00.
