PURPOSE: APPROVAL OF AMENDMENT TO ENGINEERING SERVICES
AGREEMENT WITH STRAND ASSOCIATES, INC. FOR
CONSTRUCTION RELATED SERVICES FOR THE SAWYER
CREEK CHANNEL IMPROVEMENTS IN THE AMOUNT OF
$80,000.00
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the City and Strand Associates, Inc. previously entered into a
professional services agreement in which they would provide the City with services related
to the construction of the Sawyer Creek Channel Improvements; and
WHEREAS, the discovery of contaminated sediment and excessive amounts of
rocks in some of the material to be dredged required additional services.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are authorized and directed pursuant to Section 12-
16 of the Municipal Code to enter into an amended agreement with Strand Associates, Inc.
for the provision of additional construction related services for the Sawyer Creek Channel
Improvement Project.
BE IT FURTHER RESOLVED that said City officials are authorized and directed to
take those steps necessary to implement the terms and conditions of the final agreement.
BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated
from:

RE: Amendment to Engineering Services Agreement for Construction-Related Services for
Sawyer Creek Channel Improvements/Strand Associates (Strand) ($80,000)
BACKGROUND
The Department of Public Works contracted with Strand to provide construction-related services
associated with the construction of the Sawyer Creek Channel Improvements. Due to the discovery of
contaminated sediment east of the Sawyer Street Bridge, and the discovery of excessive rocks in some of
the material to be dredged, additional services are required. These services include additional site visits
and attendance at progress meetings for the 2013 and 2014 construction seasons, progress surveys, a
final post-construction survey of Sawyer Creek, and assistance with Wisconsin Department of Natural
Resources' permit amendments.
ANALYSIS
Strand was chosen due to their experience with the Sawyer Creek Watershed and the design of the
Sawyer Creek Channel Improvements Project. Staff has reviewed the amendment and costs. The
proposed fee for this amendment is not to exceed $80,000 for a total contract amount of$225,000.
FISCAL IMPACT
Funding for these services was accounted for in the Storm Water Utility 2013 CIP bond borrowing, and is
available in the Storm Water Utility.
RECOMMENDATIONS
Chapter 12 of the Municipal Code of the City of Oshkosh provides that professional services of a
specialized nature, including engineering services, may be procured without the use of formal, sealed
quotes. I have reviewed this amendment and in accordance with Section 12-16 of the Code, I am hereby
recommending that the Common Council approve this amendment.
